Her Husband, Arthur Brand, a Promi nent Young Attorney of San Fran cisco, Accused of Cruelty. After a brief and unhappy xnatritnonial experience Katherlne Sltton Brand appears in the State Circuit Court as the plaintiff in a suit for a divorce against her hus band. Arthur Brand, becauae of cruel treatment. The papers were filed sev eral days ago by Henry E. McGinn, at torney. Mrs. Brand was born in this city and is a daughter of Mrs. I. TV. Sitton, who is one of the present Board of School Di rectors. Arthur Brand is a young lawyer of considerable prominence in San Fran cisco. He visited Portland and formed the acquaintance of Katherlne Sltton and in time the announcement was made of their coming marriage. The ceremony was performed in June. 1903. In the Uni tarian Church, and the bride, who is talented and very popular with her friends, received many congratulations. Six months later Mrs. Brand returned to Portland and by degrees the painful etory was revealed that Brand was not the loving husband he should have been, but on the contrary, was accused of be ing harsh and cruel, and the bride of only a few months had been compelled to leave him and return to Her mother for comfort and protection. The decree of the court soon to be rendered granting legal freedom to the young wife, will be the closing scene In the domestic drama which has excited much sympathy for the plaintiff. MUST KEEP BOY OFF STAGE. County Court Orders Father to Send His Child to School. Wiley Ferris, aged 11 years, who has been doing acrobatic stunts since he was little more than three years old, with his parents, Wiley Ferris, Sr.. and Lilllo Fer ris, was returned to their parental con trol yesterday by Judge Webster. The court, however, ordered that the boy must not lwrform on the stage any more, and said ho ought to be sent to school. Numerous children have appeared on the etages of vaudeville theaters within the past year, and the attention thia case has attracted may reeult in the prohibi tion of child performers in the future. At the healing of the Ferris case on Tues day Mrs. B. 1L Trumbull, of the Child's Labor Commission, was an interested lis tener, and reports are that proceedings to keep young children oft the stage are to be vigorously prosecuted. In the Ferris case Superintendent Gard ner, of the Boys and Girls' Aid Society, filed a petition in the County Court asking that the boy be surrendered to the per manent care of the society. The petition cet forth that tho boy was kicked and abused by his father and was made to perform when unable to do so. A num ber of witnesses were called and testi fied. Young Wiley also testified and showed himself to be a very intelligent and well-behaved child. He seemed satis fied to remain with his father and mother. In deciding the case Judge Webster held that the evidence submitted was not Burflclent to warrant the court in taking the child from the parents, but they should bo more careful in their treatment of him and keep him off the stage. The Ferris family came here from Chicago. ASK $5000 FOR A LIFE. Estate of Workingman Brings Dam age Suit Against Rearich. Suit for $5000 damages was commenced in the State Circuit Court yesterday by Johanna Diltz, administratrix of the es tate of Henry Diltz, deceased, against Riley Rearich, a sawyer, in the employ of the North Pacific Lumber Company. On February 19, 1903, Diltz was employed in the mill, and it was- his duty to stick a sharp-pointed instrument into the end of a stick of timber and steady the same as it passed to the opposite side of the mill and on to the carriage to be sawed into lumber. The complainant recites that on the af ternoon on which the fatal accident oc curred ho was at work assisting in mov ing a large stick of timber 0 feet in length across the mill. Rearich handled a brake and lever in such a manner that when the stick of timber was suspended live reet in the air the hooks became un fastened, causing the timber to fall on Diltz. crushing and mangling him so that lie died. After tho occurrence Rearich is alleged io have said: "It is good for him; there are others here J will get." THINKS WIFE HIGH STRUNG. Umatilla Farmer Says She Has No Grounds for a Divorce. Alison Acton, a farmer of Umatilla County, whose wife, Mary Acton, has eued him for a divorce, and for 5150 for at torney's fee and suit money, yesterday Hied an affidavit reciting that he is un able to pay tho money demanded, and also mat snenas no cause ror a divorce. The complaints covering those arrested In Eugene Blaster's Sa loon on Tuesday charges them with gam bllng and specifies that the game engaged in was that of draw-poker. The Chinese arrested on Wednesday are ateo charged with gambling, the game played In this case being what Is called by the Chinese "dong-on." The complaint recites that this gume is played with domlnoep and beans, the latter being a representative of money. The cases will be set for trial in the near future. Sues Tenants for Damages. It Is set forth that Sharkey & Son occupied the plain tiffs building on Union avenue, filling the basement with rye straw . Fire partially destroyed the building, and the straw was damaged. The plaintiff says he asked Sharkey & Son to remove the straw, but the firm refused, whereupon the plaintiff had it removed at a cost of 5124, and he asks judgment for this sum, with 57.50 interest and costs. Verdict for Contractor. A verdict for the defendant In the 510.0ft! damage suit of Arthur I. Dillon against J. E. Bennett, a contractor, was rendered by a jury in Judge Cleland's court yes terday. , In August last Bennett was en gaged In constructing a building In the Lewis and Clark Exposition grounds. Dll Ion was working on a scaffold and fell to the ground and both of his legs were broken. He asserted that the scaffold was Insecurely built and that a board gave way. Bennett, as a defense, contended that the accident was entirely the result of Dillon's carelessness. Evidence in Commission Suit. The evidence In the case of E. A. Clem vs. W. S. Conser was heard by Justice Held yesterday and a decision will be rendered upon the submittal of briefs by the counsel. Clem, a real estate dealer, is seeking to recover a commission alleged to be due him on a sale of property for merly owned by Conser, which was sold for J (300. making the commission 5212.59. In the answer to the complaint Conser denies that Clem had anything to do with the making of the sale and that there la therefore no commission due him. Jury to Be Excused.
