Senator Clings to the Hope That Su
preme Court May Declare In
dictment Faulty or Sustain
Counsel's Objections.
IForty-five years ago yesterday a young
man learned In the law came to Portland
and sat at the feet of George H. Williams
listening to him tell of the birth and
growth of the Nation. Forty-four years
ago the same young man became the city
attorney of Portland and one year later
the Senator from Multnomah to the
legislature of the state. Forty-one years
ago. he wielded the gavel as President of
the Senate of Oregon. Thirty-three years
ago John H. Mitchell became United
States Senator from Oregon for the first
time.
Day before yesterday George H. Wil
liams, old in service, sat in the Federal
Court and listened to an officer of the
Government tell of the guilt of the man
whom -the listener had welcomed to Port
land almost half a century ago, and with
whom he had worked for .the advance
ment of the state claimed by both as
home. That evening, If he had been yet
in the room, he .would have seen that
same man shrink under the grasp of the
Jaw.
To the people generally July 4 Is the
same this year, last year and the next,
but to separate men different years have
different meanings and different joys. Yes
terday was a sad celebration to Senator
Mitchell and a sad anniversary. Forty
five ycar ago it meant the beginning,the
commencement of hope, yesterday it
meant the ending, the advance o the
night. One beckoned to him with the
hand of promise, the other withdrew the
token. The first pointed the beginning of
power and the marshaling of friends, the
last tore away what little of Influence was
left and marked the retreat of associates
who. like files, seek the sunshine when the
shadows fall.
Senator Mitchell spent a part of the
day in conference with his attorneys. ex
Senator Thurston and ex-Judge Bennett,
in his apartments at the Hotel Oregon.
In the morning he went out lnt the
streets, thronged with those who were
celebrating the coming of freedom. But
he was marked of all and the curious
eyes that followed hunted him back to
his rooms.
In the afternoon a lew of the faith
ful, always to be found, called to extend
sympathy and express hope, but the
meetings were sorrowful and strained and
soon over. There were no plans to dis- j
cuss, no future to map out. no projects to !
outline, everything pointed to the past and
the past was dark. Throughout the day
John H. Mitchell, Jr., who came to be
with his father "during the time of his
trouble, remained with the Senator or at
the hotel.
Through it all remains yet a ray of
hope, however, to which the convicted
man clings, and that is the appeal to be
made to the Supreme Court of the United
States. The faulty indictment, admitted
to be so by the trial court, the .many ob
jections of counsel and Imputations of
error made by them, all are cherished as
straws to which to cling. These things
were gone over by the attorneys who. like
physicians, look for the rift In the cloud
at all times and trust for the better un
til the last. It must be. they say. that
the Supreme Court will see the justice, of
their contentions and give them succor.
It was not a triumphal day nor a pleas
ant anniversary, and the weight of. the
years Is beginning to show In the yield
ing form of the Senator. The breath of
battle has gone and he Is tired of the
struggle. Age shows itself In his bear
ing and in his gait and he seems years
older than three days ago.

One Juror Hold Out In Five Ballots
Against Conviction. .
One man on the Mitchell jury did not
want to convict the. Senator so the story
runs and five times voted to acquit him
of the crime alleged against him. All
were sorry for the defendant, all had sym
pathy, and one of the number was so In
fluenced by his feelings that he would
rather have hot voted for conviction, and
di(T not until the recommendation for
mercy made to the court was incorporated
in the verdict as rendered.
Upon the first ballot the vote was 11 for
conviction a'nd 1 for acquittal, and thistt
same rauo was maintained until live bal
lots had been cast. Then, in answer to
the questionings of the 11 men. the one
juror holding back the verdict stipulated
that if mercy was recommended he would
vote according to the evidence. The agree
ment was made and the verdict was
brought.

THE DAY'S DEATH RECORD
Charles Thompson, Lumberman.
TORONTO. July 4. Charles Thompson,
a prominent lumber merchant of the
United States, and until a few months ago
a resident of Chicago, has been found
dead in his room here. Death was due
to heart failure. He was a native of
Concord, N. H.
Pioneer of Cheyenne.
. CHEYENNE. Wyo.. July 4. Mrs.
James Jillich. mother-in-law of Judge J.
A. " Riner of the United States District
Court, dropped dead at Judge Riner's
home today of heart failure just after
the explosion of a giant firecracker In
front of the house. She was 66 years
old and was one of Cheyenne's pioneers.

Protest From Canton Chinese.
HONGKONG. July 4. A meeting rep
resenting 20,000 Chinese was held at Can
ton. July 1, to discuss the Chinese ex
clusion act. As a result the native Chris
tians formulated a petition to President
Roosevelt, protesting against the exclu
'slon act and pointing out the hardships
it entailed upon merchants and students.
Placards bearing the following appeal
have been posted throughout Canton:
