HIS EXCUSE IS DUflLPERSONflLlTY Bissell Thomas Declares He Is Not Altogether Accountable. TRIED FOR PASSING CHECK Asserts That He Is Afflicted With a 3Icntal Malady That at Times Makes Him Irresponsible for His Acts. During an examination yesterday before Drs. W. A. "Williamson and E. D. John bon insanity experts, and County Judge Lionel R. Webster Bissell Thomas, a lawyer, confined in' the County Jail to answer to a charge of passing a forged draft, told a remarkable story, the effect of which was that because of an ailment from which he suffers he possesses a dual personality, and becomes lost to his real self for days or weeks at a time. He said he only remembered what occurred In these periods in a vague, dreamy way, and many events were a perfect blank. Bissell Thomas is 26 years old, of me dium height and build, dark mustache and eves and partly bald. He is well dressed and is very intelligent, and in Ms discus sion with Judge Webster concerning his experience in the legal profession con veyed the impression of one well versed in law. His father. Charles TV. Thomas, is a well-known corporation attorney at Belleville, 111., and according to state ments of acquaintances here, his grand father on his mother's side was once Gov ernor of Illinois. Bissell Thomas came here from Belle ville in June last, and he stated that he was afflicted with one of his spells when he started on the Journey. He said he was a Lieutenant in the United States Army in the Philippines from l&sfl to 1901. and for a considerable length of time was Provost Marshal at Bulucan. where the work was very hard, and he endured many hardships in campaigns. He suf fered with a bad attack of enteritis, and was threatened with cerebro-spinal men ingitis. His Strange Spells. From this time on, at Intervals, these strange spells came over him, beginning with extreme depression and Insomnia. A black cloud seemed to envelop him which ' lie could .not dispel. He said when in nor mal condition he did not drink, because even one drink of whisky had a serious effect upon his health, but friends told him he drank during these attacks. He said he came to Portland because he liked the climate, having enlisted at Vancou ver in 1899. Upon his arrival he introduced himself to TV. TV. Cotton, attorney lor the O. R. &. X. Co., and made his headquarters at his offices, offering to make himself use ful and asking only to be given a chance If an addition to the force was required. ' Thomas stated that he went there be cause he was familiar with corporation law. He had no letters, and merely pre sumed upon the free masonry existing between members of the bar. He paid his expenses by drawing on his father for $300 in various amounts. Thom as was arrested on December . 1905, for drawing a draft for $50 on his father care of the St, Louis Trust Company. He in dorsed upon it the name of Henry F. Conner, one of the O. R. & X. Co.'s at torneys, and cashed It at the cigar stand of A. Tozler, on Morrison street. He said he had no recollection of the affair, as It was done in one of his afflicted periods, and that he came to Ills senses at the City Jail. The draft was dishonored. Mr. Thomas explained at length that he practiced law with his father for a long time prior to going to the Philippines, and for a short time after his return In 1902. and his father owed him Hi unset tled accounts $10,000 to 515.000. ' His father, he said, mixed parental duties with busi ness, and acted queer with him in finan cial matters. His father would have paid 4he draft it h had known he had drawn the money upon it. Previous drafts he sent on for collection, he asserted. His Trip to Phoenix. Mr. Thomas further told of a trip to Phoenix, Ariz., where he Incurred the ill will of the Atchison. Topeka & Santa Fe Railroad Company for prosecuting tax cases against the company. He told of the practice of the company In incor porating branch lines independent of the main company to evade the interstate commerce law and of getting the Arizona Legislature to pass laws exempting the branch lines from taxation, which was contrary to the organic law'of the terri tory. The company, he said, readily beat lilm in the district and Supreme Court of the territory, but his right to appeal to the United State Supreme Court was not yet exhausted. Some one, he said, took a shot at bim one night in the tough dis trict in Phoenix, for which he blamed the company's hirelings. He explained that Jlghtlng such a case In Arizona was not like doing so in New York or Connecti cut. P. W. Manning testified to having met Thomas in San Francisco in 1901. after Ills relurn from the Philippines. Thomas -was In distress, and be assisted him and obtained a position for him selling soap, and afterwards with the Mutual Life In surance Company. Mr. Manning told of going away on a trip, and when he re turned found that he did not have a col lar left: everything had been taken from his room by Thomas. He learned that Thomas had been drinking, and cut his acquaintance. Thomas, the witness said, was afterwards pensioned by his parents at Palo Alto. The explanation by Thom as of this was that he was teaching tac tics in a boys' military academy for a year. Mr. Manning told of meeting Thomas in Portland, and of his strange actions, and said he thought he was crazy. The evidence concerning the drinking leads to the Inference that the peculiar spells and lapses of memory may be only periodical sprees. J. A, Lee appeared as attorney for Thomas. Further inquiries will be made. Feeding Stock on Beet Pulp. LA GRANDE, Or., Jan. 25. (Special.) Grandy & Russell butchers, are feeding 3000 head of cattle this Winter. A great deal of sugar-beet pulp is being used for feeding, but a large quantity of hay is also required. Ten men are employed in care of the stock. Five teams haul beet pulp, and three wagons are used In haul ing hay. Ed TVlllard shipped this week a carload of big horses to Portland for use in dray ing and other heavy work. .They were gathered up from farmers In the valley and were a fine lot. The horses weighed 3CG0 pounds and upwards. Girl Orators at Monmouth. . IONMOUTH. Or.. Jan. 23. (Special.) Jan. 2S.-(Spocian Judge Hanna this morning denied tlio motion made by Attorney Harry Norton for a new trial in behalf of Jaspor Jen nings, and sentenced Jasper to hang March 9. The case was called just as booh as Judge Hanna dismissed the Dora Jennings Jury, which had deliberated from yesterday morning till 9 o'clock this morning. 'On the llrst ballot taken, soon after they had retired, the vote stood six for acquittal and six for conviction. On the third ballot one Juror came over for Dora, and from that time on until they were dismissed the vote remained un changed. Before passing sentence upon Jasper. Judge Hanna asked him If he had any thing to say. and the prisoner replied: "I have nothing to say only that I am inno cent. I never committed the crime." Attorney Norton Hied notice of appeal and a motion for arrest of judgment. Judge Hanna granted the defendant 30 days In which to prepare the briefs. Dora no longer enjoys her freedom. Today she was removed to the new Jail and once more she will be confined be hind prison bars. "When Judge Hanna discharged the Jurors he set the second hearing of Dora for the fir,t day of the April term of court.
