Heiberg Gives Testimony in Ac tion Between Standard and Eagle Oil. The Standard Oil Company, having pur sued H. Heiberg; an Important witness J In a lawsuit, for 15 months, it is said. Anally located him in Portland several j weeks ago and for the Ave days Just passed has had him before a notary pub- j 11c taking his deposition. Heiberg, who is a young German, was formerly in the employ of the Eagle Oil Company of Hamburg, which Is in league with the independent oil manufacturers of the United States, and having been taken with the "American fever," eape to this country several years ago and has since then wandered from place to place, readily obtaining employment everywhere as an oil-mixer, and was serving in that ca pacity for Fisher, Thorsen & "Co. and Kasmussen & Co.. local oil jobbing houses, when located by the Stan dard Oil representatives. He had at one time worked in one of the Standard Oil refineries, and on account of his former connection with the Standard Oil's rivals was believed to be something in the na ture of a spy. Nothing to this purpose, however, was proved in the deposition just taken. The Standard Oil Company believed that he would be an important witness in a case for four years pending in the United States Circuit Court for the District of New Jersey, in which the Standard Oil Company is suing the Eagle Oil Company and various independent American oil manufacturers 'to restrain alleged un fair competition and Infringement of the following alleged trademarks, 'Vacuum, Arctic,' 'Etna,' 'Viscollte' ahd 'Electra This suit was brought in this country, it is said, because similar suits of this nature instituted in European countries had re sulted in a protecting decree for th Eagle Oil Company. Heiberg, in his deposition, testified that from his knowledge the Eagle Oil Com pany was in the habit of selling Its brands of oil as "Just as good as" certain Stan dard Oil brands, but had . never stolen trademarks;'that the Eagle Oil Company always sold by sample to the Jobbing hoUses and not directly to the trade, as the Standard OH does; and that the Eagle Ou Company In Europe sells Its products of equal grade with the Standard Oil Company for one-tenth the price. The Standard Oil Company once ran ad vertisements in the big European papers disclaiming all connection with the Eagle Oil Company, Heiberg testified, and from that time on the business of the Eagle Oil Company grew wonderfully. The "vacuum" process of refining oil came largely Into question in the deposi tion, one of the alleged infringements be- ing in regard to this. Heiberg testified that from his observations in the Standard Oil refinery in which he worked, the Standard Oil Company's processes were no different from those used by any other manufacturers and that the "vacuum" process was the only safe way of per forming a certain portion of the work. As to any infringement of the word "vacuum" as a trademark. Heiberg says the process is general and goes by that name. The deposition was taken in Portland before Cecil H. Bauer, as notary, the Eagle -OU Company being represented by Charles J. Schnabcl and the Standard Oil Company by Chamberlain & Thomas. The latter were also assisted by Standard Oil representatives from San Francisco. A great part of the evidence was ob jected to by Mr. Schnabcl on the ground that the United States courts had no jurisdiction over alleged infringements of trademark laws in Germany. Heiberg was summoned to appear be fore a notary public here by order of the United States Circuit Court. CATCHES IMMENSE TROUT T. J. Craig Lands Biggest One From Washougal. "While fishing on the Big Washougal, Sunday. T. J. Craig, of Portland, caught a rainbow trout which measured 23 V4 inches in length and weighed over three pounds. The trout took a fly on a Xo. 10 hook, and leaped five feet from the water in an effort to tear the steel from his mouth. Flinging his. tall in characteristic fashion, the fish found to his sorrow there were two hooks on the line, for his tall caught on the second hook and he was fast at both ends and was landed with comparative ease. This trout is said to be the largest ever taken from the Wash ougal. Mr. Craig, who was accompanied by Jack Frazler and John White, reports good fishing- generally on the Washou gal.
