LAW 61'IT ABOl'T TUE DFLAXEY MOXEI.
In the Cirouit Conrt. William Delaney. ad
ministrator of the estnto of Daniel Delaney.
deceased, against N. T. Cutnti and C. G.
Curl. Messrs. Williams and Mallory ap
peared for the plaintiff, and Lansing Stout
and Benjamin Harden appeared for the de
fendants.
This is an action at law brought by the ad
ministrator of the lato Daniel Delaney, to re
cover the sum of nineteen hundred dollars,
which it alleged tn have been taken from De
laney') boose hy George P. Beale and George
Laker at the time they murdered De
laney ; and which it is alleged they buried near
Salem, and of which, after they had been ar
rested, it is alleged they informed their attor
neys. Messrs. Caton Sc Curl, who, it ia also al
leged, scent tn the place where the nirney was
concealed, and took the tame and converted it
to their own uee.knoving that it was Delaney 't
money.
The depositions of George P. Beale and
George Baker were taken, hy order of the
Court, before their execution fur the murder of
Delaney, and were read ill evidence. The
alatt-ineiitt contained in the depositions do not
differ materially from the confessions of the
murderers, published in the Statetman tome
lime ago. and we will imt reprint them lieie.
They are simply to the effect, that the prison
ers told their attorneys where the money was
which they had ubtnined nt Dehiney's, and
that Messrs. Cntou it Curl had admitted tn
them (the murderers) that they bud "raised
the money."
William Delaney. the administrator, catltd
for plaintiff Stnlv he had a conversation, in
presence ul Sheriff Headrick.at Lafayette with
defendants, anon after Ileale s confession. in re
lation tn this connecti n witH the money.
Cnrl said it was all right, or that they would
make it all right.4 Caton spoke up and sujl it
wat a pack of d d lies, or tome of iicale't
liet about the matter. Conversation flopped.
Don't know that I ever had any other cmiver
talinn with Curl. Hud litlle conversation
with Catnn about the matter in Salem ; said
he would fix it op ; laid be would see Logan,
nd tee w hnl he would r!o, Heard Caton say
that he had got f 1.&30 fr.nn where Beale had
buried it i but Caton laid that Beule told him
that wat hit money. Heard ennri nation at
the jail between Catnn, Logan and Beale, in
pretenoe of .Vr. Edet. Beale wanted Caton
to aay whether he had got any nf Delany's
moiiev or not. Caton deu,ed Retting any
Logan taid he had got some money, but it wat
tint Delaney t. Beale wanted tatnn tnei
plain about the 1300 got ol Baker. Caton re
plied that he would let Mr. Curl explain that ;
that be did not waut to implicate any one.
When lleale would ask Caion nueitiont, Mr.
Caton would Irt Lngai, answer them. I think
both Beale and Baker mentioned the t o00 to
Caton. lleale contended that the money be
longed to the estate, and that n he wat bound
to die, be wanted to tee that the matter wat
straightened up. Beale told Catoo that be al
wivt told him (Caton) that the money belonged
to Delaoey'i, and that he must not uae it.
Caton replied that Beale had told him it wat
bit (Beale t) mnner. Before leaving the jail.
Caton laid be bad r. ceived" 12.000, but that it
wat Beale't money, and that he bad expended
the tame in making the prisoners delence
Crott-eiamined by Stout. I never held out
nr inducement to Beale and Jlaker. in the
conversation! spoken of, to leairthem to hope
or think that they could obtain any resAite. 1
always told them that there was no hope for
them. I did oner to everyimiy mat we wooio
(ire one fourth nf tbe money recovered tup
poting that a large amont had been taken.
Don't think I beard all tbe conversation at La
layette. Caton taid, at Lafayette, that "they
(lid nut get any money" ; don't think he taid.
"that he did ant get any of old1 nun Delaney's
trmnev." Caton said first at the jail, "that
they did ant get any money," and then said.
before leaving that "they got two Ihnosand
dollars, but that it wat Beale t money, and be
had expended it in the tail." Caton referred
the majority of the qoeitioni ta Logan. Caton
aid Mr. Curl might explain altout tbe f 5U0 of
Baker money. Logan told Beale at the jail
that he (Beale) had told him (Logan) that
then wu twenty or thirty thousand dollars of
Dehiney's money buried lip there near l)e
limey's. Bcalu would not admit that he bad
told Logan that they hod buried nil the money
up near Delaney's house. Ilu'ile said that be
told him they hud buried that much up there
and brui'ght mine to town.
Jle examined hy Mallory. Uo stated that
the offer of one-fourth the money wat mailt! to
the community at largo, and not to tho prison
ers tn Influence them ; Beale taid that the
$:i(l,000 story wat told to Indnco tho attorneys
to work harder fur them s that they would not
believe theiu when they told only of a small
sum. Beule taid Lngun told him that if he
had a large amount of money tn operuto with,
ho could hire witnesset.get men tn tear the jail
down, ohlorofortn the sheriff, ico., in order tn
get the prisoners free. Logan told Bealo that
this statement was a lie.
George A. Edci called. wtit present at
the conversation at the jail, referred to by Mr.
