Martin Ready, arrested last week for gambling by selling pools on horse races, seems to have come off first best on the deal. As published yesterday morning;, he got back his cash bail of $300, through Acting Chief of Police Gritzmacher, and it now develops that Clerk Frank Hen nessey "gave down" the coin without an order from Municipal Judge Cameron. An entirely new and very interesting feature developed because of this. It now develops that Ready was willing to plead guilty to a charge of gambling, and was to have paid a fine of $25 or $30 into the Municipal Court. Arrangements had been made. It is said, whereby this disposition was" to be made of the case. Beady, however, wearied of waiting, de manded his ball money when he learned the city had no ordinance to reach him, and Acting Chief Gritzmacher applied to Clerk Hennessey for the cash. Hennessey "forked it over," on the strength of the Chief's request, although, he now states, he felt he had no right to do eq. Deputy City Attorney Fitzgerald has been 111 several days, and unable to at tend to the duties of his office. This kept the Heady case tied up, which caused the man under arrest to clamor for his ball. Mr. Fitzgerald was present in court yes terday morning, and had not the cash been returned to Ready the previous day. the city probably would have been richer by at least $25. As the matter now stands, Portland is practically open for the selling of racing pools, the city having no ordinance to stop It, and the District Attorney not caring to interfere unless it becomes a nuisance. Did Charles Stewart know that a pair of rubber boots belonging to Fred Brown were wrapped in three blankets that were sold by him to a second-hand dealer? Upon the answer to this question de pends whether Stewart will lose his lib erty and have to serve a term in the County Jail. He was arrested by Detec tive Snow, and arraigned yesterday. He swore, that he did not steal the boots, and that he did not know they were wrapped in his blankets. The second-hand man will be present this morning to tell about the deal. William Wrenn. charged with vagrancy was sentenced to 60 days in the Cits' Jail. He was arrested by Detective Kerrigan. He served a term in the penitentiary for " burglary, and his presence is not deslr able about the streets of the city. R. W. Breyman, arrested by Patrolman Hoesly. was released yesterday morrimg. there being no evidence to "warrant the filing of any charge other than "drunk." C. A. Smith, proprietor of the Stafford Cafe, Thirteenth and "Washington streets, -was acquitted of violating the 1 o'clock closing ordinance. Ho was arrested by Patrolman Gittlngs. who. Judge Cameron said, did his duty, but evidence sufficient to convict was lacking. George Repp and Jack Peters, arrested hv Patrolman Adams for violating- the or dlnance prohibiting the -eiaughterlng of animals In the corporate limits of the city. were arraigned and pleaded guilty. Repp was fined $10 and Peters was discharged, as it was his first offense, he declared. Francis Foes, charged with assault and battery, was discharged, as the complain ing witness, G. S. Brown, failed to ap pear. Tie costs of $2.50 were taxed to him and will be collected. Must Not Drink or Smoke. Captain of Detectives and Inspector of Police Bruin has issued aa order, to the members of the detective and plain clothes staff, in wihich he warns all gf the. officers that they must keep them selves jieat and presentable, must not drink or smoke and must not accept to Twtcco or liquor gifts frem saloonkeepers.
