officmi.. LAWS OF THE UNITED STATES, PAD AT Till First Session of Ike Thirty-Eighth Congress. An Act to prevent Simi(i(f!i(t, and for other pUr pOSI'S. Bo it enacted hy tlio Senate and House of Bun resentetivos of the United ("dates of America in Congress essentWed, Thnt, from and after the passago of this act, all Roods, wares, and nter cbandiie, and all bugjrage and effects of passen gers, and all other articles Imported into the Uni ted States from any continiious foreign country or country, except as hereafter provided, as well as the veesuls, cars, and other vehicles and envel opes iu which the same shall ho imported, shall be unladen in the presence of, and be inspected by, an inspector or other ollicer of the customs, t the first port of entry or custom house iu the United State where the same shall arrive; and to enable the proper officer thoroughly to dis charge this duty, he may reqire the owner or owners, or his, her, or or their agent or other per on having charge or possession of any trunk, travelling-Imp; or sack, valise, or other envelope, or of nny closed vessel, car, or other vehicle, to open the same, or to deliver to him the proper key I and if such owner, tifrent, or olher person hall refuse or neglect to comply with his do mands, the said officer shall retain such trunk, -travelling-bag or sack, valise, or whatsoever it may be, and open the same, and, as soon thereaf ter as tmty be practicable, examine the contents ', and if an'v article or articles subject to tho pay. merit of duly shall ho found therein, the whole contents, together with tho envelope, ahull he forfeited to the United Stales, ind disposed of as the law providcTin olher similar cases. And if any such dutiable goods, article or articles, hall be found in such vessel, cur, or olher vuliits la. the owner. airent. or other uuraou in eliariro of which shall have refused to open the same or do. liver the key us herein provided, the snme, to- E ether with the vessel, car, or oilier vehicle, shall e forfeited to the United States, and shall beheld by such officer, to bo disposed of as the law pro Tides in other similar cases of forfeiture. And belt further enacted, That to avoid tho inspection at the first purl of arrival, required by the first section of this act, the owner, agent, master or conductor of any such vessel, car, or other vehicle, or owner, agent, or other person having charge of any inch goods, warea, mer chandise, bnggnge, ollects, or oilier articles, may apply to any officer of tho United ritntes duly authorized to net in the premises, to seal or close the same, under and according to th" legulatioiis hereinafter anihoriaed, previous to their importa tion Into the United States: whi h iflie.'r shall leal or close tho same accordingly! whereupon the lame may proceed to their port of destination without further inspection : l'rovided.T'hiil noth ing contained iu this suction shall he construed to exempt such vessels, car, or vehicle, or its con tents, from inch examination as may oe necessary and proper to prevent frauds upon the revenue and violations of this act: And provided, lurih-r, That every such vessel, car. or olher vehicle, shall proceed, without unnecessary delay, to the port or place of its destination, as named ill the mani fest uf its cargo, freight, or contents, and bo there inspected, as provided in section one, Sec. 3. Ami he it further enacted, That the Secretary of tho Treasury bo, and he is hereby, authorized and required tu make such regulations, and from time to time so to change the Same as to him shall acorn necessary and proper, for seal ing such vessels, cars, end other vehicles, when Jiracticable, mid for sealing, marking, and idetiii ying such goods, wares, merchandise, baggage, effects, trunks, travelling-has or sacks valices, and other nveloiMs and articles: and also in ro- gard to invoices, manifests, and other pertinent papers, and their authentication. See. 4. And belt further enacted, That if, the owners, muster, nr person in charge of any vessel, car, or other vehicle, sealed as aforesaid, shall not nroeeed to the port or place ot destination thereof named iu the manifest of its cargo, freight, or contents, and deliver such vessels, car or ve hicle, to the proper ollicer of the customs, or shall dispose of the same by sale or otherwise, or shall onload tho same, or any part thereof, at any oth er than such port or place, or shall sell or dispose of the contents of such vessel, car, or other ve liicel, or any part thereof, before such delivery, he shall be deemed guilty of felony, and on con viction thereof, before any court of competent jurisdiction, pay a tine not exceeding one thous and dollars, or shall be Imprisoned for a term not needing five years, or both, at tho discretion of tlio court i ana sucn vessel, car, or oilier vehicle, . with its contents, shall, be forfeited to the Uui ' ted States, and may be seized wherever found within tlio I nitcd States, and disposed of and old as in other eases of forfeiture: Provided, That nothing iu this section shall be construed to prevent sales of curgovin whole or in part, prior to arrival, to be delivered as per manifest, and ' after due inspection. See. 5. And be It further enacted, Thnt if any reauthorized person or persons shall wilfully break, cut, pick, open, or remove any wire, seal, lead, lock, or oilier fastening or mark attached to any vessol, car or other vehicle, crate, box, bag, bale, basket, barrel, bundle cask, trunk, package, or parcel, or anything whiitsoovo", under and by virtue of this act and regulations aulhoriveil by it, or any olher act of congress, or shall alh'x or attach, or in any way wilfully aid, assist, or en courage the alliiing or attaching, hy wire or otherwise, to any vessel, car, or other vehicle, or to auy crate, box, halo, bairel, hag, basket, bun , die, cask, package, parcel, article, or thing of auy kind, any seal lead, metal, or anything purport ing to be a sual authorir.ed by law, such persou or persons shall bo deemed guilty of felony, and, open convictiou lufore any court of competent lliri.flii.tti.tt atoll litk ,,iitri.,iti..fl f,,e form ... j. ...... - exceeding rive years, or shall pay a tluu of jtnt exceeding one thousand dollars, or botli at the discretion of tho court.