Delaney, ' When w went in, Beale com
menced putting questions to Catnn, which
were, in part, answered by Mr. Caton. and
tiimo were not. Mr. Beale asked Mr. Cntou
if he bad lint reoeired $1,400 nf old man Do
laney't money, or words to that efl'eot, which
C'atou denied ; but during the conversation
acknowledged that they (Caton, Curl and Lo
gan) had received $1,380, but denied knowing
that it wns old man Delaney's money, repre
senting that Beale had told him it wat hit own.
There wat a great many questions asked by
Caton, Logan and Beale one of the other,
which were fur the most part denied. Logan
asked Beale if he (Beule) had not told him
that there was a large sum of money deposited
somewhere, that he obtained from Delaney.
He said that he had, and gave at a reason for
stilting, that bo wished hit attorneys to exert
themselves the mora to procure his acquittal.
A plat of the .ground wat then presented and
shown to Beale, and acknowledged by Beule
to he the one he gave Logon or have made to
show where tills large amount nf money was
buried ; and stilted that ull the money ho ob
tained from Delaney was about $2,000; and
that he told Mr Caton that it was Delaney's
money, which Mr. Caton denied. '
' John G. Wright called. I heard Mr. Caton
say in my store, alter the trial, that he had
received no money fur defending Baker ; that
he had done all he could for hi in and not gut a
cent ; and that Beule might go to hell.
George M. Stroud called. I benrd Mr.
Cdtnu ruifiaik, in it conversation in Mooret'
store, that they had received $1,380 for de
fending Benle and B iker, and tin more ; and
that he hud never denied it. Ho explained
that Beale said it wat hie money.
' John M. Davit called. I wat preient nt a
conversation in the jail between Caton and
Curl, and Beule and Baker. Both parties
Hindu charget which the other side would deny.
They were repealing over the propositions
made before that time. I think Mr. Cut! ad
mitted that they hud got $1,380. I think the
matter of the $ jOl) was denied by Caton and
Curl. I was present when the confession wus
made. Bealu never m ule contradictory state
ments about the Delaney matters. He told
me the tame story all the time.
Allen Croasman called. Heard Catnn tay,
in Wright & Uzal'uvnge'a sturo, that he bad
defended . Baker an I hurt himself by il, mid
got nothing fur it ; and that Bailie might gu to
heH.
The testimony of Sheriff Hcndrick, for plain
tiff, did not differ materially from that of Mr.
Edes, and is not printed for that reason.
TESTIMONY FOR DKKKSHK.
Durid Logan. Testified to conversation with
Ileal and Baker in tho jail in presence of the
Sheriff, Edos, Dciany, and Caton after confession
was made. Could not coroborato Beat's confession
as to the kijling of Delnny said lleale had told
it differently to him beforo tho trial. Said that
Beule told him he had got a large sum of money
from Delaney's had been there often before he
accomplished his purpose had dugahole before
hand for the reception of the money and after it
was obtained, went in n circuitous route and de
posited the money in this hole, havfhg previously
sent Baker directly to.tlio house. Said he had
not brought a dollar of that money to town
that the money buried above Salem was his own
money. Logan said tlioro was $1380, and he got
$4UU of it. Did not recollect what was said in
conversation witli Byron Cardwell.
.V. T. Caton. Conversation at Lafayette was
substantially as dotailed by the Sheriff. My un
derstanding was that 1 was denying having any
of old man Delaney's money. lleale t story of the
killing was not as he reported it to me. Ho said
they went there to kill old man Delaney. and that
he shot him after Baker did. The conversation
at which Win. Delauy was present in the jail is
correct as related by the Sheriff and Mr. Edes.
Win. Delany is mistaken it was not as he related
it. I told Mr. Beale I was willing to explain the
monev matter when Mr. Curl returned, and did
so explain. .
V hen lleale first told me ot tne money, Mr.
Logan and myself went out in a buggy to see
how tho " and lav Wo returned and 1 told
Beale he was lying to us, "you have no money."
Beule said "1 know why you did not get the mon
eyyou think it is not mine i you know more ot
my business than almost any other man: you know
how J got the money ; it is mine." Beale then
told Caton how he came by it that day at
noon I went to where the money wet and at
the close of the preliminary trial of that day,
Mr. Curl and myself went on to the place and got
the money and brought it to town it wns dark
before we got back. That night or the next
morning.we counted the money, Mr, Logan and
neither gentleman being present there was
$KH). Mr. Logan got tiKI, Mr. Curl ltiO, and
I as much. Beale would not talk to Curl, and
Logan was in Portland, so that I had all nf the
labor to perform. I traveled a great deal at Beale's
order, and spent more money than 1 hail got, and
pent it in good taith, believing it to be lleale s
money. 1 so Informed Heme before the trial.
I never had any of old man JJeluno a money. 1
never got Baker's $01111, and did not tell him that
I did. (Some other unimportant testimony. J .
C. G. Curl. The conversation at Lafayette was
abnrit as related by Mr. Headrick. It was I that
said Haker was a a a liar we never got his
money. Beale told me the money was his own.
I went wilh Mr. Caton after the money; there
wat s)l.lrj0.' I got one third, Mr. Logan one third,
and Mr. Caton retained one third. I never taw
Baker'i money.
