Sites Tedder, One of the Trio Said to
Have Been. Held-Up ly Adry,
Box Disappeared.
MINNEAPOLIS. Feb 26. When the trial
of the Hayward murder case -was resumed
today it was announced that County At
torney Nye could not be present, owing
to a funeral in his family, and Assistant
County Attorney A. H. Hall conducted
the cross-examination of Harry Hayward.
Hayward's connection with the loan Miss
Gins made on the flour mill at Hamel
and the collection of the loss when it
suddenly burned, was thoroughly venti
lated. Harry was asked whether he had
r.ot drit'en out to Hamel with Miss Gins
the morning after the Are. This he denied
utterly. The state proposes to show on
rebuttal that he was not telling the truth.
Harry described how he had turned the
lot given him by his father into cash.
The proceeds had been nearly $10,000, and
this he partially lost at gambling, while
the rest lie bad given Adry in a sealed
envelope, and it was put In the safe. He
declared the most money he ever lost at
one time was $5709, at the Twin City Ath
letic Club.
The cross examination was finished this
afternoon, and then the defense started
to impeach M. D. Wilson, the liveryman,
one of the state's witnesses, who had tes
tified to seeing Harry riding with Miss
Gins on" the fatal night.
During the examination, Hayward was
asked why he did not keep his money in
the bank, and he explained that he was
afrakl that Elder L. M. Stewart would at
tach It, as he had had some business with
that gentleman in which each had tried to
beat the othor, and Stewart had the worst
of It He owed Stewart some interest
money, and djd not want him to get it.
Assistant Prosecutor Hall showed that
Hayward did not owe Stewart any money
after Harry sold his property to him, and
the witness explained that he had been
in the habit of keeping his money out of
the bank to escape Stewart before that,
and therefore it had become a habit with
him. Hall also tried to show that the
loans Hayward claims to have made to
Mis Ging were fictitious, but he met with
slight success. Hayward had the best of
the encounter with the assistant prose
cutor. It seemed at times that Mr. Hall
did not know what he was driving at, and
Hayward quickly recognized that he
could match his opponent and give odds
in tho game of repartee. That the ac
cused took a keen delight in this contest
was apparent. His answers were given
for the most part with a sort of whimsi
cal and witty nonchalance and he sur
veyed his inquisitor in a critical way.
Ella Vedder, one of the trio that was
robbed on the night of the famous hold
up, is said to have gone to Missouri.
There was a hint yesterday that the state
intended to summon Miss Vedder for the
purpose of bringing out the facts about
the highway robbery incident. It is be
lieved that she would tell a different
story of the affair entirely from" that told
by Harry Hayward. Nothing is known
as to the duration of Miss Tedder's ab
sence. A JACKPOT OX THE TABLE.
Tho Body of n. Murdered Man on. the
Floor Xenr By.
IIAZLETON, Pa., Feb. 2G. With a jug
of liquor and a jackpot on the table, a
party of gamblers were found playing
cards at Sugar Loaf yesterday, while on
the floor lay the body of a murdered man.
Philip Schaup, the murdered man, was
a. mine foreman, living at Sugar Loaf, a

and populated by 'foreigners. "The" news
reached 'here yesterday that Schaup had
been found dead a few hours after he
had started to see some of his workmen.
Ills father-in-law, William Ringleben,
and several friends wont at once to Sagar
Loaf, where they learned that the body
had been carried into Mike Sinkers'
house. It was here that the searching
parly interrupted the gamblers. They
claimed they had found the body in the
wood a. short distance away, and carried
it Into the house. The gamblers, who
were foreigners, declared that he was
alive then. There were no marks on his
body. Dr. Smith expresses the opinion
that the man had been poisoned. An au
topsy will be held.
AFFIRMED THE COXVICTIOX.

of "Winnie Sinnton.
SAN FRANCISCO, Feb. 26. The su
preme court rendered a decision today in
the case of Winnie Stanton, the young
woman who threw vitrol in the face of
Charles Stensel, Corbett's first manager.
She was convicted of felony, and Judge
Wallace sentenced her to live years im
prisonment in the penitentiary. Her at
torney asked the court to instruct the
jury that it had the right to find the de
fendant guilty of simple assault, or of an
attompt to commit the offense charged.
Judge Wallace declined to give such In
structions, and the appeal was based upon
the alleged error. The supreme court af
firmed Judge Wallace's ruling.
A Snppoiicil Member of the Cnng.
CHICAGO, Feb. 26. A portion of the
booty from the looted First National bank
at GrtewoUl. la., was recovered here today
and & supposed member of the gang im
plicated in that robbery and the affray
at Council Bluffs yesterday, is under ar
rest. The suspect Is Mark Davis, a Chi
cago saloon-keeper, who was arrested
with about 909 postage stamps, which he
got shipped in by the American express.
JJIed or His "Wounds.
LOSANGSLKS, Cal., Feb. 26. Constable
Harvey Branscomb, stabbed yesterday
near Calabas by Manuel Dunnigan, whom
he was attempting to arrest on a warrant,
died this morning. Dunnigan, who was
t-hot by Branscomb, is in a dangerous con
dition, but it is thought he will live. The
bullet has been removed.

