Plgitott. W. V,'. Holcomb. Charles F. Lnrd and W. O. Campb.ll. attorney for James A. Finch, the convicted mur-4-rer of Ralph R Fisher, have resigned an his counsel. PlKSott says It Is becausa trey were not remunerated. Finch says 1 is because Flgeott tried to hold him up. Finch bitterly denounces his former law partner, although he does not say that the other attorneys have not treat ed him fairly. Finch eays he Intends to have his caso token into the Federal court, where he expects a new trial. He nay he will never pay the death penalty, lie had not secured an attorney last night. " I can see hope now that Flfarott ha resigned." continued Finch, "but I could see no liope the other way. He wanted me to deed over to him all my property, leaving my mother and wife with noth ing. Then, after I had done that, he mould have been glad to have seen me out of the way so I wouldn't be bother ing him about it." Finch said he deeded Plgpott 15 lots in Fulton Park, worth about $0o0, with the understanding that Piggott was to t-U the property and give Mrs. Finch $C0o. keeping the other half for hlmoelf and the three other attorneys. In addition to this he says his wife was to pay Picgott $7; In cash. He aoserts that Piggott owes him between $1500 and 110 as his share of the law partnership. Finch says that he owns a fifth interest in the Smith tract, at Flavel, near As toria, of which Governor Chamberlain is the trustee. He declares that this is worth ?!).. Piggott wanted him to deed this over, he says, besides his wife's cot tage at Tremont station, on the Mount Scott carline. A portion of this property ! now held by Piegott to secure the bonds of C. IL and C. H. T. Atwood. against whom charges of malpractice were lodged, but who have not yet been tried. Their ball Is $10.0 each. - Finch complained yesterday that a week has passed since his conviction, durintf which time Pisott, Finch says, hae done nothing" except try to force upon him an agreement to give up all his property. "He told me if I didn't sign one of these two agreements." said Finch, "he would do nothing more to prevent the halter from being drawn about my neck Febru ary 5. He told me I was only driving nails in my coffin. When he couldn't get my property b,y cajoling me. he tried to do It by threats. Bijarcr A Wilson are endeavoring, with my wife, to secure the services of an attorney who Is now out of the city." Mr. Lord In discussing his withdrawal from the casse. last night, said: "My withdrawal from the case and also that of W. W. Holcomb was for the rea son that it appeared to be the desire of Finch. As we both have given our best endeavors on behalf of Finch and with out remuneration, or means to properly handle the matter, we feel it is unchari table at this time to bring us into the limelight and charge ut with failure prop erly to protect the rights of the man. "The record of motion for a new trial has not yet been completed and It Is im possible, in the face of present disagree ments about counsel, to expect that we would be able Justly to present the mo tion in court on Saturday the day set for a hearing on the motion. So far we have done everything possible, I believe, to protect the rights of Finch and I am sure rlneh s rights will be looked after in the future, if not by us thin by those who succeed us in his behalf." TRIE1 FOR SALOO.V 1IOM1-LP Many Witnesses Support Charges Against Merle 'West. Merle West is on trial before a Jury 'n Judge Morrow's department of the Cir cuit Court on a charge of robbery. Wit nesses for the state related yesterday liow a young man resembling West held up the saloon at Grand and Hawthorne avenues about midnight October 3. He obtained $4 in cash from Erick Huseby, the bartender. W. II. Butts and A. V. Butts were in the saloon at the time. Besides these three the witnesses for the st.ite were John Stockton. Fred Kil mer. J. A. Reed. Thomas Smith. John H. Price and Thomas Coleman. West took the stand in his own behalf late yesterday afternoon. He said that on the nlht of the hold-up he took a young woman to the theater. After the play, he said, they went to a restaurant. He was asked if he carried a gun that night and replied that he did not. al though other witnesses had testified that lie hud one. He admitted that he some times carried a revolver, and upon being closely questioned about his reason for s doing, appeared much confused. He ssld he had given two of his acquaint ances Joe Le Paige and Bob Stewart permission to sleep In his room, as they were out of work, but that he w.is dis trustful of the latter. West at last stated that he took the wenpon so Stew art would not steal It. as West had seen him wearing his neckties. Asked why he did not have the girl In court to testify in his behalf. West said her folks told her tliey would disown her If she was connected publicly with the case. The ense will b placed in the hands of the jury this morning. Contraetor Sued for $35,000. James Flumb is suing Robert Wake field in the Circuit Court to recover $"-.-for the loss of his eyesight and in juries to his head. He says that he was working on a railroad bridge lust May. which whji being constructed by the Port land Bridge & IVuiiiling Company.
