$3000 BONDS.
Declines to Di.cuss Charge of Man
slaughter and Is Bound Over
. to Grand ..Jury.
In the custody of Detective Hellyer,
Dr. F. J. Courtney, charged with man
slaughter In connection with the death
of a young- girl, arrived In Portland
yesterday afternoon and was taken at
once to police headquarters.
There Dr. Courtney was met by his
attorney. John H. . Stevenson, who ap
peared before Municipal Judge Van
Zante In his behalf. Mr. Stevenson
waived a preliminary examination In
behalf of his client who, in the sum of
$5000. was held to the grand Jury.
Bonds In that amount were quickly
procured, the defendant's brother-in-law,
E. K. Montague, and his wife. Mrs.
Ida M. Courtney, appearing as bonds
men. Dr. Courtney was Immediately
released after having been in custody
for 17 days.
Dr. Courtney was arrested at Indian
apolis, I-nd., July 23. on telegraphic in
structions from the police of this city.
At the time of is arrest he was at
tending the National Convention of Hi
bernians and was preparing to return
to Portland. However, he was prevented
from returning and bo'hdsjn the sum of
110.000 demanded.
Detective Hellyer was assigned to
make the trip to Indianapolis. He ac
companied Dr. Courtney to Portland,
the officer and prisoner arriving at 3
o'clock yesterday afternoon.
Dr. Courtney declined to discuss the
affair for publication. Those who de
sired to speak with him on the subject
were" referred to Mr. Stevenson, his at
torney. "There Is nothing new in the case,"
said Mr. Stevenson, "and Dr. Courtney
has nothing to say that would be of in
terest. He was preparing to return to
Portland when he was arrested and
has been held for 17 days. Indianapolis
Is not such a long Journey from Port
land and it looks llk it might have
been possible to permit him to give
bonds before this time, but it wasn't.
"Dr. Courtney has . a good defense
and one that, I think, will Justify him
in the eyes of everyone."

J. WILLIAMS MUST FACE
CHARGE IN PORTLAND.
Atfer Forfeiting $1500 Cash Bail,
Fugitive Is Arrested by Au
thorities in. Spokane.
J. Williams, alias J. Rawlance, who was
arrested at Spokane last week for smug
gling opium, will be brought to Portland
where he Is wanted, having been indicted
by a Federal grand Jury on a similar
charge several weeks rro. At the time
of his arrest here Williams furnished
$1500 cash bail and when his case was
called he could not be located. The
bail was forfeited. Since then the Gov
ernment representatives have been on the
trail of the alleged smuggler.
Williams was located in Spokane last
week and when arrested for his Illegal
handling of the drug in that locality, he
agreed to disclose to the officers the hid
ing place of the opium If they would as
sure him that he would not be prosecuted
on the charge. The terms were agreed
to and the smuggler took the officers to
a pile of railroad ties in Hilllard, a sub
urb of Spokane, where 265 cases of opium
were recovered.
The Government agents kept faith with
Williams so far as his operations In Spo
kane were concerned, but he Is being held
In custody until he can be surrendered to
the Federal authorities in this state when
he will be tried on the Indictment that
was returned last Spring. Williams has
not only lost the J1S00 cash bail he de
posited with the court in this state, but
he' will now be obliged to stand trial on
the charge presented in tne indictment.
Williams will be returned to Portland
as soon as United' States Judge Wolver
ton returns from tils vacation and Issues
an order for the removal of the prisoner.
DRIVE OUT ALL VENDORS
Council Proposes to Forbid Peddlers
Cse of Streets.
No peddlers will be allowed on the
streets of Portland, If the City Council
passes the ordinance recommended by the
license committee yesterday afternoon.
The measure was drafter by Council-'
man Kellaher and introduced by him be
fore the Council at its last session. It
was then referred to the license commit
tee for consideration. The committee
discussed it and recommended it for pas
sage. There have been several measures in
troduced before the Council aiming to
eliminate street vendors, a big increase
In the annual license fee being the prin
cipal means to the end. This, however,
has not sufficed to drive the peddlers off
the streets, arid Mr. Kellaher decided
that the only way to do it was to intro
duce an ordinance excluding them from
operation.
This was done and tomorrow when the
Council meets the measure will be up for
passage. It seems doubtful at this time
whether It . will pass, as the peddlers
are not without their friends, and there
is said to be much public sentiment In
favor of the vendors.
The great argument against the ped
dlers is the alleged nuisance they become
pn the streets. The police have much
trouble with them, and the litter from
their wagons is a point urged against
them by many.
