Jost Brothers Violate Their
Agreement With the
State Board.

Warrants will be iBsued this morn
ing for the arrest of the Jost Brothers,
on charges of shipping sailors without
a proper license to conduct a sailor
boarding house within the State of
Oregon. The complaint will be filed
by William MacMaster and Adamee M.
Smith, members of the State Board of
Sailor Boarding House Commissioners.
The specific charge will be that they
shipped three men on the British bark
Elginshire, Captain Stott, yesterday
afternoon.
Jo'st Brothers have no license to
conduct a sailor boarding house, and
the act of yesterday is construed by
the board of commissioners as a simple
act of crimping, which is a serious of
fense In the State of Oregon. Jost
Brothers recently applied to the Board
for a license to conduct a sailor board
ing house. Associated with them were
mentioned the names of "Mysterious-
Billy" Smith, Paddy Lynch and others..

Jost Brothers again applied for a li
cense, this time for themselves. They
agreed with the commission that
neithor Smith nor Lynch should be
connected, either directly or indirectly
with the business. After consideration
the Board agreed to grant the license,
provided that the boarding house be
put In suitable order and a bond of
5000 be filed, in addition to the regu
lation fee of $250. They were warned
that any attempt to engage in busi
ness prior to the fulfillment of these
obligations would result In the revok
ing of their license.
An agreement was entered .into be
tween the master of the Elginshire and
the Jost boys, whereby eight men were
to be supplied at a rate a trifle less
than that which is provided by the
State law. Yesterday afternoon eight
men were lined up In the office of the
British Consul. Captain Stott accepted
three and rejected five. The three men
were regularly signed on the ship's ar
ticles. William McMasters, one of the mem
bers of the State Board of Sailor
Boarding House Commissioners, said
yesterday:
"In shipping the sailors on the Elgin
shire the Jost boys have violated every
article of agreement entered into be
tween, the members of this commission
and themselves. We shall proceed
against them immediately. It was an
understood fact between us that the
boarding house must be placed In
proper shape. We inspected the prem
ises once and would not accept the
place. Charles Jost called on me yes
terday and stated that they were work
ing on the place and would soon have
It in shape for the reception of sailors.
"Another feature on which the Board
was particular was that "Mysterious
Billy" Smith, "Bunco" Kelly and
"Paddy" Lynch should not be connected
In any way, either directly or Indi
rectly, with the concern. To this they
agreed, but I am given to understand
that Smith has solicited ships for the
new concern and that Kelly has been
hunting sailors in a number of the
down-town saloons. "Jumbo" Riley, an
ex-pugilist and well-known character,
is also mixed up with them. I am told.
Wo have placed the matter before Dis
trict Attorney Manning and tomorrow
shall proceed against them in accord
ance with the law."
During the past two years Portland
has enjoyed the reputation of having
the best sailor facilities of any port on
the Pacific. Coast. During that period
not a single ship has been detained for
more than 24 hours on account of sail
ors, while on the Sound last season the
British bark Muskoka and two other
vessels lay in the bay for nearly five
weeks waiting for the boarding masters
to furnish crews. It is the contention
of shipping men that rivalry in the
boarding house business would be a bad
thing for the port. Inasmuch as a de
mand for sailors would Induce rivals to
steal men from vessels which have re
cently arrived.
During the past year conditions have
changed greatly. Formerly, in British
ships especially. It was immaterial to
"the owners and masters whether the
sailors ran away or not. If the men
left by "French leave" the wages un
paid reverted to the owners. Since last
. July, all wages due deserting sailors
revert to the Board of Trade.

bids will be received until Friday noon
at the office of Taylor, Toung & Co.,
In the Sherlock building. The vessel is'
now at the Tongue Point Buoy Depot
and is open to the Inspection of intend
ing bidders.
Specifications call for 30 feet of bul
warks on the port side, three new planks
In the hull of the vessel, a roof on the
deckhouse, repairs to the galley and the
building of a new surf boat, for which
separate specifications were made.
COMINGS CASE AT AN END
Captain C. R. Spencer and Fireman
Hod ire last of the Witnesses.
Captain Charles Tt. Spencer, master of
the steamer Chas. R. Spencer, and W. A.
llodjce, a fireman on the steamer Annie
Comings, both testified at the Investiga
tion being conducted by Inspectors Ed
wards and Fuller Into the collision be
tween the steamer and the French bark
Europe on the night of December 26.
Captain Spencer testified that he passed
the French vessel about 20 minutes before
the accident and that the craft showed
no lights. Hodge said that he did not
see any lights. The testimony of the
two men finished the list.

