Is as follows: Be It enacted by the Legislative Assembly of the State of Oregon: Section 1. That Is shall be unlawful from and after the passage of this act for any per son, company or corporation owning or oper atic? any line of railway "in this state, wheth er such railway be operated by steam, elec tricity or other motive power, to cross at grade, excepting within the- corporate limits of any municipal corporation In this state, the tracK or tracks of any other person, company or corporation owning or operating a line of railway in the State of Orecon. Sec 2. Any person, company or corporation, and th officers and agents of such company. or corporation, or any officer, agent or ser vant thereof, who shall violate the provisions of section 1 of this act. shall be doomed guilty of a misdemeanor, and upon conviction thereof shall for the first offense be fined In a sum not less than $500 nor mors than $1000, and for each subsequent offense any sum not exceeding $1000. Sec 3. Any person, corporation or company, or other person interested in or affected by the actual or attempted violation of the pro visions of section 1 of thto act. may prosecute a suit In equity to enjoin any actual or at tempted violation, of the provisions of section 1; but such suit shall in no wise affect the right of the state or any person complaining to prosecute any person, company or corpora tion, its agent or officers, or any thoreof, Tor the violation of the provisions of section 1 of this act. Provided, however, that this act shall not be retroactive; and provided, fur ther, that this act shall not apply to railway crossings owned or operated by the same per son, company or corporation. Sec 4. Inasmuch as the safety of the trav eling public upon the railways of this rtate will be greatly promoted by the passage of this act. and emergency exists therefor, tbW act shall take effect and be in force from and after Its passage. The bill was passed yesterday by the Senate, and as has already been stated. It has specific bearing upon the attempt of a trolley line at Oregon City to get southward into the Willamette Valley. The matter Is fully explained In the follow ing statement, made up la advocacy of the bill: Senate bill 2Co. 237, introduced by Sena tor Brownell and passed by the Senate, is Intended to prohibit crossings at grade outside of the incorporated city. The gen eral policy of this character of legisla tion Is sustained by the text-writers, courts and Legislatures of many states. See 3 Elliott on Railroads, section 1122. The reason for such decision and rule is, as Mr. Elliott says: "Crossings at grade are not only a source of Inconvenience and delay to the companies operating trains over the cross ing, but they are also a source of danger on account of collisions between trains, and consequent injuries to employes and passengers." Or, as said by the Supreme Court of Pennsylvania in Railway Company vs. Bail way Company, 77 Pennsylvania Stat utes. 173, quoted In note 3, section 1122, 3 Elliott supra: "Crossings at grade are always attended with danger. As our population becomes more dense, travel and traffic will in crease, and the injuries resulting from grade crossings will be multiplied. Each succeeding year will increase the neces sity for avoiding them; their construc tion should now and henceforth be dis couraged." There are sufficient reasons for a gen eral law prohibiting grade crossings It. the country, and It is bad enough to al low them in cities and towns as the bill does. Again, It Is well known that la the country freight and passenger trains may and must make a speed of from 15 to 40 miles an hour, and If grad- cross ings of these roads are permitted to other railways, the common supervision of the same train dispatcher cannot be had and not only is the danger to the employes and public upon all trains, greatly in creased, but the speed and operation of trains are greatly impaired. The bill does not prohibit the railway crossing roads already built or to be buiit. for under the proposed law they may cross but must do so either by the usual and common overhead crossing, or cross, by a tunnel or cut under the other track. This may slightly Increase cost of first construction, but owing to danger of acci dents removed thereby. It will be far more economical In the end. The immediate occasion of this measure Is the attempt bf the Oregon City & Southern Railway Company to cross the tracks of the Southern Pacific near Cane mah, twice almost at right angles, within the street of Canemah: and the county road leading from Or egon City, and within the distance of less than one-third of a mile, and on the immediate bank of the Willamette River at a narrow and dangerous piece of track between Oregon City and Canemah, of less than one mile in length. The proposed road exists wholly on paper; its whole line proposed connects with the street car at Oregon City, and extends to First street in Canemah, a distance of about one mile. Its object is to connect with up-river boats at Canemah, as it Is claim ed, but mainly, to force the South ern Pacific to buy its franchise and enable its promoter to divide the price. Last Summer this property, the franchise, given to the new company by Mr. Fields, of Oregon City, was given to him by the county, and was offered by him and his associates to the Southern Pacific for $6000, and on last Saturday it was again offered to the Southern Pacific for $15,000 by its present promoters, Speaking by Mr. Latourette, their attorney, and the sole object Is to force the Southern Pa cific either to pay these gentlemen, some large sum for nothing or submit Its trains and the traveling public to the danger of two grade crossings in this short space, at a most dangerous place in the main line of a legitimate com pany. The stock in these two corporations will be called In and a new corporation will be formed to control the entire street railroad system.
