NOTE ITSELF IS A FORGERY Suit of Luzerne Besser Against the Estate of Lewis Love Compro mised for Two Hundred. and Twenty-Five Dollars. The reliability to be placed on expert opinion concerning handwriting received a severe Ehock yesterday. In the settle ment of a claim of Luzerne Besser against the estate of the late Lewis Love, in the County- Court- Besser presented a note against the estate for SS200 dated August 6, 1S97. and also a claim for $2535 for alleged services of various kinds per formed years ago for Captain Love. The note was typewritten except the signature alleged to be that of Lcwla Love, which was written in lead pencil. The executors of the Love estate T. T. Btruble, Phllo Holbrook and H. C Breed en were all positive that the signature attached to the note was not that of Captain Love. T. T. Struble, who had more experience with Love's signature than the other two, was certain Captain Love never wrote it. His capital' Us. he said, were different from'those on the note. The note was photographed on an en larged scale, and still Mr. Struble was sure the signature was not genuine. Ralph W. Hoyt, who was familiar with Captain Love's signature, said that on the note did not look good to him. H. H. Xorthup and Ed Mendenhall, attorneys for the estate, knew the handwriting of Lewis Love, and were sure 'lie never wrote the name on the 55300 note. An ex pert was called in, and he expressed a like- opinion. Mark O'Neill, attorney for Besser, dem onstrated to the experts that they were all mistaken, and that the signature was genuine. Mr. O'Neill took the case for what it was worth, and not with any in tention of collecting the note or anything from, the estate not justly due. Besser. who was once Chief of Police of Port land, and at another time a member of the City Council, is now an Inmate of the Poor Farm, is pick and not expected to live long. His condition appealed to Mr. O'Neill, and he agreed to act as his counsel The attorneys and executors of the es tate were positive from facts In their possession that Captain Love never ex ecuted the note, and that there could not possibly be any consideration for It. They admitted that on the othor claim of Bes ser's for services rendered to Captain Xov in the Nancj M. Love will forgery case, that perhaps Captain Love owed Besser something, and agreed to settle for $225. which Mn O'Neill accepted. Then Mr. O'Neill sprang aXgreat sur prise on his opponents. Recently he ex amined the note by holding It up before a light, and discovered pencil marks run ning through it; the date 3S7G and several other words. Closer investigation re vealed the fact that the note had once been a. pencil receipt written and signed by Lewis Love. The receipt had all been erased save the signature, and the type written note placed above. Thus Mr. O'Neill proved to the attorneys, executors and others, that the note Itself was forged, but the signature was real. Mr. O'Neill having won the battle to the sat isfaction of his conscience and correct legal procedure, accepted the settlement of $225 for Besser's servies, and dismissed the case. COURT ORDERS WILL FILED. After Three Years Executor Asks That It Be Probated. In response to a citation Issued yester- Ilay by Judge Webster, George E. Watklns filed for probate the will of Mrs. Harriet B. Campbell, who died In December, 1902. Mrs. Campbell was a pioneer of Portland. and In her will distributed most of her property to relatives, and named George E. watklns as executor without bonds. For some reason, the will was never filed In the County Court. Yesterday V.Vrank Whlttler, through Attorneys Carey and Mays, called attention to the fact that there was a will, and Mr. Watklns awn afterwards found and produced it. It bears the date of July 31, 1901, and was witnessed by A. L. Little and W. W Baker. Mrs. Campbell bequeaths to the Home Mission Society of the Methodist Episco pal Church, to the Foreign Missionary Society of the Methodist Episcopal Church, and to the Taylor-Street Metho dist Episcopal Church, $1000 eaCh. To Mary De Lena Barnhart, Maria A. Smith and Sarah A. Latham, daughters. Is bequeathed $3000 each. To F. W. Latham, a son-in-law of the testator. $1500 Is bequeathed, to care for the graves of the family. To Martha Dalton and Orkna Murray, $150. and to the grand children, Henry N. Barnhart. Ben C. Hoi laday, Linda Darcy. Allen Calef and Al mlra Pitblado, $200 each. The rest of the estate Is devised to the three daughters aiary De Lena Barnhart. Maria A. Smith and Sarah A. The complaint alleges tnat the defendant has so far refused to comply with the terms of its policy and suit is brought to enforce the col lection of the money alleged to be due the plaintiff and beneficiary. WILL BE TRIED. FOR TRESPASS Seven Boys Arrested on Warrants From East Side Court. The case of trespass against Frank Mc Crumb. Wallace Kadderly, Ralph Kad derly. Leo Burges, Tod Burges. Wctcomb Clock and Walter McCcumb, will