NEW YORK. Feb. 36. The court of ap
peals lias afllrmed the conviction of Dr.
Buchanan, the wife-murderer.
AN ARTIST'S ANSWER.
His Wife's Ideas of Woman's Rights

NEW YORK. Feb. 26. A special from
CiaelRMiti. O., says: Mary T. F. Fierro,
wife of John W. Fierro, a wealthy artist,
on Saturday filed a petition for divorce,
ftUegtatc neglect. Yesterday Attorney
Odan O'Noil tiled for the husband the
most unique and advanced answer and
crsMs-petition ever tiled in these courts.
John says Mary is a devout believer and
disciple of woman's rights, and that her
pursuit and study of this subject has
induced her to absorb a bitter hatred for
pockety as it now exists, and especially
for mankind.
Mr. Fierro alleges that his wife thinks
it is his duty to support her in absolute
Idleness, her conception of the rights of
a married woman being that she shall
hav all the rights assumed by the stern
er k. relegating the irksome duties of
household work to others.
Farther, he ays. his speuse is a be
liever in spiritualism, and consults me
dium who pretend to advise her of his
"shortcoming" and the manner of treat
ment that should be nceted out to Mm.
On this account be asks for a divorce, de
nying alt her charges.
Decree In the Wickes Divorce Cuse.
CHICAGO. Feb. 26. Judge Tuthlll to
day delivered the decree of divorce to
Mrs. Laura. R. Wickes, wife of Thomas
H. Wickes, vice-president of the Pullman
Palace Car Company. The terms are the
reault of an amicable arrangement be-
tween the complainant and defendant.
Besides turning over to his wife life in
surance policies to the amount of S1S.500,
Mr. "Wickes transferred to her the family
residence at No. 3647 Grand boulevard,
and to her and the children the property
at No. 3516 Grand boulevard. He also
agrees to keep his life Insured for 515,000
In favor of his wife for the payment of
mortgages on the property mentioned, In
case of his death.
Hm. Drayton' Petition.
TRENTON, N. J.. Feb. 25. Mrs. Char
lotte Augusta Drayton, whose husband,
James Coleman Drayton, is suing her In
the courts of this state for a divorce, on
the grounds of adulter, today filed a
counter petition asking for a divorce oa
the grounds of desertion.

COLLIDED IN THE FOG.
A Slight Brash. Between the Tele
phone and XortliTrest.
The steamers Telephone and Northwest
had a little encounter yesterday morning
in a thick fog. The Telephone, starting
for Astoria, had just backed out from
her dock at the foot of Alder street, and
was waiting- for the Burnslde-street bridge
to open, when the Northwest came crash
ing into her from behind. The Northwest
was bound for the Ccwlitz river. The only
damage to the Telephone was a broken
wheel bucket. The steamer went back to
her dock for repairs, and two hours later
proceeded on her way to Astoria. The
Northwest was damaged to the extent of
about 558. The guard was broken and a
portion of the planking of the hull was
torn off down to the water's edge. The
boat was taken up to Johnston & Olsen's
yard for repairs, and the steamer Salem
was sent out in her place.
The Lighthouse Bontx.
The lighthouse tender Columbine is load
ing with material for buoy work on the
Sound. Captain Farenholt, lighthouse in
bpector, will go down to Astoria this even
ing, and if the tender can get out at once,
he will go around on her; if not. he will
wait till she gets round to the Sound and
go overland to Join her, and while there
will look out for site for xog-3lgnal sta
tions. The Manzanlta will start up river
today, to attend to. buoy work on the bars,
repair stake-lights and fix up things gen
ierally, as far up as St. Helen's.
Without a Bill of Health.
The barkentine Eureka, which arrived
at Port To.vnsend Monday from La Paz,
Mexico, without a consular bill of health.
Is detained by the customs authorities
pending the advice of the secretary of the
treasury, to whom the matter was re
ferred. The case Is similar to that of the
Hawaiian bark Mauna Ala, which was
subject to a fine of 55000, all of which was
remitted with the exception of 55.
Lout of the "Western Belle.
The Western Belle; a ship well known
In Portland, is now at New York, where
she will be converted into a barge. This
vessel, on her last voyage to Portland,
was commandJd by Captain Sweeney,
who afterwards got sadly tangled up in
the opium business with Nat Blum.
Sweeney, whan last heard of, shipped be
fore the mast from San Francisco.
Lost Several Spars.
LONDON, Feb. 26. The steamer Hall
fax City, this port, reports that on Feb
ruary 22, in latitude 50 north, longitude 16
west, she passed the British ship Lao-
mene. Captain Randall, from San Fran
cisco, September 8, for Liverpool. The
Laomene had lost her main royal mast,
foretopgallant mast and jibboom.
Xo Sign f the Powder Ship.
TACOMA, Feb. 26. The ship Occidental
arrived today to load wheat, but reports
having seen no signs of the missing
schooner Mary Dodge, 29 days out from
San Francisco with a cargo of powder.

