GIVES SCATHING REBUKE "Someone Ought to Bnmp Their Heads Together," Says Court In Dismissing the Case. Wife Refuses Mediation. "Some one otiRht to hump their heads together and tell them to start over. I am willing to undertake it." With these words Judge O'Day, of the Circuit Court, refused yesterday morning to grant the divorce sought by Emella Kildahl. The scorching rebuke to the wayward couple completely upset Mrs. KUduhl, and she mails her way through the crowd In the courtroom with the tears streaming down her face. To the importunities of hor attorneys to reconcile herself to her husband she answered: "No. no, no." Andrew Kildahl, the husband, con tested the suit, but did not ask the court for a decree. He said his wife once, while they were walking to church on a Sunday morning, and passed two young men, remarked, "There are two nice young men. I wish I could get a nice young man like one of them." His wife, he said, also visited a saloon one time with a man named Roxtad. The extreme cruelty for which Mrs. Kildahl attempted to secure a divorce yesterday was. according to her testi mony, that her husband pinched her when she asked him to pay a small gro cery bill. She was quite positive it was not a love pinch. She says cruel treat ment, consisting of hard names and blows, extended over many years, but Kildahl said it was only since 1902 that his wife had treated him coldly. The couple were married at Mow, Nor way, in July, 1SS6. and have four children. Mrs. Kildahl souffht to obtain a shnre of the property at Lents, in addition to $75 a month alimony. . Fhe says- he deserted her In November, 1905, after he had been a drunkard for five years. The couple have one child, 15 years ola. Jennie Marriman says her husband, Vic tor Marrlman, has assaulted her on sev eral occasions since she left him on De cember 20 last, because he failed to sup port her. She says that on these occa sions he used language "too mean to be set forth in the complaint." The couple were married at St. JeMIs, Belgium, July in, 1902. and have one child 8 years old Addle Murletta wanta a divorce from Roy Murletta because of his cruelty. She also wants to resume her former name. Mrs. Addle Clayton. She wants $100 suit money, $30 a month alimony and $76 at torney's fees. The couple married at Illllsboro, September 16, 1907. Mrs. Murl etta eays she has been compelled to earn her own living ever since her marriage. nrE CHARGE OP CONSPIRACY Plot to Steal Profits Alleged by De velopment Company. That the defendants In the 6Ult brought by the South Harbor Development Com pany, in the Circuit Court, entered into an agreement which was part of a con spiracy to cheat and diefraud others' who signed it, is the allegation of the com pany in Its reply to the answer of K. D. Whitney, C. W. Tower, Isaac Tower, C. W. Codding, 33. R. Robinson,' W. I. Lati mer and the Bennett Trust Company, de fendants. It is further- alleged by the company that the sgreement, the nature of which is not disclosed in the reply, was drawn up with the purposo of ena bling the defendants to obtain large se cret 'profits out of the company, and that some of them were elected officers in car rying out their plan. The company was organized, it Is said, by Charles M. Hemphile, Phil Harris and S. S. Laimont. When the stock was sub scribed for. It is alleged, it was agreed that each person should have eight times (is much of It as he paid for. Nearly all the defendants live at Marehfteld. Sl'ES FOR DEED TO PROPERTY G. I. Kus-hnimi Declares Hawthorne Estate Broke Sale Agreement. G. D. Rushman has brought two suits In the Circuit Court, one against the Hawthorne estate, and another againft Rachel L. Hawthorne. Catherine H. Col lins, Merrit Orin Collins. Louise II. Boise. Whitney L. Boise and the Hawthorne es tate. In the latter suit he asks that the defendants bo compelled to execute a deed to lots 5 and 6, block 252, Hawthorne Park, for which ,he says ho agreed to pay $3300. Ho says that when be informed the owners he was ready to make out a note for the amount, they refused to sell the land. In case the deed cannot be made, Rushman asks $10,000 damages. In the suit against the Hawthorne es tate Rushman asks that the admlnlstra' tors be compelled to give h!m a need to the east half of lots a and 6, In block S-'S, Hawthorne, Park as he says he also bar gained for this piece of property for JJ.650. De spite repeated requests of plaintiff the obligation still remains uncancelled. Held for Counterfeiting. R. H. Wells, J. N. Saylor and Frank Caviness, charged with passing bogus cur rency, will be given a hearing before United States Commissioner McKee at 10 o'clock this morning.