be held this afternoon before Justice Whldemar Seton. . E. F. Cannon is the complaining witness. Otto Prag made the arrest, and there is great Indignation orer the man ner In which he displayed official au thority. The boys all live- out in the direction of Lents, and it is alleged that the deputy paraded the youngsters when he arrested them. There Is also talk of a. damage suit. Three Charges in "Divorce Suit. Because of drunkenness, cruel treatment and nonsupport, Bessie Baumgarte has sued William Baumgarte 1 for a. dfvorce. Judge George signed an order restralalng the defendant from visiting; tne ncrae his wife, or from interfering with her in any manner. The litigants were married In 1SSS. In South Dakota, and have one child. 8 years old. Mrs. Baumgarte avers that her husband began drinking to ex cess soon after their marriage, and has continued tho habit ever since. He ill treated her, sne declare, and failed to provide for her support. Mrs. Baumgarte conducts a rooming and boarding-house. and says the defendant occupies his time Idling about saloons, and drives away her roomers. In March last, she alleges, he struck her -with his fist. She asks for the legal custody of the child. Wife Throws Missiles at Relatives. Charles P. Hays, who recently sued his wife. Elizabeth A. Hays, for a divorce, filed an affidavit in the State Circuit Court yesterday setting forth that she had frequently threatened to kill him and his mother and brother. They reside at 401 East Couch street. Several days ago. Hays alleges, his wife, in an Intox icated condition, visited the house which is owned by his brother, and threw a hammer through the window, which nar rowly missed his mother's head. On an other occasion, he asserts his -wife came to the house and threw a bottle through the window. An order restraining Mrs. Hays from molesting her husDand and relatives was signed by Judge George. Corporations File Papers. The Art Furniture Manufacturing Com pany filed articles of incorporation in the County Clerk's office yesterday, by E. L. Barnett, Robert Andrews and C. A. "Walk er; capital stock, J16.0C8. The objects an nounced are to manufacture and deal in furniture, draperies, etc. Articles of incorporation of the Equita ble Finance Company wera filed yester day by W. A. Hurlburt, Fred S. Morris and William T. Mulr. capital stock, JlO.m The objects announced are to contract for the construction of and to construct all manner of public works. Including water works, electric power and lighting plants, railroads, etc Vill Test Ferry-Boat. Saturday afternoon at 2 o'clock Judge Webster and County Commissioner Web ster and Llghtner will take a trip on the new Albina ferry-boat and test her speed and running capacity. There is a report current that tho steering gear of the boat will not serve Its purpose satisfactorily when short turns have to be made, and will have to be replaced with steam steering gear, at a cost of about $1000. The crew for the boat has not yet been ap pointed. Duty on Sheep Dip in Court. Arguments were heard by Judge Bellinger yesterday in the case of R. E. Moody vs. I. L. Patterson, Collector of Customs. The case Is an appeal from the decision of the Board of United States General Appraisers, wherein the classification and duty upon Imported shoep dip, wore fixed. and is brought to secure a reduction on the rate. Judge Bellinger has taken the matter under advisement. Grand Jury Will Reassemble. An order was Issued by Judge Bel linger yesterday providing for the re assembly of the Federal grand Jury April 4, and notices are being sent to this effect to all Jurymen. Upon con vening: the grand jury will immediate ly take up tho matter of the land frauds. Attorney Sues St. Johns. Mark O'Neill, attorney, has sued the town of St. Johns, in the State Circuit Court to recover $100 for legal services performed In 1903 In advising the corpo ration concerning thervacatlon of certain streets. Kaiser Starts for Mediterranean. CUXHAVEN, March 23. Emperor Will lam started today on his Mediterranean cruise on board the steamer Hamburg, placed at his disposal by the Hamburg- American Line. A Usturbanee of esnaSderable magnitude moved rapidly in from the ocean during the last "24 hours, and Is this evening central over British Columbia. Its Influence is being felt generally in the North PaeiSc States, where rainy weather has prevailed today. High vi lndtj and gales have prevailed along the eoast from Eureka northward to Cape Flattery-. At tne mouth of the Colombia River a maximum ve locity of 72 sites from the southeast occurred. while at the entrance to the Strait of Juan de Fuca, the highest wind attained was 44 miles, from the routh. At Eureka, CaU, the maximum velocity was 36 miles, from tne southeast. The indications are that the storm wilt more eastward during Friday, and cause a corttlnua tlon of rainy weather in this district, with brisk squally southwesterly winds. WEATHER FORECASTS.
