JraC3 KOHaJLNi OEEGOTZIKS, WED5TESBXT, SEPTEMBER 13, 190 o. 10 MUD i PAVEMENTS Careless Teamsters Get Into Trouble as Result. JAMES RILEY IS ARRESTED Municipal Court Hears His Defense and the Testimony of the Po liceman Who Arrested Him. Other Cases Come Up. la te ejmtiering rain, Municipal Judge Camera viewed the pavements on Holla djr. Adams and Pacinc streets yesterday &f tanteon. and it Is probable that he will dettvor some remarks from the bench this mrnin that will strike terror to care less tawters and negligent contractors -wfco permit literally barrelfuls of earth t drop from wagons and He on the costly improved thoroughfares, to ruin the work I bat has been done and paid for by tax payers. Judge Cameron declined to make any advance statements concerning the con dition of the streets, but others who saw them doctor thnt mud from one to four fetches thick lice on the wooden block pavements of Holladay. Pacific and Ad ams streets. Judge Cameron must have wttneneed the same thing. The oaee of the city against James Riley, who has been before the court two pre vious times, was what caused Judge Cam eron to view the premises and satisfy htmratf In what condition teamsters and contractors leave streets. Riley was crKd br Mounted Policeman Croxford tvtth permitting oarth to He on the pave ment of Holladay, Pacific and Adams Htreets. He pleaded not guilty, and said that he left the streets In better condi tion than when he began the work of hanttng away earth from an excavation recently. Poliorman Croxford, however, had his evidence welt in hand. He knew all about the care from start to llnlsh, as he had noted former violations of this very Im portant city ordinance, and purposed to keep a strict watch on Riley to see that he -was obliged to obey the law. Crox ford uwtMed positively that Riley's em ployes did not clean up the streets: that they left much oarth on the pavements and that yeMerday morning, because of the rain, mud was all over the streets. Judge Cameron, having had scvoral ras similar to this one, took occasion hut week to view conditions on Sixth and Oak. and Seventh and Morrison Ftreets. He remarked yesterday that he watched teamsters for ten minutes at each pfcHse. and never saw one of them cloan off the wheels of wagon or attempt to keep earth from the streets. A. H. Tanner appeared In defense of Riley. He was of the opinion that the ordinance. If enforced to the strict letter, would work a hardship upon teamsters and contractors, but Deputy City Attor ney Pitsgerald replied by declaring that teamsters and contractors were altogether too careies: that they have no regard for the rights of others, and that they cared not how many pavements they ruined, as they did not have to pay for the Im provements. The ordinance is very Im portant, he said, because It was the only means wKhtn the powor of the city whereby pavements may be kept In good condition. Judge Cameron will announce his decis ion this morning. "Chief of PoMce Hunt gave me pcrmls fon to block the sidewalk," said Charles Wakrow, when arraigned before Judge Cameron yesterday morning. "Weil. Chief Hunt is not here now, and your permit has run out," laughingly re piled Mr. Fltxgerski. "Wakrow wa? arrested by Patrolman B. F. Smith for keeping wagons standing M the streets at Seventh and Glisan. The case was continued until Friday, so that Wakrow may secure witnesses and the services of an attorney. Standing more than six feet tall, with a giant frame, Charles Crane was ar raigned for bogging. He was trembling ! violently, but It was apparent he was shamming. ! 'May It please Tour Honor." began Crane, with alt the care and skill of a man who has many times been In a sim ilar sHuation. "I'm an electrician by trade, but a pole fell with me recently, I had my shoulder crushed, my arm bro ken, my left leg badly hurt and my head nearly knocked off. By the advice of physicians. I am bound for Southern Arl aona. bees. up- my lungs arc consumptive; in fact, I'm la a mighty bad condition, if the court please." Crane called me every name he could lay his tongue to at Third and "Wash ington streets," repllod Policeman Sloan, the arresting officer. "Furthermore, he got a grip on me with the arm he claims is crippled. I'm a strong man. but I couldn't break his hold. My candid opin ion is that he's a boggar from the ground up. and that's saying he's a pretty big boBftar." Judge Cameron thought it best to give Crane an opportunity to leave the city and thte was done. Crane gladly accepted tt. and said he would leave In fifteen minutes. , A. Hamilton waived further hoaring and wag held to the grand Jury under bonds of 503 on a charge of arson. It Is alleged he set fire to a barn In East Portland for the purpose of defrauding an Insurance company. After much parley, Tom McGllnn, Sam Bolter and "John Doe" are to be tried for assault and battery upon Dan Con nors. The hearing will occur next Fri day morning, at which time McGllnn and Johnson, formerly keepers of the Tux. cdo saloon, will be tried on a charge of keeping their doors open after hours pre scribed by ordinance for closing. A. Shapiro, arrested by Policeman Er nast Johnson for permitting his estab lishment on Third street to be open in violation of the city ordinance, was be fore Judge Cameron yesterday. Johnson paid he saw 11 persons 10 men and "one woman enter the saloon from 3 to 3:40 A M.. September 8. The lights in the establishment were on full blast and everything Indicated that business was being transacted within, he said. Patrolman Ehmson. on whose beat the Patrolman Ehmson, on whose beat the Maze Cafe, owned and operated by Shar- Iro, is located, took the stand and tcstl fled that be mw persons enter the sa loon and omerge therefrom all the way from 2 to 3:30 A. M., and would have ar rested the whole outfit but for the fac. that when he attempted to effect an en. trance he could not get in. The remainder of the case will be heard Friday morn ing. J. B. King, alias Francis Bateman, alias taany other names, arrested by Acting Detective Hlllyer, was yesterday found guilty of stealing a grip belonging to Chief Clerk W. H. Alport, of the Amer lean Inn, and was immediately sentenced to serve a term of six months in the Count' Jail. J. B. Halley was held to the grand jury on a charge of larceny of a trunkfrom the Northern Pacinc Railway. Frank Schurtz Is under arrest, charged with burglary, and behind the affair is a atory of unusual proportions. It is al leged he entered the home of Joseph j. a MACK & CO 86-88 THIRD ON ACCOUNT OF CHANGES BEING MADE IN OUR RUG DEPARTMENT WE ARE OFFERING AT SPECIAL SEVERAL STANDARD RUGS INCLUDING Colonial Brussels, 9x12, seamless, splendid Talue kt $22.50; special 18.00 Crex Rugs, 9x12, seamless, artistic effects, in plain colors; regular $12.00; special 9.00 High-grade Sniyrnas, 6x9, Oriental designs, for hall, library or den.
