"Upon recommendation of Deputy District
Attorney Hanoy. Municipal Judge Hogue
yesterday held Charles F. McGinty to the
crand jury on a charge of assault and
battery, preferred by Mrs. McGinty. Be
cause of the fact that the whipping-post
ect, passed by the last Legislature, is now
In effect In Oregon, the defendant is li
able to punishment of that nature. He
pleaded guilty to the charge.
"I think the defendant deserves more
than ordinary punishment," said Mr.
Haney to Judge Hogue. "He admits his
guilt, and It is evident from the appear
ance of that woman sitting there that
she was terribly beaten. I think he should
be held to the grand jury, so that more
adequate punishment may be meted out, i
the courts see lit to inflict it."
McGinty waived examination, and was
lipid under bonds of 1200.
He said he had no money trllh which to
engage counsel, and was not at all fam
iliar with court proceedings. He was in
formed by Judge Hogue that he was en
titled to a preliminary hearing, if he
wished it. but that under the circum
stances, he probably would be held to the
grand jury anyway.
"It does't make much difference what
you make my ball," said McGinty, "for I
can't give any amount."
To the police Mrs. McGinty related a
pathetic story. She said her husband at
tacked her Thursday evening, knocked
her down and beat her. Both of her eyes
were blackened, and she appeared weak
and exhausted. She claims that for a long i