Simms. of Port Townsend. bid $5400. In
all probability the contract will be
awarded to the lowest bidder.

Smallpox on a Norwegian Steamer.
VICTORIA, B. C. Jan. 21. The steamer
Bellerophon, of the Blue Funnel Line,
reached quarantine this afternoon from
Liverpool, via the Orient, with five cases
of smallpox on board. The steamer has
been quarantined. The victims are all
white members of the crew, the carpen
ter, his helper and three seamen.

The four-masted British bark Province,
Captain Jones, which arrived up yester
day from Buenos Ayres, completed one
of the fastest runs made for several

31 and 70 days later she appeared oft the
mouth of the Columbia. Considering the
fact that she beat around the Horn, the
vessel made as good as steamship time.
Halilis Chartered for Lumber.
The Norwegian steamship Haldis has
been chartered to carry a full cargo of
lumber from Portland to Panama. The
cargo will be supplied by Arthur Game
well and will consist of better than a
million and a half of fir. The vessel is
now at San Francisco and will be ready
to sail for Portland by the end of the
week.

VICTORIA, B. C, Jan. 21. A report
from Carmanah Point says a bark be
lieved to be the French bark Pierre Lotl,
from Hobart for Tacoma, is flying

nere at tf. m. to assist her.
Hartfield Blown Out to Sea.
SEATTLE. Jan. 21. A deserting sailor
from the Norwegian steamship Tyrea,
Bellingham to Australia, reports that the
Tyrea sighted the missing British ship
Hartfield Wednesday last, 40 miles in
side the Straits, east of Cape Flattery.
She was on her beam ends. Later the
vessel was blown out to sea.

Thieves Enter in ,the Absence of
Head of Household Servant
Sleeps During Robbery.
After attending a theater party Satur
day night, Saul Silverfleld, president of
the Silverfleld Company's store at Fourth
and Morrison streets, returned to his
home, 6S9 Flanders street, to discover
that burglars had looted the residence,
taking away a large quantity of silver
ware. Owing to the fact that Mrs. Sil
verfleld is away on a visit at the present
time and Mr. Silverfield is not able to
say just what articles of value were in
the house," it is not known how much
was stolen. Mr. Silverfield thinks the
loss in silverware is at least $400.
The Japanese servant returned at 10:30
o'clock' on the night of the burglary,
found things as usual and retired. As
none of the rooms on the upper floor
were disturbed, it is believed that after
the lower floor was looted the burglars
found the sleeping servant upstairs and
retired without attempting to get more
plunder. Entrance was effected by break
ing a pane of glass in one of the parlor
windows and unfastening the window
latch.

Astonishing increase In the mortality
from heart disease, based on statistics
made public recently by the Depart
ment of Health, is being discussed
with much earnestness by eminent
physicians of New York City.
According to the report of Dr. W. E.
Guilfoy. Registrar of the Bureau of
Vital Statistics, the increase of the
number tf fatal cases of heart disease
for the first eleven months of last year
in Manhnttan and the Bronx over tho
same period in 1906 was 1246, or, if the
ratio is maintained, loOO for the year.
This would mean an excess of 27 per
cent.
Dr. Thomas Darlington. President of
the Board of Health, said that almost
as large an increase had been noted in
1956, and that, in fact, ever since
1866, when the statistics of the depart
ment were first kept in such a way
that' comparisons could be made, there
had been a steady rising of the scale
of mortality due to weak hearts.
