attorney- The charge aa developed
at a hearing yesterday In which he
was the only wltnesa, are follower
J That he married Lillian Monk
without obtaining a divorce from
Louise Powell-Steven.
That If, aa he clalme, he wae never
married to Mr. Louisa Powell
Stevens, be haa been guilty of a
statutory offense for the past 16
years.
That he was married in Kansas
City In 18S3 and to hie mother de
nied the marriage.
That his mother warned Mrs.
Louisa Powell-Stevens against him.
That he has failed to abide by the
terms of his separation agreement
with Mrs. Louise Powell-Stevens by
refusing to pay her the sum of $300
per month, as the contract provides.
Nervously defiant and braaenly assum
ing an air of offended decency, T. M.
Stevens, the wealthy clubman and ex
porter, aat for two hours and a half yes
terday forenoon under 'such an Inquisi
torial grilling- as few men of his standing
1 have ever been forced to endure.
A a result of hi admissions, confes
; sions and denials he will be prosecuted
either on a bigamy charge or a statutory
one. according to Attorney A. E. Clark,
who conducted the inquisition. However,
It rests entirely with Mrs. Louise Powell
Stevens, the woman abandoned by him,
whether or not Mr. Clark .will be per
mitted to Institute prosecution.
Still claiming to be his wife, after hav
ing lived with him as such for 16 years,
the woman has not yet given her full con
sent to his prosecution. She Is In a pri
vate sanitarium, broken in health and in
spirit as a result of her troubles, and afl
newspapers are denied her. Special pre
cautions have been taken to prevent her
from learning of the accusations against
her by Mrs. Lillian Monk-Stevens.
Drawn Into the office of A. B. Clark,
attorney for Mrs. Louise Powell-Stevens,
by a subpena. the man of many mar
riages yesterday admitted that he was
married In 18S3 to Miss Ida Well at Kan
sas City. He admitted that ha had told
his mother that he had never married the
woman, but denied that bis mother had
warned Mr. Powell-Stevens against him.
He further denied that he had deserted
ha first-wife and left her penniless when
she became ill.
Refusals to answer questions for fear
of incriminating himself were one of the
chief features of Stevens' hours of parry
ing with Mr. Clark. Many questions, he
said, were Immaterial, and he refused to
reply to them. Judge Thomas O'Day, re
tained as his counsel, sat beside htm.
Witness Refuses Replies.
During the Inquisition no reference waa
made to the marriage of Stevens and
Lillian Monk, though he refused to state
where or under what circumstances he
first met her. He also declined to answer
questions as to whether she had not visit
ed him In his room at the Eaton Hotel
on numerous occasions. There was no
resentment on his part when such Insin
uations were made against his present
wife merely a refusal to answer on the
ground that he might Incriminate himself.
Reports of detective agencies pur,
porting to show that he and Miss Monk
had frequently spent hours together
at the Eaton before their marriage,
and at a date prior to the date Miss
Monk claims to have met him, were
read to him and elicited no more than
a refusal to reply as to their truth.
However, he talked freely on the
financial relations between himself and
Mrs. Louise Powell-Stevens, and his
testimony In that connection differed
widely from his previous statements
and those of the woman who is now his
wife. The hearing was before a notary
public
"Is it not true. Mr. Stevens, that you
deserted Mrs., Louise Powell-Stevens
because of her refusal to comply with
your unprintable demands upon her?"
was the substance of a question asked
by Mr. Clark.
There was no sign of anger on the
part of the wealthy exporter merely
a refusal to reply.
The hearing was preliminary to the
suit which has been Instituted by Mrs.
Powell-Stevens. She claims that he
agreed to pay her $300 a month during
the rest of her life, and, although the
agreement was made a year ago, only
two payments have been made. Ste
vens was accompanied by Judge O'Day
and Attorney McKee.
"Is it not true, Mr. Stevens, that in
July of last year you were found by
detectives In a room at the Hyland
apartment-house on Morrison street
with a woman other than your wife?"
asked Mr. Clark.
"I decline to reply," answered the
clubman.
"Do you know Mrs. Gus Kuhn, of this
city?" he was asked.
"I decline to answer," was the reply-
"Were you in Portland on March 17
of thi year?" queried his inquisitor.
"I decline to answer," said Mr.
Stevens.
Incident at Hotel.
"Is It not a fact that on that day
you and a woman named Lillian Monk
went to Richards' Hotel at S o'clock in
the afternoon of that day, remained
there till after 8. then went to your
'roomi In the Eaton and remained there
until after 12 o'clock?" Interrogated
the inquisitor.
"I decline to answer," came the ster
eotyped reply.
"Well, the detective who watched
you stayed till 12. and when he left,
this Monk woman was still In your
room." retorted the attorney.-
Mr. Clark produced a letter written
by Stevens to Louise Powell-Stevens
last October, which began "My dear
Wife." followed by a stanza of senti
mental poetry, which Mr. Clark pro
nounced to be of Stevens' own com
position. "Was this written to your wife?"
