In the harbor at 8 o'clock this morning

Word of th capture had already been
received here, and a (treat throng of peo
ple lined the quava to witness the en
trance of the Dutch battleship conduct
ing: her capture within fhe harbor.

The fla of the Netherlands had been
hoisted to the peak of the captured
Veneiuelan cnast-auard ship, and astern
tha Dutch flar floated the Venezuelan
colors. Although, tho Venezuelan flax
iras atlll ehonn It was In minor con
trast to the Dutch pennant flylnjr from
the mainmast and foremast, on both of
the warships and Its prize.
Th capture of the "23 De Mayo" was
effected December U. at a point a little
north of Cumana. on the Gulf of Cura
cao. The battleship Jacob Tan Heems
krk observed the "23 Do Mayo" in the
ofnn. took possession of her and sent a
pr"ie crew aboard. The Venezuelan crew
which had been In charco ofthe "23 De
Mayo" wa sent ashore In the small
boats of the captured ship. The van
Heemskerk then proceeded back to tie
port escorting her prize.
The crew of the "23 De Mayo" made
no resistance. All of the officer found
on board were sent ashore with the
rrew.
The "23 De Mayo" waa formerly an
American steamer callPd the Alliance.
She belonced to a Mr. Smith, who was
at one time American Consul here. She
was raptured by Venezuela In lW while
In distress off Maracaibo on the around
that ahe was emracerl In running- contra
band to the Venezuelan coast.
Mr. Smith made a claim afralnst the
Venezuelan rovernment for the vessel
and his demand was reduced In 1903 to
$2900 by the mixed commission that
adjudicated various matters of this kind.

The Dutch cruiser Gelderland left here
yesterday for the Venezuelan coast. She
bad on hoard a aeaman thoroughly ac
quainted with the small bays and Inlets
along the Venezuelan ehore.
She Is out after the torpedohoat Mar
rnrita. a steel vessel of 97 tons, and
armed with four three-pounders and two
torpedo tubes. The vessel k supposed to
be at the Island of Marirerira.
The Jacob van Heemskerk will leave
here tomorrow to resume her patrol serv
ice on the coast.
The "23 De Mayo." while classed as a
eoast-ruard vessel. Is a unit of the Ven
ezulan navy, but her size and strength
are Inaigntflcant. She Is of IV tons and
la armed with one machine gun. '

Situation at Venezuela Unusual In
History of Country.
WASHINGTON'. Dec. 14. The exist
ence of what amounts practically to a
state of war between Holland and
Venezuela, the absence for the first
time In many years In an acute crisis
nf this kind of American warships from
their proper sphere of Influence, and
tho profession by the State Depart
ment officials of their ignorance of
the intentions of Holland ponstltute a
most curious and interesting interna
tional situation.
The fact that America has a quarrel
f her own with Venezuela and has
terminated diplomatic relations with
that country Rives rise to doubt as to
the accuracy of the statement that this
Government Is not interested In what
Is R-oina; on off the coast of Venezuela.
Indeed there is reason to lteiiee that
while official records may fall to show
the existence of any formal agreement
between America and The Netherlands,
the government of the latter country
Is proceeding: with the tacit consent of
America, to bring- to an end the chaotic
conditions that have prevailed in an
International sense In Venezuela for
the past two years. So lona: as tho
Dutch ships act strictly within the
lines of the Monroe Doctrine as con
strued In the annual meesajre of Pres
ident Roosevelt of last year; so long
as no attempt Is made to seize Vene
zuelan territory for permanent occupa
tion: so Jong as the Dutch warships
captains confine their activities to the
seizure of Venezuelan ships he block
ade of rorts nnd the attempt to redress
the affront to Holland's honor there
will be no Interference on the part of
the Vnlted States Government.
Of course it is Inconceivable that this
Government has not already received
some assurances from Holland on this
point, but It Is probably the case that
these have not been reduced to writ
ing. The experience of the allied pow
ers who operated against Venezuela
several years aco would seem to have
Indicated to Holland the necessity of
coming to aome understanding with
the T'ntteS States before proceeding to
the point of actual hostilities, which
after all Is the situation on the Vene
zuelan coast notwithstanding diplo
matic disclaimers.
Logirally. the next step will be the
declaration of a blockade, and of this
due notice must be given by Holland
to all marttime nations In order to pre
vent the lodgment of claims for un
warrantable injury Inflicted upon neu
tral commerce.
Meanwhile the action of fhe Dutch
cruisers In seizing Venezuelan ships Is
calculated to have a depressing effect
upon the trade of Venezuela and to
discourage prospective shipments of
merchandise in the present unsettled
conditions.

CASTRO CALLS OX CHANCELLOR

BERLIN, Dec. 15. President Castro, of
Venezuela, who arrived last night from
Paris, called this morning on Chancellor
von Buelow and Foreign Secretary von
Schoen. leaving his card. The Foreign
Secretary later In the day sent Councillor
Ooetzch. who acted on the German In
demnity Commission at Caracas in 1903,
to return the call and Inquire ' concern
ing President Castro"s health. The local
newspapers today publish various ac
counts of the luxurious living- of Presi
dent Castro and party at their iotej In
thJji city. .

13 mm has been selected to try Thornton
Jenkins Halns, a Btory writer, as a prin
cipal In the killing- of William B. Annis,
a publisher, who waa shot to death by
Captain Peter Halns. Jr., at the Bayalde
Yacht Club last Summer.
One hundred and seventeen talesmen
were examined before theJury-box was
killed.
I The rjroaecution'a case will be presented
by DIstrk Attorney Darrln. and It Is
expected that the examination of wit
nesses by both aides wlU consume at
least two or three days.
A feature of the trial will be a tank
of water and a model of. the boat and
catboats In miniature, representative of
the. scene of the shootine. that will be
placed on a table In front of the wit
nesses. Iron men, representing the
principals of the affair, will be moved
about in this marine theater to Illustrate
actions and posttions taken la the
tragedy by Hants and witnesses.
Among; the Jurymen selected Is Wil
liam Hecker, chosen by Halns despite
the objection of his counsel. Another
talesman. Alexander Jardin, a milk
dealer, especially pleased Halns because
he lived In Texas and haa Indian blood
in hla veins. Of the other talesmen one
bad a prejudice apainst firearms, and
Rnother did not comprehend questions
put by counsel and was dismissed after
pleading illness.
One talesman. Hnrman Berrer. a

in Refunding Fares.
CHICAGO, Dec 15. At the opening of
the second day's hearing before Interstate
Commerce Commissioner Lane, concerning
the complaint of George S. Ixrftus that
the rates on sleeplng-oar bertha are ex
orbitant, a demand was made on the
Pullman Company for a statement show
ing the percentage of berths occupied
annually by persona holding passes. The
demand, which was made by Mr. Mana
han, attorney for the complainant, waa
vigorously opposed by Mr. Fernald for
the Pullman Company.
Mr. iAne ruled that the company
should produce the desired Information
and Instructed William Hough, assistant
auditor of the Pullman Company, who
had been recalled to the 6tand today, to
furnish the stateroent.
In response to a demand made yester
day, Mr. Hough produced a statement
showing the money lost by the company
In refunding fares. According to the wit
ness, the total amount of refund for the
fiscal year 190 was $S,R19 and in the fol-
