COHN AND SHIELDS CLASH.

Edward Shields says he is manager of
the recently opened Arcade Theater on
Washington street. S. Morton Conn says
Jhe is not. Mr. Shields quotes a verbal
contract in support of his assertion and
Mr. Cohn points silently to the fact that
lie is sole owner of the new playhouse,
and, therefore, entitled to change man
agers at any time.
Two months ago Cohn conceived the
idea of opening a 10-cent theater on
Washington street, and after some nego
tiation made arrangements with Shields
to manage the house. It was agreed that
Shields should engage the performers, at
tend to the advertising, manage the stage,
the ushers, the limelight and all the mul
titudinous matters connected with a the
ater. For this Shields was to receive 20
per cent of the gross receipts. Cohn "was
to retain the remaining 0 per cent, pay
all the bills and keep what was left over
us his profit
Unfortunately at the end of the first
week there was nothing left over. The
gross receipts had been 5476. Shields had
taken $35.20 as his share of this and out
of the remainder Cohn paid $250 for sala
ries to tae performers, many dollars
more for advertising and lights. Then he
sat down to think it over. Soon he de
cided that Shields was to blame for the
deficit, and he announced to the vaudeville
manager that it would be necessary to
cut down his percentage in future.
To this solution Shields would not agree.
3t was 20 per cent or bust with him. Mr.
Cohn was obdurate and now Shields will
eue to force Cohn to keep his contract.
Mr. Cohn is not alarmed. Indeed, he
says he will enter a counter suit against
Mr. Shields for damages.
"I employed Shields as manager," said
Cohn last night. "I agreed to give him 20
per cent of the gross receipts as long
as his services were satisfactory. His
services were not satisfactory at all, but,
aievertheless, I paid him 595 for the first
"Week. He didn't engage the proper kind
""of performers. I wanted good ones and
'-he employed poor ones. I told him our
""arrangement was at an end, and he
claimed that he was going to remain
anyway. ,
"I don't know anything about the busi
ness, but I can engage men who do. I'm
going to do it. That's all there is to it."
Mr. Shields was seen last evening and
declined to make a statement at the pres
ent time.

Mr. John D. Long, ex-Secretary of the
'Navy, has contributed to the "current
number of the Outlook an article upon
"The New American Navy," in the
-course of which he goes out of bis way
to cast a slur upon the conduct of Presi
dent Roosevelt when he was Assistant
Secretary of the Navy. Mr. Long In his
rather unkind article only convicts hlm
.self of self-contradlclton and misstate
ment. He compliments Mr. Roosevelt for
ihls intellience. Industry, and enthusiasm,
for his helpfulness in the purchase of
ships, and his restless energy In pushing
forward preparations for the Spanish
"War. Having done this, ho turns round
fand says:
His ardor sometimes went faster than the
.president or the department approved. Just,
before the war he, as well as softie naval ofh
cers. was anxious to send a squadron across
he -ocsan to sink the ships and torpedo-boat
destroyers of the Spanleh fleet while wo were
et at peace with Spain.
The gravamen of Mr. Long's charge Is
contained In the above quotation. Mani
festly Mr. Roosevelt did not wish to sink
the Spanish ships and torpedo-boat des-'
troyers while we were at peace with
Spain. The charge is almost too sense
less to be worth denial. "What he wished
was to be In position to sink them with
expedition the moment war was pro
claimed. "While we were yet at peace
with Spain" he wished to be prepared
lor war. His energy and foresight were
amply vindicated by the battle of Manila
Say. He was more responsible than any
other for sending Dewey to the Asiatic
station and for hurrying ammunition
across the continent to him when Long
was half asleep.
In the absence of Long, Roosevelt acted
es Secretary of the Navy. He was re
sponsible for the action of the department
and undoubtedly he went over, under,
and all around the orders of his superior
officer. It was natural he should do sq,
for he was a man of action, while Long
was a man of peace and a slow coach
. generally. It was Insubordination oer
haps for Roosevelt to take the initiative,
but the occasion called for Insubordina
tion. Relative to Mr. Long's criticism, a
special "Washington City Dispatch to the
Chicago Inter-Ocean says:
President Roosevelt's close personal
friends are Indignant over the article of
ex-Secretary John D. Long, and especially
the paragraph which represents Mr.
Roosevelt, while Assistant Secretary of
the Navy, as eager to send a fleet to
Spain to destroy the Spanish fleet while
this country was still at peace with that
power. There is said to be no record of
such recommendation in the Navy De
partment, and the naval officers there say
they never before heard of the sugges
tion. Some of the President's friends see In
Mr. Long's article a part of the effort In
New York to prejudice the Administration
as not safely conservative, but It Is said
that the President has no such suspicion.
He regards the article as simply reminis
cent without being held down to official
facts.
It Is no secret that as Assistant Sec
retary of the Navy Mr. Roosevelt was
Insistent on getting ready for war, which
lie believed to be inevitable, and that he
was impatient with Secretary Long's do
nothing policy, which suggested that he
regarded himself as the receiver for the
'Navy to wind up its business affairs, rath
er than the Secretary to have the Navy
ready for war.
One of the President's friends re
marked that Mr. Long forgot to mention
ono Incident of that period before the
war with Spain, which" is a matter of
Tecord.
That was the Secretary's trip to Old
Point Comfort for a short vacation In
February, 1S9S, and the dispatch which
went to Dewey Immediately after his de
parture, directing the Commodore to be
prepared to go to Manila and strike the
Spanish fleet there when war should be
declared. That dispatch was signed
"Roosevelt," and Mr. Long returned to
"Washington to continue his peace policy
in the Navy Department.
The President's friends admit that Mr.
Roosevelt helped to get the Navy ready
tor war, but they deny that he ever rec
ommended a hostile demonstration against
Spain before war was declared.
Intnrance Lair Held Invalid,
DES MOINES, la.. Oot 20. Judge
Smith McPherson, of the Federal Court,
has rendered an opinion in which he
holds the anti-compact law placed on
the statute books of Iowa In 1&H3 Is In
valid, and asserts insurance companies
have as good a right to combine as other
commercial Interests.
The opinion is of far-reaching Impor
tance, affecting every company in the
state, S3 of which asked an Injunction re
straining the State Auditor from enforc
ing the Blanchard law which prohibited
two or more companies entering an
agreement to fix rates.

DENVER, Oct. 0. The general court
martial, sitting at the state capital, to try
members of the National Guard of Colo
rado, resumed its sessions today. ' "Wit
nesses were sworn by the prosecuUon In
the case of Brigadier-General John Chase,
who has been the commander of the
Guard, and Is accused of perjury, disobe
dience of orders of the Commander-in-Chief,
Governor Peabody, and usurpation
of power. Among these witnesses was
Adjutant-General Sherman M. . Bell, who
makes the charges.
A. W. Grant, Clerk of the Court of
Teller County was called and testified as
to the proceedings in habeas corpus In
the case of W. F. Davis, confined In the
military prison at Cripple Creek. "Upon
the return made by General Chase In this
case, to the effect that Davis had been
released, the perjury charge Is based.
Private Frank E. McElroy was called,
but did not respond. Judge Advocate Grier
requested an attachment be Issued
for him, and that he be brought forthwith
from Cripple Creek.
Judge Advocate asked that the perjury
charge be passed for the present because
of the absence of McElroy, and the diso
bedience charge taken up. The defense
objected, arid the court took a recess to
consider the motion of the Judge Advo
cate. "When the court reconvened this after
noon the motion of Judge-Advocate Grier
to lay aside the charge of perjury against
General Chase and proceed with the dis
obedience charge was argued and finally
overruled, and the court adjourned until
tomorrow.
ALL IN ONE NATION.
Carnecrie Expect to See America,
Britain nnd Canntlu Joined.
LIMERICK. Ireland. Oct. 20. The free
dom of tills city was given to Andrew
Carnegie today.
Referring in a speech to emigration, Mr.
Carrtegia said he looked for the day when
the United States and Canada would have
a population of 250,000,000, and with the
British Isles would form one nation.
Subsequently Mr. Carnegie laid the
foundation stone for a library.
Herald Libel Cukc on Trial. -UNION,
Or., Ocfe 20. (Special.) In the
Circuit Court today the trial of the sec
ond case of the 12 indictments frfr crim
inal libel against the publishers of the
Baker City Herald was called, the first
case having resulted In acquittal. The
parties were represented by the same
counsel'as In the former case.
The state introduced the libelous mat
ter and rested, and the defense put on one
witness, when the court adjourned until
tomorrow.
