Sec, 3. And bo it furihtr enactid, That lh said court, in addition to the jurisdic tion now conferred by law, slull ulsoh.ive jurisdiction of all set-niTs, counti r claims, claims for damage whether liijuidatcd or unliquidated, ir other demands whatso ever, on the part of the Government against any person making claim against tho Government in hi1 court ; and upon tho trial of nny sin h enuse it shall hear and doteriniiiB sm-h claim or demand both lor and ngaiiutlha ttovrrniii.nt and claim ant; and if upon tho whole case it finds that tlio claimant is indebted to the Gov ernment, it shull render judgment to that fleet, and such judgment shall be final, with tho right of appeal, as in other cases herein provided for. Any transcript of such judgment, filed in the clerk's cilice of any district or circuit court of tho United Slates, shall be entered upon the records of tho same, and shall ipso faito become and ue a judgment of such district or cir cuit court, and shall be enforced in like manner as other judm. i U therein. And be it further enncUd, That the suid court cf claims shall hold one an nual session, commencing on tho first Monday iu October in each year, and continuing so long as may ba necessary for tho prompt wspoihion of the lusiucss of the court, The & id court mar pre scribe rules and regulations for practice therein, and it may punish for contempt, in tho manner pre.-cribed by common law. Jt may appoint commissioners and may generally exercise such powers as are no cessary to carry out the powers herein granted to it. The judges, solicitors, and clerks of said court shall be admitted to the use of the congressional library, and also tho law library, until a law library be provided for them. The said court may appoiut a bailiff, who shall hold his office during four years, unless sooner removed by said court lor cause, and who shall re ceive a salary of one thousand dollars, payable quarterly. The judges and clerks .f said court may administer oath nnd affirmations, take acknow ledgments of in .Rtrumci.U in writinj, and give certificates jf the same. Said court shall have a seal, with such device as it may order. Mem bers of cither house ol Congress shall not practice in said court of claim. Sec. 5. That the solicitor, ns-isiant solicitor, and depu y solicitor of suid court, kha l hereafter Ve appointed by t 'resident, by nnd with tho ndvice and content ol the Senate, and it shall bo 1 1n ir duty faithfully and diligently to defend the L'titcd States in all matter and casts before sij court of tlaims; and in all cases taken by p q therefrom to the supreme court; and no other fee or compensation than the salary of said solicitor, and assifnnt and deputy aoPehors, shall hereafter, in any c..se, be paid to dther of them, and no fee or com pensation for services in either the supreme court or court f claims shall hereafter be allowed or paid in any cue by the L'niled tSlutcs. And be it further enacted, That the jurisdiction of tho said court shall not extend to or include any claim against tho Government not pending in said court on the first day of December, Anno Domini eighteen hundred and sixty-two, growing out ol or dependent on nny treaty stipu lation entered into w ith foreign nations or with the Indian tribes. Sec. 10. And bo it further enacted, That every claim against the I'niud States, cognixable by the court of claims, shall be forever barred unless the petition setting forth a statement of the claim be filed in the court or transmitted to it under the provisions of this act within six years af ter the claim first accrues: J'rovid'tJ, That claims which have accrued six years before the passage of this aet shall not be barred if the petition be filed in the court or trans initled as aforesaid within three years af ter the passage of this act: Andprovidrd, further, Thut the claims of married wonn firt accruid during marrinre, of persons under the age of twenty-one years first accruing during minority, and" f idiots, lunatics, insane persons, and persons be yond seas at ih-s time the claim accrued, entitled to the claim, sha'l not be birred it the petition be filed in tha court or transmitted, as aforesaid, within three yearsafter the disabil ty has ceased; but no other disability than those eaumerated shall prevent any claim from being barr ed, nor shall any if the said disabilities operate cumulatively. Sec. 11. Aud be it further enacted, Thai any person or persona who shall corruptly practice or attempt to practice any fraud ngoiust the United States in the proof. statement, establishment, or allowance of any claim, or any rart of any claim against the I'uited State, shall ipso facto forfeit the same to the Government; and it shall be the duty of the court of claims, in such cases, to find specifically that such fraud was practiced or attempted to be praetis ed, and thereupon give judgment that such claim is foifeited ro the Government, and that the claimant be forever barred from prosecuting the same. Appeals may be taken from the court ol claims to the su preme court, in all such cases, on all ques tions ol law, in the manner herein provid ed for appeals in tther cases. Sec. 12. And brtt further enacted, That any petition filed under this act shall be verified by the affiJavit of the claimant, his o"eiif, or attorney, statin;; that no as signment or transkr of said claim, or nny part tin rcof, or m y int- rest therein, has been made, except as in said pttitioii sta ted; thut said claimant is justly entitled to the amount therein claimed frim the I'ui ted States, after allowing all just credits and offsets; and that he bli ves the farts as stated in said petition are true: J'roviJ- id, hoicever, That in order to authorize the said court to reader a judgment in favor of any claimant, if a citizen of the United States, it shall be set krth iu the K-tition that the claimant, and the original and e very prior owner tlicrcol w here the e'uirn has been assigned, L is ut all times borne true nlleuiar.ee to the Government of the United States, and whether a citizen or not, that I,o has not iu any way volunta rily uided, abetted, or (.iven encourage ment to rebellion against the said Govern ment, which allegations may be travir-ed by the Government, nnd if on tho trial such issue shull be decide I nzain.st the claimant, his petition shall be dismissed. And be it lurthrr enacted, That there shall be a secretary of said Territory, w ho shall roide therein, and shall hold his office for four years, unless sooner remor ed by the President of the United States he shall record and preserve nil laws aid proceedings of the legislative assembly hereinafter constituted, and all the act and proceeding of the governor in sis ex ecutive department ; he shall transmit one copy of the Isws and journals of the legis. luiire assembly within thirty days alter the end of each session, and one copy of tho executive proceedings and official cor respondence semiannually, on the first days of January and July in eat h year, to the President of the United State, and two copies of tha law to the President of the Senate and to the Speuker of the House of l.cprYSeiitntives tor the use of Congress; and in case of the death, re moval, resignation, or aksei co of the gov ernor from the Territory, the secretary shall be, and he i hereby, authorized and required to execute and prrfonn ail the powers and duties of the governor du ring such vacancy or abeiKv, or until an other gorernor shall be duly appointed and qualified to fill such vacancy.
