"The main point contended for by
Itlngen were: That the railroad
company's depot was on the town
ulte of Itlngen, and the right of way
bud been donated to them, It being
understood, an a matter of fact, thut
the depot would be called after the
town; that tickets would be Hold to
lMngen, freight accepted for BIngeu,
and thut ISlngeo would receive up
proprlate uotlce on the time cards
and turlff sheets. That the com
puny understood this Is shown by
the fact thut for three months they
did so recognize It, and then, with
out a word of explanation, without
consulting the proprietors of the
townslte, who gave them the right
of way, the company wiped the
name of lilngen off their map and
substituted the name of a rival town,
access to which has to be made by
stage from the depot at lilngen.
When the railroad commission were
appealed to and rendered their de-
clslon, the railroad company object
ed on the ground that the people of
Wulte Salmon bad not beeu beard In
the matter.
"The case was appealed to the su
perlor court, and for the third time
the decision Is the same."
