At today's meeting of the City Council
the petition of the Inman-Poulsen Lum
ber Company for the vacation of portions
of several East Side streets, occupied in
connection with its sawmill plant, will
come up for consideration. Mayor Lane
filed a protest Saturday against granting
the requested vacation, on the grounds
that the streets should be kept open, as
they furnish the only access to the river
on the East Side above the Madison
street bridge. The petition asks that
portions of the following streets be va
cated: Bast First. Bast Second, East
Third, East Sherman, East Lincoln, East
Grant. Bast Caruthers and Division.
In reply to the communication of the
Mayor, In which he recommended the
leasing by the city of these streets, the
Inman-Poulsen Lumber. Company, peti
tioners, yesterday is.wed the following
statement to the members of the Coun-.

Statement to Council.
Through the columns of the dally papers
It has been announced that the Mayor has
directed a communication to you anent the
matter of the vacation of certain platted
ground occupied by the Inman-Poulsen
Lumber Company as a part ot its sawmill
plant. He suggests as an alternative the
leaning of the premises to this company at
a nxed rental for a term of years and
further suggests that this company compen
sate the city for the past use of the prem
iss by the payment of a further rental,
snd by way of calling attention to the Im
portance ot the transaction,, figures the area
in square feet and the market value In
dollars.
As a first proposition, our petitions on file
set out the fact that when the plat of
Stephen's Addition was filed In I860 It
contained no dedication of the premises as
streets and no recognition has been made of
same as street by the public or ourselves
and a large portion of the premises is In
a deep slough, the bounds of which were
distinctly traced on the plat.
Secondly. In answer to the suggestion to
rent the streets. The law Itself Is In con
flict with such a proposal and bars negotia
tions on this basis as we are advised and we
opine your City Attorney will so advise you.
The city, having no Interest In a street sub
ject to lease, could not lease the same to a
private party. When a street is dedicated
by sufficient words of dedication, the owner
of the property still retains the title to the
ground dedicated and the public simply
have a light of passage over the street. The
owner does not part with his title, but
v simply grants the public a rfght-of-way over
the same. The city can no more sell or
lease a street than it Could sell or lease the
Willamette River. The city cannot even
occupy a street to . the exclusion of the '
public.
Big Plants Are Cramped.
In the City of Portland the blocks are so
small and the streets so numerous that
large manufacturing plants find themselves
materially handicapped for want of space
and oftentimes the public interests would be
served much more in the vacation of un
necessary streets than by tenaciously of
otherwise Insisting that In the preservation
ef streets as ertglnally platted lies the only
safeguard of the people's rights and liberty.
We trust, therefore, that you will give
Shis matter a consideration consistent with
.business Judgment and not be mislead by a
proposal the law deems absurd.
Several months ago Mayor Lane dis
covered that a number of corporations or
private Individual? were occupying por
tions of several streets belonging to the
city and without authority. He called
the attention of the Council to the fact
and demanded that ell such streets be
vacated or that the occupants of those
thoroughfares be compelled to pay to the
city a reasonable charge for the further
occupancy of the property. The Inman
Poulsen Lumber Company was included
In the lipt of trespassers.
Soon after the Mayor submitted his
communication to the Council, enumer
ating the streets improperly occupied,
the lumber company notified the city's
chief executive, through its attorney,
that it would propose to transfer to the
city other equally valuable property, foot
for foot, for that occupied by the tres
passing corporation. This offer never
was formally submitted to the city offi
cials, but instead the company recently
applied to the Council for the vacation
of these streets, and that Is the petition
which comes up at today's meeting of
that body.
"I have called to the attention of the
members of the Council the importance
of the petition for the vacation of these
streets which will be considered at to
morrow's meeting," said Mayor Lane
last night. "In doing so I protested, I
think with adequate grounds, to the
granting of the vacation petitioned for.
I feel that I have done my part.
"This petition calls for the vacation of
portions of a number of streets that have
been occupied by the petitioning corpora
tion for several years without authority
from the Pity and without compensating
the city In any way for their use. The
streets proposed to be vacated represent
en area of about 412,500 square feet, or
the equivalent of 82 city lots of the value
of not less than $100,000. For the surren
der of these streets the city is to receive
nothing.
"Aside from the market value of the
property, these strifts are even more
valuable to the general public, since they
afford the only means of access to the
river from the East Side above the Madi
son-street bridge. The time will come
when the use of every one of these
streets will be of great Importance to the
commercial interests of this city, and If
for no other reason, their possession
should not pass from the city."
BEATS AN AGED WOMAN
Police Searching for Mrs. Kate
Barden, Accused of Assault.
Beaten into Insensibility, Mrs. Sarah J.
Brown was found lying on the floor of
her home, Monday nisht, by her son.
Harlan EL Brown, who as a result yes
terday tiled an information against Mrs.
Kate Barden whom he charges with the
assault. A warrant was Issued for the
woman's arrest and the police are now
searching for her.
According to the story told by Brown
and his mother, Mrs. Barden, who is the
wife of George Barden, Brown's step
brother, wu divorced from her husband
about a year ago and the court awarded
the custody of the two small children
resulting from the union to Barden. One
of theise children whs Klven to Mrs.
Brown to care for and it is alleged that
the child having been placed in its grand
mother' care has been the cause of
numerous disturbances raised by Mrs.

Barden, who has tried in numerous ways
to regain ppssession of the child.
Monday night t Mrs. Barden, accom
panied by another woman by'the name
of Ethel Mack, went to the Brown resi
dence when only the aged Mrs. Brown
and the little child were at home and
while her friend took the child Mrs.
Barden, it is said, beat the old woman
into unconsciousness. The police have
advised the Browns to register a charge
of kidnaping against Mrs. Barden and
her companion. As Mrs. Brown Is very
old and feeble her condition ia considered
serious.
