THE MORNING OBEGONIAN. TUESDAY, DECEMBER 13, 190 LULL IN THE STORM Portland Club Owners and Dep uties Pause For Breath. GORMAN FILES THREE SUITS 10 Arguments on Writs of Habeas Cor pus Are Continued Until This Aft ernoon,"when Judge George Will Listen to "All Sides. " Arguments In the matter of petitions for writs of habeas corpus In the cases of Chief Deputy Sheriff Morden and Deputy Sheriffs Cordano. Hollingsworth and "Wise, set for hearing before" Judge George yesterday afternoon, were put over until 2 o'clock today. The large crowd In at tendance showed signs of disappointment at the continuance, because sensational speeches were anticipated. Micbae,l Solo mon, who avers that he is the owner, of the saloon attached to the Portland Club, and not his brother, Nathan, was in the courtroom, and also Pat Powers, the old Democratic warborse. who has been em ployed as bartender In the place. Henry McGinn appeared as attorney for the petitioners, the deputy Sheriffs, and S. C. Spencer and Ed Mendenhall as the counsel for the Portland Club propri etors. A. C. Spencer was present as the legal representative of Coroner Finley. After court had been called to order S. C. Spencer arose and stated: "If the court please, 3Ir. Finley tele phoned to me at 11 o'clock this morning, and I did not get to his office to see him and obtain the copies of the papers filed until noon. I would like the case to go over until tomorrow morning to make re turns." Mr.. McGinn admitted that this was a reasonable request and said he would con sent to the continuance. Judge George said he would be engaged with other mat ters throughout the morning session and set the hearing for 2 o'clock. Declaring he was brutally treated, as saulted, knocked down and kicked after being felled to the floor of the Portland Club by Deputy Sheriffs Morden, Cordano and Hollingsworth, William Gorman yes terday filed suits against each of the of ficers named, in the sum of $250. He filed the complaints in Justice of the Peace Beld's court. The amounts were made small, it Is said, because the complainant wished to leave the matter in the hands of Justice Roid for settlement. A larger amount would be appealable. SUES FOR DIVORCE. Cecelia Kagi Says Her Husband Mis treated and Abandoned Her. Cecelia Kagi, who was married to Henry Kagi at Zurich, Switzerland, In 1869, has filed suit against him in the State Cir cuit Court for a divorce and for a di vision of the community property valued at 57000. The litigants reside at Oak Grove, in Clackamas County. Mrs. Kagi In her complaint charges her husband with de sertion and cruel treatment. In the Sum mer of 1894, she alleges that he treated her in an inhuman manner, and she has never condoned his offenses. In August of that year she says he abandoned her, and she has since worked as a nurse and midwife to earn a living. Kagi has $3000 on de posit in the First National Bank, his wife alleges, and ?2S00 in the safety de posit vault. She asks for $150 to pay at torney's fees and the expenses of the suit and $50 per month alimony. The Kagis have three children Mrs. C. Fitzgerald, of Chicago; Mrs. Bertha Zlnck. of Astoria, and Henrietta Kagi, living with her mother. DEVLIN BEFORE GRAND JURY. City Auditor Is Called to Give Testi mony on Mysterious Case. City Auditor Devlin had a long session with the grand jury yesterday morning, and soon after he had left it became whis pered around the corridors in the Court house that the grand jury wanted to know all about the charge of padded pay rolls in the City Engineer's office. Mr. Devlin was required to bring various doc uments with him to the grand-jury room. In the afternoon, Silvey Stuart was a witness before the grand, jury, and an other witness was a boy who is a ward ot the Boys' & Girls' Aid Society. The grand jury devoted considerable time yes terday afternoon to consultation, but what It was all about only the members know. Whether or not indictments for malfeasance were discussed concerning city officials can only be conjectured. The grand jury made no report yesterday. SOLDIER GIVEN AID. Asks for Assistance That He May Go to California to Die. John P. Carroll, who served as a Quar termaster's clerk In the Philippines during the Spanish-American war, applied to the County Court .yesterday for assistance and was furnished with a ticket to San Francisco so that he may enter the Ma rine Hospital at that place and have an operation performed. His health has been poor ever since he returned from the Philippines, where he contracted chronic dysentery. He thinks he will not recover, and told the members of the court he has friends in San Fran' Cisco, and that he did not want to go to the poor farm and die. Court Notes. Judge Webster has gone to Jacksonville and will return Thursday. The inventory and appraisement of the estate of George H. Chance, deceased, was filed in the County Court yesterday. The property is valued at $12,000. LEAVE P0R THE SOUTH. Baseball Magnates Go to Attend Meet ing of League. Judge McCreedle, Ben C. Ely and Wal ter McCreedle leave for California to night to attend the annual meeting of the Pacific Coast Baseball League, which takes place Thursday In San Francisco They will ask for a longer playing sea son here and a different division of the gate receipts. There has been some curiosity to know who is to be tho third incorporator with the McCreedies in the Portland Baseball Club, and it was expected that the in corporation papers would be drawn before they left, but it will now rest until they return from California.
