POKTHAJCD, Oct 05. (To the Editor.)
In an editorial in this morning's Ore
jjonian, under the caption "May Vote
Away From Home," the statement is
made that "one may vote outside his pre
cinct, in his own county, if hfe Is Trilling
to take the trouble, of proof." The "de
cision" of County Clerk'Ho'.mes published
n few days aso is to the same-effect. This
is not the law. The Supreme Court of this
state settled that question years ago. In
"Wood vs. Fitzgerald; 3 Ok G6S, the court
in -considering the right of stockmen,
hcidcrs and others having" no fixed resi
dence, to Vote, held that if a. person "is
a, bona fide- resident of a- county, but
has no fixed residence or domicile In any
particular precinct therein, he may vote In
any precinct In which he nnds himself
on the day of election," but that "when
an indiridual has established for himself
o. settled residence and fixed domicile in
sjay precinct of a county, there he must
vote." The- opinion of the court was de
livered by the "late Judge .McArthur. The
decision has ever been questioned in
thb courts of the stae and It is the set
tled law that if a- person has n. fixed place
of residence in a county. If he votes in
suchjjounty, he must vote in the precinct
of his residence.
The constructon of the law given by
Mr. Holmes andThe Oregonian Is directly
cortrary to the- decision of the highest
Judicial tribunal of the state, and its ten
dency is to open the door to all of the
frauds which the registration law was

The pressure has fallen in the North Pacific
States during: the last 24 hours, and a storm
center Is approaching "the Northvest Wash
ington Coast tbl evening, The- pressure is
highest along the Northern California Coast
and in the Mississippi Valley. Cloudy to partly
cloudy conditions prevail west of the Cascades,
while eart of this mute the weather Is clear;
It is unseasonably warm In the Pacific North
