His Attorneys Try to Quash Indict
ment on the Ground That She'
Cannot Legally Give Testl-
mony Against Him.
Can a man's wife legally testify,
against him before a grand Jury on a
charge of infidelity?
"William Reid. attorney, argued to
the contrary before Judge George yes
terday In the case of E. H. Goodwin,
and asked the court to quash the in
dictment. The statute provides that a husband
or wife shall not be allowed to testify
against one or the other in a criminal
case, except in a case of personal vio
lence upon either by the other.
E. H- Goodwin is a well-known
young society man who was married
to Alice R. D. Goodwin in New York
several years ago. Goodwin is well
known in San Francisco and in other
places in this section of the country.
He and his wife separated. Mrs.
Goodwin came to Portland and discov
ered her husband living at the Port
land Hotel with another. The latter
person, upon the arrival upon the scene
of the wife, found it convenient to
leave at once. Mrs. Goodwin caused
the arrest of her husband on a warrant
issued In the Municipal Court. She tes
tified before the grand Jury, telling of
their marriage, and this evidence Wil
liam Reid, attorney for the accused,
argues, snould not have been received.
Mr. Reid called the attention of Judge
George to the section of the statute
which provides:
"In the Investigation of a charge for
thw purpose of Indictment, the grand
Jury shall receive no other evidence
than such as might be given on the
trial of the person charged with the
crime in question."
Counsel in the course of his argu
ment said: ,
The defendant contends that the
Indictment should be set aside, because
the evidence of the said Mrs. E. H.
Goodwin is wholly incompetent; she
swears In the information filed against
him in the Municipal Court that she
is the wife of the defendant, and this
is as far as she can go. She assumes
the relation to defendant as that of
his wife, and tho moment she does this
she is disqualified to testify against
h?m, and could not even be called as a
witness against him.
"In the case of the State of Oregon
vs. McGrath, the court says: 'The com
mon law rule prohibiting either a hus
band or wife from being a witness in a
case to which the other was a party
was. so strict, and the public had such
an interest in its observance, that, ac
cording to Greenleaf, it could not be
relaxed even by their consent.' "
In response to Mr. Reid, Deputy Dis
trict Attorney Moser argued that an
indictment can only be quashed on
statutory grounds, which he enumer
ated, and said the reasons urged by
defendant's counsel were not statutory.
B. 8. Pague, special counsel for Mrs
Goodwin, took a similar position.
Mr. Reid responded that the author
ities hold that the court has power to
set aside an indictment for other than
statutory grounds, where the evidence
on which it was based was Insufficient,
and for different reasons. Counsel also,
called attention to a section of the
statute which provides that where Ju
risdiction is conferred upon the court,
"any suitable process or mode of pro
ceeding may be adopted which may ap
pear most conformable with the spirit
of the code."
Judge George took the motion under
advisement, and the attorneys will sub
mit briefs.
SHIP CAPTAIN IS SUED.
Adolf Schaffer Says Carl Koster De
famedHis Character.
"He is a thief, he is worse than a
bailor boarding-house man; he would
rob sailors of their clothes." Adolf
Schaffer says these remarks were
made concerning him by Carl Koster,
master of the German ship Anna, and
In consequence he has sued Koster in
the State Circuit Court for 53000 dam
iiges. Schaffer also caused Koster to
e arrested because he was about to
leave the state with the vessel. The
captain was releasd on a bond for
52000.
In his complaint Schaffer avers that
he is a builder and contractor and has
resided in Portland for 13 years. The
alleged false and defamutory words
Jie says were spoken by Koster in the
bearing of Emll Hansen and greatly
Injured aim. Schaffer, in his good
same and reputation.
Captain Koster has had considerable
trouble since his arrival in Portland
JWltii the sailors on the ship of which
lie Is In command. He had a quarrel
with a physician who treated one of
the seamen. The latest reported diffi
culty is the Schaffer suit.
W. C. ELLIOTT CASE IS SET.
Demurrer That Indictment Does Mot
Charge a Crime to Be Argued.
The argument of the demurrers to
the indictments against William C El
liott. ex-City Engineer: James M, Cay
wood, Henry Chandler .and E. "W. and
R. M. RIner, was set for Thursday next
by Judge George yesterday. They are
indicted on a charge of attempting to
obtain money under false pretenses in
the Tanner-Creek sewer contract. The
meaning of this is that the Rlners en
deavored to collect pay for a poor piece
of work, and that Elliott. Caywood and
Chandler were assisting him to do it.
The demurrer is on the grounds that
the indictment sets up more than one
offense, and also that the facts stated
in the indictment do not constitute a
crime.

KEN TO BE PICKED.
Firemen Will Be Chosen for Duty at
Exposition Grounds.
President Goode, of the Lewis and
Clark Exposition, held a conference
yesterday with Director of "Works Hu
ber end Mayor Williams, to complete
arrangements for the installation of a
fire department at the Exposition
grounds.
The building in which the depart
ment Is to be housed is now complete,
and has been furnished throughout. The
force will compose three pieces of ap
paratus, manned by a force of 21 men.

Convention Will Discuss Topics

The convention of County Assessors
met in Judge Cleland's courtroom yester
day morning, pursuant to a call by J.
H. Morton, Assessor of "Union County.
The objects of the gathering are to discuss
assessment laws, and to exchange Ideas
concerning taxation and assessment, and
it may be decided to recommend certain
changes in the statute to the legislature.
The question of assessing at approxi
mately the actual cash value Instead of
upon a 50 per cent basis will be talked
over, and the matter of uniform assess
ment in the various counties will also be
debated. There will also be a discussion
concerning the assessment of railway
property.
B. D. Sigler was elected chairman and
J. . F. Nelson, of Clackamas County,
secretary- The Assessors spent most of
the time yesterday in becoming acquaint
ed and early in the afternoon adjourned
the meeting until 10 o'clock today. The
Assessors present were:
