OREGONIAN NEWS BUREAU, Wash ington, Aug. 2. President Roosevelt has decided that the coal barons shall not Iiave a monopoly of the coal fields of the w est. Late In the recent session he sent a message to Congress calling attention to the tendency of large corporations to gobble up coal land in the West, and sug gested the advisability of repealing the. coal land law and retaining coal land as a permanent asset of the Government, to be leased at a fair price to operators who would develop the coal and put it on the market at a reasonable figure. No action was taken on his suggestion, though Sen ator La Follette and several others made speeches in advocacy of the leasing of coal land. To show that he is absolutely in ear nest, the President has directed the In terior Department to withdraw from en try all public land in the West that is bcllved to contain coal deposits of com mercial value. In all, 10,000.000 acres have been withdrawn, but out of this area It is probable that not more than 4,000,000 acres are now public land. Oregon and Washington Coal. Oregon is not known to have as exten sive coal deposits as some other Western States, but, with Washington, it has been embraced in the President's orders and all vacant public land in townships 23, 26 and 27 8., R. 13 W.. lying in the Roseburg land district, has been withdrawn from entry -' under the coal land or other public land . laws. In Washington 25 townships have been withdrawn under the same condi tions, the withdrawals being: Vancouver district T. 14, R. 1 and 2; T. 8, R. 2; T. 9, R. 2 W. ; T. 12. R. 5. Olympia district T. 15, R. 1 and 6; T. 20. R. 5; T. 19, R, 6; T. 18, R. 6: T. 16, R. 2. Seattle district T. 37, R. 4; T. 23, R. 5, 6 and 7; T. 24, R. 6; T. 29, 34. 35 and 39, It. 6; T. 22, R. 6 and 7; T. 21. R. 6 and 7. It Is true that the greater portion of these townships has already passed into private ownership, and some of the rich est coal fields of Washington are em braced in these areas. Such land as is now in private ownership Is not affected by the President's order, and the Govern ment has no control whatever over it or over the companies that own and are de veloping their coal deposits. But the re maining public lands are now beyond the reach of the coal man and the speculator, and it is not likely that they will again be made available except by lease. Would Only Lease Coal Lands. It is the intention of the President when Congress reassembles in December, to renew his recommendation that the coal land law be repealed and that such land remain permanently with the Gov ernment, and that authority be granted for the leasing of such lands. So long as the Government holds title to coal land, it can compel the lessees to sell their coal at a fair profit, a moderate margin above the cost of production added to the cost of the lease. Experi ence in the Pennsylvania authracite fields has Bhown the outrages that can be per petrated when a trust has absolute sway and the President's last move is Intended to prevent the repetition of the Pennsyl vania hold-up In the great West. Practically every public land State of the West has some coal land, and in each State where coal is known to exist " withdrawals have been made. The Geo logical Survey has been instructed to make careful investigation of all the withdrawn areas, and the land found to contain no coal or merely tracts that have no commercial value will ultimately be restored to entry. The remainder, if Congress adopts the President s sugges tion, will remain public property until the coal Is exhausted. Hold Land Till Congress Acts. Until Congress repeals the present coal land law, the President will have no authority to make leases of coal land in the West, but the fact that such sweep ing withdrawals have been made and that the Geological Survey has been in. Btructed to immediately proceed to an examination of all the withdrawn land would indicate that the President believes the desired legislation will be enacted at no distant date, probably next session. INVESTIGATION IN PHILIPPINES Wood's Search for Irregularities Needs Aid From Home. WASHINGTON, Aug. 2. An investiga tion of alleged irregularities in the Phil ippine Islands is now being conducted by order of Major-General Wood, the inquiry being in charge of Colonel Wood, Inspector-General. At the request of General Wood the War Department has made a special detail of officers familiar with the methods of business and conditions in the Philippines to assist. No result has yet been reported to the department. SPANISH TREATY IS ARRANGED Duties Reduced by Reciprocity Will Make Champagne Cheaper. WASHINGTON, Aug. 2. All prelimi nary negotiations between the United States and Spain for the reduction of the tariff on American products entering Spain, in consideration of the reduction of the tariff on champagne and several other Spanish products, have been con cluded. Mr. Collier, the American Min ister at Madrid, so advised the State De partment by cable today. Admiral Train, commanding the Asiatic station, in a report to the Navy Department, says that, while the fleet was at