Says He Can Prove Another
Man Shot Nelson,
BUT WITNESSES ARE. AWAY

Affidavit Filed Telling Strange Story
of Confession by an Unknown
Pronounced Only a Ruse
to Gain Time.
WHAT THE AFFIDAVIT SAYS.
That Walton 4" prove Officer Neloa
was shot by a man other than himself.
That this man visited Walton's moth
er and told her the whole toty, threat
enlnc to kill her U oae revealed it.
That the man shot Officer Nelson be
cause of an old grudge.
That the man ix&a a criminal, thrlo
convicted of crimes, 'who escaped, sen
tence, by being proven Insane.
That he pro in lied to eurrendr himself
to save Walton If Kelson died, and re
fused to do so It the officer lived.
That all this -was told to Mrs. Walton
In an Interview with the man who did
the shooting.
That Mrs. Walton Is 111 in Dubuque,
la., cannot get hero to testify,
wherefore Walton prays for a continu
ance of the case until the next term of
court.
Attorneys In the office of. District At
torney Manning -were dumbfounded at
noon yesterday -when served with an af
fidavit by Henry St. Bayner, attorney for
Charles W. Walton, charged with high
way robbery and assault with Intent to
lcill. The affidavit prayed for a contln;
uance of the case until the next term of
court, to enable the defendant to have
Important witnesses present at the hear
ing, and sets forth a startling1 story, which
the defendant says can be substantiated
at the trial if the continuance Is granted,
The trial was set for this morning, the
hearing of the assault charge to follow
on Monday.
In the affidavit Charles W. Walton seta
forth an Interesting state of affairs. At
torney St. Bayner smiled knowingly when
it was served. The District Attorney and
his deputies are between two fires and
do not know which way to turn It is a
Question with them whether the affidavit
is a barefaced attempt to gain time or
whether there is really something of fact
in the story told. If It Is fact, the case
against Walton has received a death
blow.
Walton first sets forth that he is but
17 years of age and reviews the crimes
with which he is charged in the indict
ment. After the preliminaries, he says

On or about September 16, two certain men
who refused to communicate their names to
her, sought and obtained an Interview with
Carrie B. Walton, In the City q Portland, and
there and then Informed, declared and con
fessed to her that one of them was the man
who, on the evening of September 1, assaulted
and shot Policeman Ole kelson on a street
car returning: from Willamette Heights, on T
street, vihlUt In the vicinity of a certain gulch
in the City of Portland; that he shot two times
with a certain Smith & Wesson revolver, which
he then and there showed to the said -Carrie
B. Walton; that at the time of the shooting
he was disguised with a certain acarf, which
was pinned about his face, which be then and
there showed my mother also; that as he
jumped off the car he brushed against & young
man who was in the act of getting on the car,
and in so doing struck his own face against
the side of the car, causing a slight wound on
h!n forehead.
These men also stated that the one of them
who shot Policeman Ole Kelson did so partly
because some time previous thereto he had had
an altercation with the said Officer Ole Kelson,
and that the said officer had then and there
struck him In the face. This man declared he
was a criminal, and had been three times con
victed of crimes, and had been found Insane
on trial and committed to the Insane asylum,
from which he was paroled about eight months
previous to the shooting of Officer Kelson. He
further stated that he did not want me to
suffer for what he had done; that If Officer
Kelson died from his wounds, he would surren
der himself to the authorities to save me from
the consequences of his act: that he telephoned
to the Good Samaritan Hospital when Officer
Kelson was there, asking permission to see and
talk to the wounded officer, and that this per
mUslon was denied him, he being told that
Officer Kelson was in such a condition that no
person was allowed to see and talk with him,
and that this man was then and there unable
to ascertain the officer's condition.
This man and his companion exhibited two
revolvers to my mother at this time, eta ting
that. It she or any one else through her agency
should tell of their visit or communicate In
any way with other person or persons In such
a manner that detectives, policemen or other
officers should be furnished with a clew to
their Identity, she would have to take the con
sequences, intimating that she would be mur
dered by them.
Important Witness Is III.
The affidavit then sets forth that Mrs.
Walton returned to her home in San
Francisco on September 23; that on Oc
tober 3 she received a letter from her
mother, residing In Dubuqe, la., stating
that her father was dying and not ex
pected to live more than a week, and
that. Mrs. Walton immediately left her
home in San Francisco to journey to her
father's bedside. It states that after ar
riving inDubuque. Mrs. Walton was her
self taken ill, and that at the present time
she Is unable to leave her bed and Jour
nay to Portland to appear as a witness
in the trial of her son, her testimony In
rerard to the facts stated la the affida
vit being deemed by the defendant of the
utmost importance.
Condemned as a Ruse.
"The affidavit is one of the most foolish
things I ever saw," said Chief Deputy
Moser yesterday afternoon. "I do not
think it will be considered by the court."
"It Is extremely foolish and nothing
but a ruse to gain time," said Deputy
Haney. "I would not be surprised if the
court reprimanded the attorney for the
defense for filing such a document."
The affidavit will be tiled this morning
at an early hour, and Mr. St. Rayner will
go Into court and, on the strength of It,
attempt to get the case continued until
the next term of court. The District At
torney was made aware of the affidavit
at noon yesterday. Later an addition to
it was filed to cover important legal
points.
Miss Roosevelt In Yellow.

brown gown of smooth finished cloth,

and a "hat of long-haired beaver,
trimmed with wings in verious shades
of yellow. She passed through town on
her way to visit relatives in Farming
ton, Conn. She will make several coun
, try visits this Fall before she returns
to Washington.
