OREGON CITY. Feb. 11. (To the Ed
itor ) The plea of Hon. R. G. Smith for a
constitutional convention, published In
your issue of Sunday, lack? the force and
conclusiveness which usually character
izes articles coming from his pen. He
seems to regard the state constitution,
formulated by the pioneers of the state
40 years ago, as an mtrument for the.
propagation of political Immorality. This
ie the latest and by all odds the most
original excuse that has ever been made
for the shortcomings of members of the
Oregon Legislature. It Is manifestly un
fair that all our legislative crimes, or any
portion of them, should be shouldered
upon the unoffending authors of our stats
constitution. It -would eeem that If the
limitations of that constitution have un
dermined the morals of our legislators. It
would be unsafe to adopt a constitution
Imposing any restrictions, and that possi
bly we should abolish the constitution al
together and proceed upon the old-fashioned
plan of having no written constitu
tion. If the old constitution provided for too
few offices, and prescribed salaries that
were inadequate for -such offices as it did
create, is there not danger that in a new
instrument we may go to the other ex
treme and establish offices and fix sala
ries that will give still greater dissatis
faction in coming years? It is an easy
matter to pick flaws In a completed work,
but It Is well to reflect that there Is more
talent In this world for destructive; than
for constructive work. The young bump
kin who ventured the opinion that little
talent was required to write the Book of
Proverbs was conclusively answered by
the college professor when told to write a
few himself. The state would probably
suffer nothing If the work of preparing a
new constitution were left to men of the
admitted capacity of Mr. Smith, but the
chances are that any constitutional con
vention we might elect would give us a
less satisfactory Instrument than the one
we now have.
Has the suggestion for a new constitu
tion come from the taxpayers of the state?
Who is demanding It? From not a single
county nor a single precinct has any re
quest come for it. A number of our pol
iticians, who seem especially solicitous
about the welfare of the people, are urg
ing1 an amendment providing for the Ini
tiative and referendum. Would not the
question as to whether or not we need a
new constitution be a good one to open
up on? What question Is there that the
people are more vitally interested In than
the fundamental law which -we designate
as our state constitution? If the people
want a new constitution, let them say so
at the polls before the expense Is Incurred
of holding a convention whose work they
will. In all probability, repudiate, just as
they did the five amendments submitted
last June.
A member on the floor of the House, last
week. In discussing a bill providing for
the relief of the Supreme Court, argued
that the needed relief should be secured
through a constitutional convention, which
might be relied on to Increase the number
of Judges. Would not a constituency
which has overwhelmingly voted down
an amendment providing for such a thing
Just as readily vote down a constitution
providing for it? The people of the state
could not have protested more emphatic
ally against tinkering with our old con
stitution than they did last June. Every
amendment proposed was beaten by thou
sands of votes. Even the so-called negro
amendment, that no one was In reality
opposed to, was voted down for no clear
reason, unless It was to rebuke the po
litical fad that because our constitution
is 40 jears old It Is necessarily defective,.
Provision is made for amending it when
ever It falls to meet present requirements.
We have patched on 15 amendments to
the National Constitution, and it has not
perceptibly marred the beauty or the
strength of that Instrument. What change
Is needed in our constitution that -cannot
be effected by amending it, and that, too,
without the expense and uncertainty oC
a constitutional convention?
Mr. Smith's, proposition that a new con
stitution would Improve the morals of our
politicians Is untenable. They are past
redemption, and such of our citizens as
are amenable to any plan of redemption
are not to be made good by statute. Mrs.
Nation Is demonstrating that In Kansas.
Most of us are of the opinion that a con
stitution framed only 40 years ago by such
men as George H. Williams. M. P. Deady,
It, P. Boise, James K. Kelly, Thomas J.
Dryer, David Logan and other -men of
that type, Is as good as a,ny that would
be framed by the average politician of the
