STILL-FLOURISHES.
Strong Testimony Given Be
fore Council's Investigat
ing Committee.

Further evidence adduced before -the
special lnvestig-ating committee of the
City Council at Its eecond session, held
yesterday morning, tends quite strongly
to show that there is still an understand
ing among practically all the Portland
furniture-dealers to keep up prices and
that a boycott exists against the few
Independent concerns in the city. . Two
witnesses swore that, because they con
duct mail-order establishments, they are
unable to purchase furniture from any of
the firms that were admittedly members
of the combine at the time of the Federal
indictments, last Summer. Another
witness swore that because he sold a
email bill of gooda to an independent
store, he was "put out of business" by
' the Arms that formerly patronized him.
He was forced to sell his manufacturing
plant and is now engaged in another line.
.. The witnesses yesterday morning were
A. Jones, of the Jones Cash Store, a
mail-order house, at Front and Oak
streets; William H. Phelan, of Rice &
Phelan. mall-order dealers, at tront ana '
Oak streets, and Samuel Kirtschevsky,
formerly engaged in the manufacture of
a lino of kitchen goods. All of the
witnesses swore that, to the best of their
knowledge and belief, there still exists at
least a secret understanding as to a scale
of prices, and that the Federal indictment
and subsequent flno of last Summer did
not, In reality, end the so-called trust.
Because of the serious nature of the
evidence adduced yesterday morning, the
Investigating committee, ' composed of
Councilmen Vaughn, Beldlng and Con
cannon, assisted by Deputy City Attorney
Grant, decided to Issue subpenas for the
proprietors and managers of some of the
large furniture establishments and to
secure their testimony. Among the firms
affected by the sworn testimony of
witnesses yesterday are Ira F. Powers,
Taubenhelmer & Schmeer, William
Gads by & Sons, I. Gevurtx & Sons, Henry
Jenning and Heywood Bros.
Gives Strong Testimony.
Perhaps the most damaging testimony
was that given by Samuel Kirtschevsky,
who swore that he was formerly In the
manufacturing business, and sold a line
of kitchen goods. His concern was known
as the Rose City Manufacturing Com
pany. He admitted that he was formerly
a member of the Northwest Furniture
Kxchange, the 'wholesalers' association,
and that a fixed rate of prices prevailed.
He said he sold largely to certain Port
land dealers until it became necessary for
him to secure at once some money with
i which to meet a ' bill. His. regular
customers were fully stocked, and de
clined to purchase, even at a liberal dis
count, "and he was forced, he said, to
sell a bill of goods to the amount of $200
to the Independent Furniture Company.
This transaction occurred after the Fed
eral indictment of certain furniture
dealers. "After I sold to the Independent Fur
niture Company," said Kirtschevsky, "I
went to Gadsby's buyer, as usual, and he
said. 'Why, you had better sell your
goods to the Independent people." I
knew at once what that meant Gadsby's
were determined to take no more goods
from me. They never purchased of me
after that. "When I went to Powers,
William H. BeharrelU Jr., told me
plainly that, as I had sold a bill of goods
to the Independent Company, he could
no longer deal with me. He Bald he was
sorry, but It could not be helped. He
said that I had violated the rules of the
association and had sold to a concern that
cut prices, and could not have his patron
age longer."
Continuing, the witness testified that.
whereas he had previously enjoyed a
good trade, he was unable thereafter to
secure enough business fo remain in trade
as a manufacturer; that he could not sell
his goods and was forced to go out of
business; that he sold only about $76
worth, of wares in six weeks, after his
deal with the Independent concern, and
that although he tried repeatedly to sell
to his former customers, they all declined
to buy of him. He therefore sold out at
great sacrifice, he said.
Asked whether he believed that the
'combination" still exists In Portland and
whether a scale of prices is maintained
nd the usual means employed to uphold
these prices, the witness declared that
such was his strong belief.
Cannot Buy Here.
OF". A. Jones, of the Jones Cash Sstore,
was the first witness called yesterday
morning. He swore that he- believed
firmly that a secret agreement exists
among furniture-dealers of Portland to
uphold prices.. He said that he had been
unable to purchase supplies for his trade
from several local establishments, and
was forced to purchase In the Bast and
South. Asked if he knew of any cases
of discrimination other than that already
related by him, he said that S. L. N.
Oilman and the proprietors of the Inde
pendent Furniture Company had been
grossly discriminated against, and he
thought It was solely because of the fact
that they were cut-rate houses, and
would not enter into an agreement to
maintain a scale of prices. He also ex
plained that there exists much 111 feeling
against Gllman, among furniture-dealers,
because of the fact that Gllman sells
furniture at auction.
W. H. Phelan, who has a mail-order
establishment at Front and Oak streets,
was next called. He admitted that his firm
was at one time a' member of the com
bine, and paid a fine last Summer under
Indictment by the Federal officials. Later,
ho said, the combine officials refused to
accept his firm's money for dues, and
since then he and his partners had not
belonged to the organization. He and
the members of his company were once
fined $20, he swore, for cutting prices.
A scale of prices, said to be in vogue by
the furniture-dealers, was examined by
the witness, and he showed the difference
in prices of his firm and the figures
quoted in the book said to be the guide of
the "trust" by citing a case. For ex
ample, linoleum was listed at 73 cents a
yard by the "trust," while In the cata
logue of the store conducted by the
witness, the same quality of linoleum
was listed at 60 cents a yard.
Oppose Mail-Order Stores.
He said that he had experienced diffi
culty in purchasing goods from local
wholesale dealers, and the reason given
by them was that their country customers
objected strongly to mall-order houses.
He swore that he believed, from his own
experience and from what be had been

able to learn, that there is today a secret
organization among the Portland furniture-dealers.
. No date was fixed for the next session
of the investigating committee. It Is ex
pected that the work mapped out for it
will consume several weeks. All of the
testimony Is being preserved, and after
the investigations are finished, if it is
deemed by the City Attorney that there
is sufficient evidence in any Instance to
prove a violation of the Belding anti-trust
law, Indictment will follow, and the cases
will be tried in the Municipal Court.
POWERS TO SECURE PEACE
Contribute to Loan to Protect Mo
roccan Coast.
PARIS, Feb. 26. It is officially an
nounced here today that both Germany
and Spain contributed to the loan of
$500,000 made by the Bank of Morocco to
Abd-el-Azlz', the Sultan, for the purpose
of maintaining the soldiers placed on
duty at the ports by the Foreign Board.
This is Interpreted to show that France,
Germany and .Spain are In accord in an
endeavor to secure peace on the Moroc
can coast and to protect business Inter
ests.
Removed to Federal Court.
The suit of George Martin for 10,000
against the Coos Bay Lumber & Coal
Company has been removed from the
Coos County Circuit Court to the United
States Court. Martin seeks to recover
damages for injuries sustained in May,
1907, while employed by the defendant
company.. His injuries consist of several
broken ribs and a badly bruised body.