Kobe, Mr. Malslkata, president of the Kawasaki Dock Yards Company and a graduate of Yale, presented to the fleet a handsome silver football challenge cup, which is to be played for each year, the name of the winning ship to be engraved thereon. He also presented to the crew of the Oregon a silver cup of smaller size, which is to be sent to the Navy Department. NO IMMUNITY FOR JOHN D. Will Not Be Subpenaed in Standard Oil Inquiry. " CHICAGO, Aug. 2. John D. Rockefeller will not be served with a subpena to ap pear before the grand Jury which has been called to convene in this city next Monday, to Investigate the relations ex isting between the Standard Oil Company and various railroads entering Chicago. This announcement was made here today by Government officials, after a confer ence between Assistant Attorney-General Oliver B. Pagin, Assistant District Attor ney Hanchett; T. C. M. Schindler, Special Agent from Washington, and District At torney J. G. Sullivan, of Cleveland. The Government officials declared that, should Mr. Rockefeller testify before the grand Jury, it would be necessary to grant him Immunity from future prosecution, and this, it was claimed, is what the Govern ment wishes to avoid. " Two hundred pounds of evidence this afternoon reached the office of District Attorney C. B. Morrison for use in prose cuting the investigation, having been sent from the office of Commissioner of Cor porations James R. Garfield at Washing ton. A careful study of the mass of evi dence is now being made by the Gov ernment attorneys who have charge of the case. The evidence was gathered by Mr. Garfield's men during his recent in vestigation of the oil business. SL'BPENAS FOR STANDARD MEN Forty Officials Called Before Chi cago Grand Jury. NEW YORK, Aug. 2. Forty or more subpenas for officers and employes of the Standard Oil Company have been for warded to New York from Chicago. Sev eral officials of the Standard would not say whether they had received the sub penas from Illinois, but did not show sur prise when they learned they had been Issued. Inquiries were referred to M. F. Elliott, general counsel for the company, who said so far as he knew no attempt had been made to serve any of the offi cials. Mr. Elliott would not say what attitude the officials of the company would take in case the subpena-servers put in an appearance. Johnson's Interest Not Financial. CLEVELAND, Aug. 2. In the dis patches handled by the Associated Press on July 25, in describing the controversy now proceeding over the street railway situation in this city, the statement was made that Mayor Johnson "was credited with being largely interested in the Mu nicipal Traction Company." This state ment is unwarranted. Is believed to be entirely untrue if it tend to create the impression that Mr. Johnson had any financial interest whatever in the Forest City Company, and is contrary to every public statement made by that official. Am bassador Whltelaw Reld today inaugu rated the course of Summer lectures at the university with an address on "The Rise and Development of the United States." Mr. Reia suggested that the separa tion of Great Britain and her American colonies might never have happened, had Chatham's wise policy Ibeen followed, and said that both the British people and their colonizing sons had profited by the result, because America's triumph had checked reaction in Great Britain. There was no doubt, he continued, that the first echo of the rise of America was heard among the crashlngs of old institutions during the French Revolu tion, and that it certainly was a factor in the subsequent rapid extension of pop ular rights throughout Europe. As it had stimulated liberty by its po litical development, so had it stimulated material welfare by Its inventions, prod ucts and opportunities. It was scarcely possible now to conceive the world with out the American outlet for its super fluous energy and its superfluous population. Refuses to Pay Taxes in Texas. DALLAS, Texas, Aug. 2. (Special.) The Western Union Company refused to pay its state taxes under the Ken nedy gross receipt law, although the Texas Attorney-Gneral held that lc should do so. The company claims that It Is subject to tax under the Williams intangible asset law and de clines to pay under both tbe intangi ble and gross recelpcs laws. UNWRITTEN LAW STANDS Woman Who Killed Guilty Rival Ac quitted of Murder. BCENA VISTA, Colo., Aug. 2. After a dramatic trial Mrs. Grace Hutchinson was tonight acquitted of killing Mrs. Mary Bode at Salida last June. During the trial Mrs. Hutchinson's husband admit ted on the witness stand that he had been intimate with Mrs. Bode and that he had confessed to his wife the night before the murder was committed. Right of Way for Umatilla Canal. WASHINGTON, Aug. 2. The Secre tary of the Interior has approved the agreement with the Wilson Irrigation Company of Umatilla County. Oregon, wherehv It agrees to permit the reclamation service to cross its right of way and canal with a feed canal, ditches, roads, telephone and electrio transmission lines and other irrigation works, under the Umatilla Irrigation project.