Ved the inquisitor.
"It waa written to the -woman who
called herself Mrs. Stevens," replied
the exporter.
"Now. Mr. Stevens, is It not a fact
that you threatened to leave your wife
and to bring disgrace upon her unless
she would yield to certain unprintable
demands?" said the attorney, who ap
parently thought the wealthy clubman
had at last found another reply than
the regulation one. But he was mis
taken. "I decline to answer." said Stevens.
Story of Meeting.
"When did you first meet Louise
Powell-Stevens?" asked Clark.
"In the Fall of 1891."
"When did you begin living with
her?"
"About October of that year."
"How long did you live with her?"
"Fifteen or sixteen years."
"As man and wife?"
"Yes. sir."
"Continuously?".
"Yes. sir." .
"In all those years did you ever live
with any other woman as man and
wife?"
"No. sir."
"Where did you first live with her?"
"In the Perkins Hotel."
"How long?"
"One night."
"Where next?"
"In a roomlnghouse at Fourth and
Morrison."
Several other places were mentioned
as temporary domiciles.
"And you introduced this woman to
your friends as your wife?" asked
Clark.
"Yes. sir."
"Ever introduce her to people. In any
other way?"-
"Yes. I did to some."
"To whom?"
"I decline to answer."
"When you wrote letters to her how
did you address her?"
"Sometimes as 'sweetheart,' wifer
and 'dear.' "
"And in directing your mail to her,
how did you address it?"
"To Louise J. Stevens, sometimes,
and sometimes to Mrs. T. M. Stevens."
"Always that way?"
"I believe so."
Money for Release.
At noon the inquisition was ad
journed and will not be resumed until
next week. Before adjournment, how
ever. Attorney Clark took up Stevens'
contention that he had paid Mrs.
Teniae Powell-Stevens $25,000 to re
lease him. The claim has been heralded
by Mrs. Monk Stevens.
On the stand Stevens said he had
nalrl her 14000 In cash at one time,
$2000 at another, and $2500 at another
time. Then, upon cross questioning
by Mr. Clark, he explained that before
the separation agreement naa oeen
aimed bv both himself and Mrs. Pow
ell-Stevens they had sold a piece of
property owned Jointly by tnem.
From the sale the woman's proceeds
amounted to $10,000. He borrowed
$S000 of that amount from her. he
said, and he claims to have paid to
her the remaining $2000.
When the separation agreement was
signed he paid her back the $8000 he
haa borrowed, and stated that during
their It years as man and wife he had
paid her at various times for house
hold expenses the sum of $2500. How
ever, it is admitted by Mrs. Stevens
that at the time of the separation he
did turn over to her a mortgage for
$11,509, but It is denied that the wo
man received any cash that was not
already hers.
Stevens Files Answer to Suit.
T. M. Stevens filed in the Circuit
Court yesterday the answer to Louise
P. Stevens' charges that he has broken
his contract with her. The answer
was filed through Stevens' attorney,
Thomas O'Day. He makes a number
of counter charges against Louise P.
Stevens, one of them being that she
threatened to kill him and viciously
assaulted him.
NEGRO SLASHES OFFICER
HACKED ABOUT NECK, FACE
AXD SHOULDERS. .
Spokane Policeman Is Showered
With Rocks While Subdu
ing; Assailant.
SPOKANE. Aug. 20. After attacking
Mrs. Jane Lowe, alias Jones, a white
woman, Charles Lewis, a colored em
ploye of a carnival company showing
here, murderously assaulted Officer E. D.
Bradbury, with a knife, hacking him
about the neck, face and shoulders this
afternoon.
The attack upon the woman is said to
have occurred this forenoon in a lodging
house near Market street and Riverside
avenue. The negro's act la said to have
been witnessed by a little daughter of
the landlady. She managed to escape
from his grip and ran Into a rooming
house near by.
This afternoon as Officer Bradbury was
passing her window, Mrs. Lowe called him
in and related to him the story of the
attack by the negro. While the officer
was advising her as to what action to
take, Lewis, the negrofl opened the door
and asked him to come Into the hallway,
as he wished to speak to him.
As Bradbury stepped outside the room,
Lewie swung on him, stabbing him in the
left shoulder, at the same time exclaim
ing, " "I'll kill you." Before the officer
could get his club the negro had cut him
several times about the neck and chin.
Bradbury severely pounded the negro with
his club before he was able to subdue
him. A shower of rocks was rained upon
the special officer by other negroes In a
nearby lodging-house.

Mineral Springs Located.
MONTESANO. Wash.. Aug. 20. (Spe
cial.) A mineral spring has been dis
covered near this city and the water,
which was analysed by W. F. Bower,
contains quantities of lithla, magnesia,
iron and other medicinal properties. A
sample of the water has been sent to
the state laboratory at Pullman for a
more thorough examination. If results
are entirely satisfactory, the owner of
the property says he will build a san
itarium at the spring.
