Proprietor Rhule Wants $2000 From Kay, Burke and Baty for Smashed Doors. , troceedings which may cost Kay and Burke, acting detectives on the Port land police force and members of Ser geant Baty's "moral squad," their po sitions, were instituted In the Circuit Court yesterday afternoon by Attorney Ji. C. King, on behalf of L. C. Rhule. the proprietor of a place at 85 North yifth street, which' was raided at 2 o'clock last Sunday morning. Attorney King in his damage suit Tor J3000 against the three detectives alleges that they entered the house il JegaUX. JreaUn& several jdoors tfc&t one of - the detectives turned over a kerosene lamp, . starting a fire which was put out by th sleuth, who cov ered the blaxe with bedclothes before It obtained any headway, and that Kay struck Katie Gray, one of the Inmates, over the head with the butt of a re volver for yelling "fire" when the flames shot up from the floor. Aside from this. Attorney King will file a damage suit for $25 J against De tective Kay on behalf of Katie Gray for injuries received from the alleged blow over her head. This suit will be filed in Justice Reid's Court today and it is ex pected that the developments will cause a formal charge to be placed against Kay with the police commission. Sergeant. Baty's version of the af fair tends to show that the whole trouble arose through the work of Of ficers Kay and Burke, against whom complaints have been the rule rather than the exception. Baty has had trouble with these two men, several times recently, and in addition to crit icising them personally has informed Chief of Police Gritzmacher of their failure to follow orders. "Numerous complaints have been made nmlnst Rhule'a house." hslM "Rat v. "JV' iiav-heea. Informed, no-- gresses who had apartments there are In the habit of receiving white visitors. We went there early last Sunday morn ing. With me were Kay and Burke and Patrolmen Mallett and Humphreys, who have the North. End beat on the second night relief. "I sent two or three men to the rear door and I went to the front door with the others. We hammered on the door and told the inmates to open it. that we were officers. Instantly a scramble could be heard Inside and the sound of persons running about the house. Again I hammered on the door and shouted to those in the house to open it, as we were officers, and would brook no fur ther delay. "At this Juncture I heard the sound of a window being raised on the side of the house and ran around there, thinking I would' catch aomebodj crawling out. A man jumped back and pulled down the window. Just then came the sound of the doors being smashed in. I ran around to the door and into the house, calling loudly to the men to stop that kind of work, that I didn't want any more smashing of doors. "A regards the character of the bouse jr caa.rovs.it Jsevoad, fiuea- tion. The result of the raid proves that. But I want no smashing of doors ex cept when It is absolutely 'necessary, and the doors at Rhule's-house were broken without my consent and before I realized that it was going to be done." 17. S. The dynamite had been placed on the tracks with the Intention, of wrecking A sassenKer train D0W1E SAYS HE IS PURE Deposed ' Leader of Zlon Denounces Voliva and His Supporters. CHICAGO. Sept. 5. In a long printed statement Issued from Shlloh House, in Zlon City, yesterday, John Alexander Dowte replied categorically to charges of - Immorality. extravagance, misrepre sentation, misuse of investments and po lygamous teachings, made against him by Wilbur Glenn Voliva, who deposed him from authority and usurped his place as leader. Replying to the charge of im morality, Dowie declared that he had demanded of Voliva, time and time again, that this accusation be made public Each time Voliva refused to comply, he said: "Before God and man, I say I am with out taint upon my personal purity," he asserts. "If there Is aught to the con trary, let them stand forth and prove it." The charge of polygamous teaching, he says. In the face of bis public teachings for years and of his printed addresses. Is absurd and foolish. Answering the charge of extravagance, Cttwle says;, "yhe eneral overseer and first apostle of the Christian Catholic Church in Zion must necessarily, in his representative character, use more funds than a private individual in Zion. To say that I have made willful and extravagant use of money in connection with my pri vate affairs can only proceed from an en vious and malicious source." After denouncing Voliva and leading officials of Zlon who joined the revolt as "men who are guilty, confessedly, of rank dishonesty, the basest deception and the most monumental Ingratitude," Dowle appeals to those in Zion still faithful to him to aid financially In his fight to re gain leadership. Swapping Professors With Italy. NEW YORK, Sept. 6. Dr. S. Kennard, of Tarrytown, returned yesterday from Italy. He said that arrangements for the exchange of university professors between that country and the United States on the same lines as the system now in force between America and Germany, but on a larger scale, had been completed. "The whole country exhibited the keen est appreciation of the value of the alli ance," said Dr. Kennard, yesterday. "Un der the system for exchanging professors, Italian f rofessoca will come to the Amer ican colleges to lecture and American professors will go to Italian colleges. Circles for the study of the English lan guage in Italy and of the Italian language in America also will be established." Tries Again to Beat St, Johns. E. J. Hufford has appealed to the State Circuit Court from the decision of the authorities of the town of St. Johns ap propriating 10,383 square feet of his land for the improvement of Modoc street. He was allowed nothing for the land, which he says is worth J2150, while he puts the excess of damages over benefits because of the street Improvement at $1500. B4mel Complaint In Children.
