as the Anglo-Roman Union Is holding
sessions in New York, with a view of
uniting the Roman Ca.thollc and Protest
ant Episcopal churches. The World
newspaper, of that city, yesterday sent a
telegram to Bishop Scadding, of the Epis
copal Church in Oregon, asking for nls
views on the proposed union. The tele
gram reads as follows:

olic churches, organized here this week.
Various well known Episcopal clergymen par
tfelapted; recognition of the primacy of Rome
advocated. Father James Paul Franeia, gen
eral of Protestant Bptecopal Order of Atone
ment at the head. We respectfully urge you
to telegraph your views concerning the possi
bilities of this movement. We make this in
quiry purely In the spirit of disclosing- the
prospects for the ultimate success of plan.

ply: The Editor of the New York World: The
possibilities of success of the Anglo-Roman
Union plan are innnlteslmally small. There
is no movement that way In this diocese.
There La not a churchman from New York to
Portland who will deny the Catholicity of
our church, thouirh he may prefer the label
"Protestant Episcopal." Our church In Amer
ica Is Catholic and has never professed any
thing else but the Catholic faith.
The fixed creed of our church, its settled
liturgy. Its decent -and reverent forms,' Its
tone of practical reality, these are being felt
more and more ni are winning thoughtful
and devout peopw? The country Is over
whelmed by a flood of religious sects of the
strangest names and theories. Midst the
madness of these waves our Episcopal barque
holds Its anchorage, and becomes to those
around it a witness for fixedness and truth.
The limned late duty of members of the Episco
pal Church Is by their sincerity, loyalty and
devotion to commend to the community, which
la 00 largely Anglo-Saxon, the Catholicity of
which we are in possession.
The type of Catholic Christianity which, is
ingrained In the I -a tin and Greek world will
never fit, or be fitted, with this other world
of another race to which we belong. The
small section among us who take upon them
selves a Roman type of devotion will remain
a Latinized minority. W take our stand
' upon our book of common prayer, which is
Catholic, and ts Rngllsb. To live and be
strong the TJptocopal Church must bring out
her own principles with charity to all. Our
banner must be ordered "Evangelical Truth
with Apostolic Order The Gospel In the
Church," and without faltering steps let her
remain true to her Anglo-Cathollo heritage.

Alleged Highwayman Confident That
Second Trial Will, Result In Ac

Charles "W. Walton, who Is held In the
County Jail pending a second trial on a
charge of shooting Policeman Ole Nelson
In holding up a Willamette Heights car,
more than three years ago, professes
to believe that he will be acquitted when
he again fares a Jury.
I was railroaded through when I was
tried three years ago," he said yesterday,
"and It was for that reason that I was
never given a chanco to plead. They were
too anxious to get me convicted. The
line of defense this time will be Just the
same as It was three years ago."
"Will you not havo some difficulty In
securing witnesses after bo long a time?"
he was asked.
"Perhaps so, but I believe all my wit
nesses are still living1 here. Of course,
their memory may not serve them In
recalling some things that occurred that
night, but I know I shall tell Just the
same atory that I did when I was taken
before the Jury before. That's all I can,
do.
"I was In the Penitentiary for more
than three years, and I was held for sev
eral months awaiting trial before I went
up there, but In case I am again con
victed that time will not count.
"I think I shall have a Jury this time
which will try me impartially. I had a
hard time In securing a Jury at my first
trial; the newspapers did not give me a
fair deal. Facts were misrepresented
and statements twisted. The Jury had
formed an opinion In regard to the case
before It came to trial.
"The first trial was held before Judge
Clcland, but the demurrer in the case
was argued before Judge Fraie.r. That
was how the plea came to be overlooked.
They were so anxious to get me convicted
that they set the case for hearing then
and there, without giving me a chance to
plead. I was sent up for Ave years on
tho assault charge and for 20 years on
the chargo of holding up the car.
"You see, I still have the scar where I
was knocked down during the rumpus on
the car," said Walton, pointing to a white
mark on his forehead. "I hope this trial
will be over quickly."
Walton has not yet been arraigned, and
the date of his trial has not been set.

Herman G. Burkhart Demands That
Court Impose Sentence.
A writ of mandamus to compel him
to pronounce sentence at once upon
Herman O. Burkhart, or appear In the
Circuit Court before Presiding Judge
Cleland on February 17 at 2 P. M., and
show cause why he has not done so, has
been Issued against Judge George J.
Cameron, of the Municipal Court, by
Judge Clcland. The writ-was filed with
the County Clerk yesterday.
It seta forth that Burkhart was
charged In the lower court with dis
orderly conduct In assaulting a police
man on November 5. last year. Burk
hart pleaded not guilty when brought
to trial January C4. but was convicted
January 28. As Judge Cameron did not
pronounce sentence. Burkharfs attor
ney made a motion on January 30 that
this be done, but on -February 3 Judge
Cameron overruled the motion and re
fused to pronounce Judgment.
E. B. HENDERSON FACES A JURY

Alleged Burglar on Trial for Rob
bing Frohman Art Store.
E. B. Henderson Is on trial before a
jury in Judge Gantenbeln's department
of the Circuit Court, charged with
stealing 11250 worth of Jewelry and art
goods from the art store in the Port
land Hotel. The stolen goods belonged
to Mrs. H. Frohman. Henderson is
said to have sold 23 stickpins, a cigar
case and a gold nugget to Louis Cohen,
a news agent on the Southern Pacific,
for 4G, soon after the burglary.
An attempt was made yesterday by
the attorney for the defendant to fast
en the crime upon Cohen, in whose
possession the goods were found. Cohen !
said he bought the goods as a business
proposition from Henderson In the lat
ter's room at the Cascade HoteL He
said he did not know then that the
goods were stolen.
Tuska A. Klyoma. a Japanese.. clerk
employed at the store, identified the
stolen property.
The trial will be continued this morn

Marquam Case Tip Again.
Presiding Judge Cleland of the Circuit
Court yesterday afternoon listened to the
arguments of the attorneys in regard to
the application of P. A. Mortmain for a
commission to take certain depositions.
and took the matter under advise
merit. Mr. .Varquam seeks to secure
the depositions of the officials and
former officials of the Title Guarantee &
Trust Company, including J. Thorburn
Ross, T. T. Burkhart, George H. Hill, E.
C. Mears, W. M. Ladd. B. B. Seabrook,
W. A. Munly and W. M. Gregory, to be
used In the trial of a suit to set aside
the sale of the Marquam building under
a mortgage foreclosure. The attorneys
for the defense allege that there Is no
need for taking the depositions ae aU the
parties connected with the suit are with
in reach of the court, should the case be
brought before It again.
Yacht Spirit' to Enter.
VANCOUVER, B. C. Feb. 12. The
Seattle Yacht Club has notified the
Royal Vancouver Tacht Club of t
entry of the yacht Spirit in the inte
national cup race this Summer.

streetcars made recently shewed that 105 were
fllthy, 41 had flat wheels, 7S6 rattled notice
ably. 2-40 were without headlamps, 102 with
