Refused to Bring: Before the Jndgre a Prisoner Whom He Had Hot Arrested. BOISE. Idaho. June 5. J. P. Campbell. Sheriff of this county, -was arrested today on a bench warrant and "brought before Justice of the Peace Kerrlck on a charge of contempt of court. The case 'will be heard Wednesday morning. It appears that one Squires ivas arrested and brought before Judge llerrick on a charge of horse stealing by the city police, and he M'as turned pver -to the Sheriff for safe keep ing until the preliminary examination. When the time came for his appearance the Sheriff refused to bring him in, on the ground that it waa the duty of the officer "who arrested him to brlngr lilm before the court. The bench warrant fol lowed, Coroner Glover serving the "war rant. The man Squires -was afterward brought before Judge Herrick by'Beputy Sheriff Robinson. There is more trouble over the railroad question. When the money was sub scribed Saturday for the 'bonds, the Cham ber of Comtnerce took immediate steps to close "up the contract ivlth the Midland. Shermart Coffin, 'secretary of the Chamber of Commerce, stated tonight that the original proposition between the Midland and the Chamber of Commerce was to the effect that when 20 miles of. road were built the llldland-stiouia receive a deed, upon giving a good bond that at least 33 more should be built. Mr. Broadbent. who is the principal owner of the right of way, appeared before the Chamber of Commerce last Saturday night, and through his attorney demanded that the Midland "be required to build 30 tniles of road before receiving a deed, and upon failure to build up to 50 miles, that the property revert back to Mr. 3roadbent. The Chamber of Commerce refused to consider such a proposition, taking' the ground that when Mr. Broadbent had re ceived the $20,000 he asked for the right of way. he had nothing to do with the conditlona to be imposed upon the Mid land. Mr. Broadbent had previously of fered the right of way in writing to the Chamber of Commerce for 520,000, without other conditions, and his attempt now to tack on conditions is resented by the Chamber. The Chamber of Commerce has dis charged its old railroad committee and appointed x tiew one, consisting of Sher man Coflm. chairman: Judge Richards and R. E. Green. Mr. Coffin states that tho committee is now preparing a con tract -which Tvill be In strict accordance with the proposition between the Mid land and the Chamber, and that, when it is completed, the committee will .go to Mr. Broadbent and make a tender of the money due on the right of way. If he accepts, then the contract will be signed with the Midland immediately and work commence in earnest. If he refuses, a mass meeting will be called and the mat ter again Teferred to the people. The subscription of John B. Broadbent and Peter Sonna for $12,003 of bonds was refused by both the Chamber of Com merce and the Midland, on account of their having strings attached, so that the subscriptions amounted to nothing. The subscription of the Boise City National Bank is now flxed so that it is a bona-flde subscription. The rumor that Colonel Dewey had of fered the Midland $250,030 It they would miss Boise is an error. T. W. Bates states that no negotiations whatever have been entered Into up to date with Colonel Dewey. The members of the Chamber of Commerce say they believe Mr. Broadbent will deed the right of way upon an offer of the money. The Midland now has 408 Japanese at work in the canyon.
