GRANT NOT GUILTY
Jury ReturnsVerdict After Five
Hours1 Deliberation.
DEFENSE SPRUNG SURPRISES
Showed by Bill of Sale That Grant
Had Disposed of Gambling Para-
i phernalU Over a Month Bc-
j fore His Arrest.
In the case of Peter Grant, charged with
running a gambling-bouse on July 21 last.
the iurv. sworn to try the case, returned
a. verdict of not sullty In Judge Cle
land's Court yesterday afternoon at 4.
o'clock, after deliberations lasting five
hours.
The defense SDrunc a surprise in the
nature of a bill of sale, executed by
Grant and Kate Solomon, of the roulette
wheel and other gambling instruments
of the Portland Club, on June 24. nearly
& month before the arrest, to Edwin
Richardson. Raleigh Trimble and George
Williams testified that they were wit
nesses to the conveyance and identified
their signatures as such on the paper.
E. B. Williams, attorney, testified that
he had drawn un the papers. The con
sideration for the sale was 51500. Attor
ney Ed Mendenhall made the point, in
introducing this evidence, that there was
nothing to show Grant had regained pos
session of the property after the date of
the sale. The charge against Grant was
conducting a roulette game.
After the evidence was all in the at
torneys for the defense sprung a second
surprise. District Attorney Manning
made the opening argument for the prose
cution, and it was supposed Henry E,
McGinn, who appeared as special prose
cutor to assist Mr. Manning, would make
a. sensational speech to close the case.
following those of Grant's lawyers. But
both Mr. Mendenhall and S. C. Spencer.
af tec-h i.TUgct Attorney concluded his
vremarks, informed the court they had
nothlne to sav. Tsndp" the rules of Tirar-
tice, this shut Mr. Mcl55tn. out. He was
not permitted to address "the jury and
had to save his fireworks for a future
occasion.
Immediately after the close of the Grant
trial, the case of the State of Oregon
against Nathan Solomon, jointly indicted
with Grant, was begun. Only eight jur
ors had been chosen when court ad
journed for the -day, as follows: Delos D.
Neer, T. W. B. London, Thomas Fox,
John J. Lee, H. C. Nicolai, J. M. Bar
rett, J. H. Pox. W. G. McCcrmick.