ballast at the Sand deck yesterday.
Ships loading wheat yesterday were the
British General at the elevator, Celtic
Queen at Columbia dock No. 2, Duncan
at Montgomery dock, and Carnarvon Bay
at Victoria dock.
The Louden Hill discharged coal at the
O. R. & N. deck yesterday. The Inver-ness-shlre,
another coal ship, has arrived
up and will soon go to the Gas dock. The
big ship Dumfrelsshire has begun to take
out coal at the West Side bunkers.

now at Tacoma, wheat, thence to Cork,

at a lower figure.

DEED OF ASSIGNMENT.
It Was Made by the Oregon City Sash
& Door Company.
OREGON CITY. Feb. 26. The Oregon
City Sash & Door Company and S. B.
Califf and Charles Callff, the members of
the partnership, made a deed of assign
ment this morning to C. O. T. Williams.
The liabilities are $1S,4B0, besides accrued
Interest on a considerable amount of
paper, which, it is estimated, will bring
the total liabilities up to nearly $20,003.
The assets listed in the aeed foot up $11,
327, Including machinery, stock, real es
tate and accounts. The real estate is
mortgaged for $1500 and the machinery for
$S0d, and $3900 of negotiable assets are held
by one of the creditors as collateral se
curity. This leaves $6327 from which to
pay debts aggregating at least $15,500. Al
lowing for the usual shrinkage in turning
property into cash under these slrcum
stances and for bad debts, the prospect
is not favorable for the unsecured credit
ors to get much on their claims.
Fifteen Portland creditors hold claims
amounting to about $2300, the larger ones
being Rasmussen, Fisher & Co. $336,
and Kelly. Dunne & Co. $i. The
concern owed only about $209 for labor.
Comparatively few of those named In the
list of creditors will suffer by the failure.
No one had any Idea that the company's
liabilities were one-third what they are,
not even the members of the company.
On account of the wide distribution of the
losses, it is not expected that any of the
endorsers will be seriously inconven
ienced by the assignment. This is the
only business failure the town has suffer
ed for more than a year, and the second
failure in considerably more than two
years. This company began business
about five years ago, and suffered loss
first from the flood of lS9d and later from
tire. It enlarged its plant and moved Into
a new mill about two years ago. The
factory has done but little work this win
ter. The trouble was precipitated by a
chattel mortgage in favor of F. Born, of
Portland, filed a week ago today.
County Clerk Hortorr has completed the
tax rolls and wilt turn them over to the
sheriff for the collection of taxes 2&arch
L The total valuation upon which Clack
amas county pays taxes this year is
$3,277,778. The state tax to be raised Is
1 $15,85. The county general fund will be
550466, the road fund 521.111, and the school
fund 529,555. The various school districts
raise an additional aggregate of 51C.CS1.
State and road poll taxes amount to 5523,
and the city tax in this city to 53G67, mak
ing a grand total of $15L2S4 to be raised
by taxation In this county this year.
A number of the people of Oregon City
attended the funeral of the late M. A.
Stratton In Portland today. Mr. Stratton
lived here many years, and he was al
ways held In the highest esteem.
The Postal Telegraph.
NEW YORK, Feb. 26. At a meeting cf
the stockholders of the Postal Telegraph
Company today, the following were elect
ed directors: Albert B. Chandler, John W.
Mackay, John W. Mackay, jr., George S.
Coe, W. C. TanHorne, James W. Ells
worth, Charles R. Hosmer, George C.
Ward, William H. Baker, Edgar C. Brad
ley, and E. C. Piatt. The president's re
port stated that 3514 miles of pole line had
been constructed, and (ESS miles of wire
strung during the past year. A second
route to the Pacific coast of two copper
wires, 500 pounds to the mjle, via Colo
rado, New Mexico, Arizona and Southern
California, was also constructed. Busi
ness has been remarkably good, consider
ing the general depression, and shows a
considerable increase over last year.
Sleep and Death.
WATERBURY, Conn., Feb. 26. Mary
Fanning, aged 77, who has been In a
trance nine days, died yesterday. She
went to sleep a. week ago Sunday at 1
o'clock and could not be awakened. She
breathed naturally and coughed once, this
being the only signs of animation. She
took but little nourishment, it being forced
into her mouth.
Flood's Trial Again Postponed.
SAN FRANCISCO. Feb. 26. The trial
of John W. Flood, ex-cashier of Donohoe
Kelly & Co.'s bank, charged with falsify
ing the records of that Institution, was
postponed today until March 27, owing to
Flood's Illness.
