Hood Itlver Terminal Company,
complaining that the city is trespass

directing the city to remove the sew

The terminal company alleges that
it was ready to make Home Improve
meats on the laud but that on ar
ranging for leveling off part of the
ridge caused by the sewer It was
found that the pipe had been laid at
the top of the ground Instead of four
feet under the surface.
Tne couucll at Its meeting the last
of the week took cognizance of the
letter and Instructed City Attorney
Derby to take the proper steps for
condemning the strip of land occupied
by the sewer.

Notice of Improvement of Street
Notice Is hereby given pursuant to Ordidance
No. 371. passed by the Common Council of the
City of Hood River on the sth day of April, li12,
and approved by the Mayor on the 9th day of
April. lyl2, providing for the improvement of
Sherman Avenue from the West line of Sixth
Street west to the Kast line of Ninth Street, ex
cept in front of such property as permits for the
improvement of which under this ordinance shall
have been issued: that bids will be received bv the
undersigned City Recorder at his ofTice. 211 Oak
Street, in said city up to 12 o'clock noon on the
4th day of May, 112, for the improvement of said
street by grading the same to the established
grade, as established by this ordinance, from curb
line to curb line, and the construction of cement
walks and curbs along the South side of said
street as provided for by the City Surveyor. The
work of grading said streets and sidewalks shall
be let in one contract and the construction of said
cement sidewalks and curbs shall be let in a sep
arate contract and each of said contracts shall be
required to be completed within sixty days from
the date of awarding the same.
Said bids shall be opened by the Street Commit
tee as soon as practicable after the time fixed for
receiving the bids, and the several bids, together
with the summary thereof, shall be reported to
the Common Council at its next regular meeting
thereafter, to-wit. on the 6th day of May. 112. at
the County Court House in said city, at which
time said bids will be considered.
Notice is further given that any interested par
ty may tile his objection to the letting of said con
tract within the time specified for receiving bids;
and that the same will be transmitted to the City
Council along with said bids for their considera
tion at said meeting. The person, firm or corpor
ation to whom the contract is let will be required
to enter into an agreement to the effect that said
contractor shall look alone for payment for mater
ial and work to such particular portion of the
fund to be assessed upon the property liable to
pay for such improvement and paid into the City
treasury for that purpose, as shall be assessed to
the property in front of which and to the charge
of which a particular part of the improvement to
be done by the successful bidder is to be made and
collected and paid into the City treasury, and such
contractor shall in no event require the City of
Hood Kiver or any of its officers or agents to pay
the same, except out of such particular portion of
said funds so assessed or collected into the City
treasury, and for such portion of said improve
ment, nor seek to enforce payment of the same on
any part thereof against the City of Hood River
or any of its officers by any legal process or other
wise, except out of such particular fund.
All bids must state price for grading said
streets to grade, and price for constructing said
curbs and sidewalks, which work shall be done in
the manner and form provided for in General Im
provement Ordinance No. 194 of the City of Hood
River. No bids will be received which specify
more than one price on said work chargeable to i
one block in length. A bond for the faithful per
formance of the contract to an amount equal to;
25 per cent of the estimated contract price will be
required of the successful bidder, the Council re
serving the rwht to reject any and all bids.
