Failure to Slake Report.
During a colloquy between Dr. C H.
Chapman and Frederick V. Holman. at
last night's meeting of the Charter
Board, the open charge of falsehood was
passed and npeated. For a time the
controversy threatened to turn the ses
sion Into a stormy one. but Dr. Chap
man refused to take more than a pass
ing notice of the terms applied to a
statement he had made.
The atorm arose over Dr. Chapman a
motion to strike out the closing sen
tence of section 108 In the present char
ter on "Forfeiture of Franchises Not
Vsed." In explaining his reasons for
striking out the words of the sentence.
Dr. Chapman said he had been Informed
that the Portland Railway. Light &
Power Company had. under this provision
of the present charter, refused to make a
report to the city authorities, as required
by the charter.
Mr. Holman who. for two years past,
has been the attorney for the railway
company, was also a member of the other
Charter Board. When Dr. Chapman made
this statement. Mr. Holman was on his
feet !n a moment, demanding to know
where the speaker received his Informa
tion that the railway company had re
fused to make a report through the
strength of the closing sentence. Dr.
Chapman refused to answer the ques
tion, and then It was that Mr. Holman
said:
Holman Calls Statement False.
"The statement that the railway com
pany refused to make a report to the
city because of this part of Ide present
city charter la absolutely false."
"f do not care." replied Dr. Chapman,
"whether you say it is false or not. It
remains that the railway company has re
fused to make a report to the city."
"I assume." replied Mr. Holman. with
unmistakable signs of anger, "by the
way you talk that you don't care, and I
say again that such a statement la
false."
"You may call people liars If you want
to." retorted Dr. Chapman, "neverthe
less, the fact remains that the railway
company has taken refuse behind this
section and has refused to make a re
port." By this time Richard W. Montague and
City Attorney J. I. Kavannugh took a
hand in the wrangle. Mr. Montague ad
mitted at the outset of his remarks that
he was perfectly willing to vote out of
the section the sentence which reads:
"Nothing In this charter contained shall
afTect the validity of any franchise, right
or privilege In actual use or enjoyment
heretofore given or granted 1'V any
former or the present City of Portland
or by the City of East Portland or by
the City of Alhlna, and the same shall
be and continue In force and effect as
given or granted by said cities or either
of them."
He stated, however, that It had never
come within his knowlenge that any cor
poration had dodged behind It.
Tronblons Section Voted Out.
Dr. Chapman had stated previously that
he had consulted City Attorney Kava
naugli concerning the wording of the sen
tence, and had been advised to recom
rnend that It be stricken out. Again Mr.
Holman took the floor and demanded
to know If he or any of the attorneys
representing the railway company hud
discussed the matter with the City At
torney. Mr. Kavanaugh said that he
was not aure whether It was, Mr. Holman
or some other attorney for the company,
but he was sure he had been apnroached
upon the subject, and he believed It was
bv Mr. Holman. Thta Mr. Holman em
phatically denied. The matter finally
came to a vote upon the motion to strike
out the sentence. When the vote was
taken, all voted for its removal but Mr.
Holman.
Once till matter was settled, a number
of Important matter were taken up and
harmony prevailed throughout the rest of
the session. Mr. Montague called atten
tion to the fact that the life of the Com
mission was drawing to a close and urged
that the Board meet more often. .
There will be a meeting tonight and
another Thursday afternoon and at least
four. If not more meetings, next week.
Before the memb-ra got down to busi
ness they were addressed by Mrs. Abigail
P-ott Dunlway. Mrs. Dunlway wanted
the Board to make a charter provision
granting taxation suffrage to women and
made one of her forceful talks. I'pon
motion of T. B. Wilcox, a vote of thanks
was extended by the members of the
Board to Mrs. Dunlway for her excellent
address.
Several paragraphs In the report sub
mitted by the committee on finance,
revenue and taxation were referred back
to the committee BjirS made a epeclal
order of business for the next mcet
lrr. The first part of the report was adopted
amending the section governing the tax
levy. It provided for a levy of J-2S mills
for the fire derartiuent and l.So mills
for the police. On motion of Mr. Mon
tague thta was further amended so that
the Are department will get a tDO-miU
levy and the police a l.K-mlll levy.
The rest of the levy recommended! Is
a follows:
lighting. .75 mills: library, JO mills;
street repair, .75 mills; parks, .50 mills.
And that the levy for bridges shall not
exceed 1 mill.

Insane Asylum, sent here only last Sat
urday. January 3. from Lane County,
was smothered by another female late
Monday night because she made too
mnch noise. A sheet was Jammed Into
Mrs. FYeece's mouth and a pKlow placed
over her head. The vlctom was In a
strait-Jacket and could not help herself.
Coroner Clough made an Investigation
and absolved the asylum authorities from
blame, holding the affair to have been
unavoidable.

The three-masted schooner C. A.
Thayer Captain Peterson. SJ days out
from the Hawaiian Islands, arrived In
port today, practically all of her rigging
gone. The captain reports that while
going through a pass between the Islands
he was caught by severe winds and
heavy seas, which carried blm some w
miles south of his course. The foresail
was the first to go by the board; then
went the main boom, and two days later
he lost his main gaff.