PENCE SAYS ROSS
TRIED TD RUIN HIM
Title Bank Gang Laid Trap,
Declares Promoter, but
He Escaped.
APPEARS IN STATE COURT.
Tence Called On to Tell Under Oath
Why He) Cannot Satisfy Judg
ment tot $4 82 Shows Four
Silver Dollars.
When called before Circuit Judge Mor
row yesterday forenoon to tell under" oath
what property he has and why he can t
furnish money or show property sufficient
to satisfy a Judgment of $482, Lafe Pence,
former Congressman from Colorado, and
head of the Pence Company, took occasion
to accuse J. Thorburn Ross. T. T. Burk
hart and John E. Altchison of having at
tempted to swindle and ruin him.
"I want to tell here, while I am under
oath." he said, "how these three men.
before the failure of the Title Guarantee
& Trust Company, laid a plot to put me
In the stack with old man Marquam; how
I hired detectives to watch them and
learned of their - scheme; how they laid
their trap In the grass while I sat on a
limb watching them."
Judge Morrow said he did not feel that
the proceedings before the court merited
any such exposure and directed that the
examination of Pence as to his personal
belongings proceed. Information was de
sired particularly as to Just how Mr.
I Pence came to sign a $10,000 bond in a
criminal ease with a Judgement for the
paltry sum mentioned hanging over his
head unsatisfied, despite earnest efforts
of the Sheriff to locate tangible property
on which to levy.
Mr. Pence worked In a portion of his
charges against Ross anyway and sup
plied the rest after the trial. He said
Ross and the others worked earnestly
and with desperate cunning to wrest his
holdings from him and nearly succeeded.
Quit Drinking to Watch Ross.
"I want to tell this so that if there Is
any other gang of thieves here plotting
against some person, It may serve as a
warning," he said. "I quit drinking whisky
Just to watch Ross, and if I hadn't he
would have caught me sure. I am the
only man who ever escaped from his
plots." ,
Elaborating on these accusations. Mr.
Pence said that the Pence Company had
spent large sums of money on a line of
flumes west of the city. Their plan was
to build what Is known as the Cornelius
Gap flume, buy timber land and turn
out 100,000 ties for the O. R. & N. Com
pany and at the same time utilize a
hydraulic plant In Balch's Gulch to wash
the top off a section of foothills Imme
diately west of the city and turn out
fine residence lots therefrom. The wash
from the plant was to be ran In to fill
the Cottle tract, about Guild's Lake.
An effort was made to sell 180 pros
pective lots to the Episcopal Church, but
the church wouldn't buy because Pence
would not give a bond for early comple
tion of the work, saying It depended en
tirely on rainfall. It was then that J.
Thorburn Rosa took up the company's
financial affairs, took over the company
Indebtedness to" John S. McMlllin, of
Seattle, who had been financing the proj
ect to a large extent and proposed fo
supply me 1' for completion of the plant
and equipmeirt.
Tells How He Beat Gang.
Pence says Ross" and associates waited
until they had him where they thought
he waa helpless, declined to furnish him
money at a critical time, as per agree
ment, and apparently had him on the
shelf as the result of crooked machina
tions and double dealings. He found out
their intentions, took the matter up with
W. M. Ladd, telling him of the dealings
of the Title Guarantee & Trust trio, and
shortly afterwards was able to secure
a release or a mortgage neia on nis
Balch Creek plant. In consequence of
his dealings wlfh Ross. Pence says he
Is Just where he was two years ago, and
feels lucky at that.
Questioned closely as to his property,
he said the Pence Company holdings are
worth $300,000, that he Is the principal
owner, but that corporation or personal
bills now outstanding cannot be met un
til the company get on a paying basis.
He said that Denver parties have fur
nished what money Is needed to put the
plant in operation and bring gigantic
plans to 8 consummation. A contract
with the United Railways has Just been
closed by htm. Pence said, to put 800,000
yards of filling in Guild's Lake this com
ing Winter, the contract price oeing iv
cents per cubic yard.
"Have you anything of value on you
to apply on this Judgment?" he wai
asked by the court.
Pence felt In his pocket and fished out
four silver dollars, which he turned over
to the clerk.
"If the money is really needed I Imag
ine I mlKht be able to go out and borrow
$10 more." he added. The Judgment In
question Is held by Emmons & Emmons.
Denies Award of Contract to Pence.
Lafe Pence has been awarded no con
tract to fill terminal grounds by the
United Railways, according to Lloyd
Wlckersham, chief engineer of the sys
tem. He says Mr. Pence made the com
pany a proposition to fill the Guild's Lake
property recently purcnasea ioc termi
nals, but that the proposal has not been
accented or rejected. What action will
be taken In the matter Is problematical.
