Assault Upon Fiftecn-Ycar-Old Girl at Bonneville Creates Great Indignation. Guy and Grover Smith, the boys who as saulted Almlra Sheppard, 15 yVars old, at Bonneville. Tuesday afternoon, occupy cells in the County Jail awaiting the ac tion of Judge Frazer. District Attorney Manning nled an information against thorn yesterday. Guy, who is 1G years old, will probably be sent to the Penitentiary, and Grover, who Is 14 years of age, will be committed to tie Reform School. They have acknowledged their guilt. A Deputy Sheriff who went to Bonne 'ille after the culprits says if they were older they would have been lynched. As It was, a crowd of men held Mr. Sheppard, the girl's father, to keep him from killing the boys, as he threatened to do. The father of Guy and Grover Smith Is a junk dealer. He recently obtained a di vorce from his wife, and the evidence on both sides was of a sensational character. Mrs. Smith charged him with bringing the children up badly. SEEK MOTHER'S PROPERTY Wilhelm Marks' Children Say He Wants to Marry Again. Wilhelm Marks, whose wife, Anna Marks, died a year ago, is charged by his children. J. C. Marks. Mrs. Emily Palm qutst and Mrs. Wendcl. with desiring to marry again, and of retaining all of the personal property of their mother's es tate, amounting to $2000. of which, under the law, they are entitled to one-half. Part of the personal property consists of a note executed by Mrs. Palmouist for $700 borrowed from her mother. She was sued by her father", and he also attached a liouse and lot which she own?. He cashed a certificate of deposit and erected a house. Mr. Marks was before the County Court yesterday to answer to a petition filed by his son, J. C. Marks. The proceeding was in the nature of a bill of discovery to as certain what property he has belonging to the estate of his late wife. He told about the note and money, and asserted that he was the real owner, while Mrs. Marks handled the cash for several years before her death. They were engaged in the dairy business in Stephens Addition. There Ls a house and lot. of which Mr. Marks has a life tenancy, and the children declare he has said he would marry as soon as he could find one willing to join fortunes with him. and with the 52000 could live comfortably. Insurance Litigation. A suit to determine who l entitled to 11009 life Insurance money was filed In the State Circuit Court yostorday by Grand Lodge Degree, of Honor against Lillian C. Parrish. guardian of Perry W. Kerr. Hazel Brannan. Wini fred Paine. Leonora Paine and E. L. Butler, holrs of Dora B. Davis, de ceased. Mrs. Davis was the wife of Dr. William H. Davis. Mayor of Albany. He obtained s. divorce from her because of dissolute habits. She moved to Port land and adopted- Perry' W. Kerr as a son, and Mrs. Parrish was subsequently appointed his legal gua-dian. The other defendants in tne case are nieces and an uncle. Mrs. Davis left (Ifiie worth of property, which these same persons are contesting for in the County Court, Ownership In Dispute. The vacation of East Yamhill street for a block east of East Sixteenth street, has caused suits to be fllod in the State Circuit Court by Samantha Sheldon against Judge JB. CI eland and Georg Fetz. Each Is alleged to assert tltlo to a strip of ground 30xl6d feet, and Mrs. Sheldon, who was the original owner of the property, seeks to recovor it. She alleges that the street was nevor platted and that she never parted wltn ownership. The contention of the defendants Is that the land was never dedicated for street purposes, and the Council recently vacated the part of East Yamhill street. The question Is if It belongs to Mrs. Sheldon or own ers of lots adjoining:. 1 Would Adopt Nephew. John Singer and wife petitioned the County Court yesterday for leave to adopt Paul Ernest Hettwoe. a nephew of Mr. Singor. 7 years old. The parents reside in Germany and have six othor children, and decided they could part with this one. ALL FOR ORGANIC UNION Portland Cumberland Presbytery Holds Its Final Session. 1 Unless an emergency arises, the Portland Cumberland Presbytery held its la6t meeting yesterday afternoon in the Presbyterian Church on East Twelfth and Taylor BtreetB. ns by an other year organic union with the Presbyterian Church of the United States of America will be accomplished. Retiring Moderator C. R. Brown called the presbytory to order, and Rev. E. Nelson Allen acted as scribe. Rev. -W. R. Bishop was elected moderator. A communication was received from the McMinnvlllo Cumberland Cnurch asking to bo dismissed to tho Willam ette Presbytery, and after extended dis cussion the dismissal was granted! Rev. J. F. Claytom. pastor of that church, also obtained letters of dismissal. He announced that he has resign od from the McMinnvIUe church to take' effect December 1. Rev. W. S. Holt. D. D.. synodical mis sionary of the Presbyterian Church, was present and was Invited to take part. Rev. C. R. Brown, of Scappoosc, was elected commissioner tu. the general as sembly, and Rev. E; Nelson Allen, alter nate. O. M, Scott, elder, was elected tommiesionor to the general assembly, and W. D. DeVvur alternate. Rev. W. R. Bishop asked to be placed on the re tired list. This was granted after re marks by Dr. Holt, who said that dur ing the many years he had known Mr. Bishop he had never heard of his re fusing a call to preach in any church. Rev. Bishop ls now the oldest minister of the Cumberland Church In the state. The presbytery adjourned subject to the call of the moderator, but there will probably be no more meetings. Every action Is 'now in the direction of or ganic union with the mother church. The Cumberland General Assembly will meet In May, 1916. In Decatur, 111., vh:ch may be Its last meeting. At the session of tne presbytery j'eeterday It was announced that legally organic union between the Cumberland and the Presbyterian Church of the United States of Amorica is now established, only a formality remaining -to finish up the work, and this will be completed at the next general assemblies. This is the largest revenue In the history of the In stitution, with three days still left in the quarter. It is estimated that the total receipts of the department for lSei will foot up about $301,000. as against $24S,Sa.94 for last year. The receipts for the pre ceding quarter were J7S.75S.S2, which was the record up to that time. While It Is reasonably certain that the coming quarter will show a marked de crease in the receipts, on account of the discontinuance of many establishments that started up during the Exposition, still It is believed by the license-collecting officials that the greater portion of this Increase of revenue i due to a healthy growth in population. Carter, charged with defraud ing the Government of 2,s0O.O0O. Circum stantial evidence was Introduced to show that on several occasions when large payments were made to Gaynor and Greene, the Government contractors. Car ter deposited money alleged to be his share of the division of the profits to his credit in a New York bank. The defendant and his attorney objected to the Introduction of this documentary evidence, consisting of bank checks and deposit slips, the objection being based on the ground that there was no record in Team Brand Powder the case that Carter ever received money from the contractors.
