CITY OF SEASIDE, OREGON
Notice is hereby given on November 8, 2022, a general election will
be held in Clatsop County, Oregon. The following shall be the ballot
title of the measure to be submitted to the City’s voters on this date. An
elector may file a petition for review of this ballot title no later than the
seventh business day after it is filed with the city elections officer.
CAPTION: TEMPORARY BAN ON PSILOCYBIN SERVIC CENTERS
AND MANUFACTURING PRODUCTS
SUMMARY: State law allows the operation, manufacturer, distribution
and possession of Psilocybin and Psilocin. State law provides that the
City of Seaside City Council may adopt a measure to be referred to
the voters to prohibit the establishment of any registered or licensed
activities. The Oregon Health Authority has initiated a rulemaking
process to implement the state’s psilocybin regulatory program and
intends to begin accepting applications for psilocybin-related licenses
on January 2, 2023. This measure would add a two-year moratorium
for prohibiting the establishment of operations of psilocybin-related
services. The Oregon Health Authority has not completed the
rulemaking process to implement the state’s psilocybin regulatory
program. The City Council believes that prohibiting psilocybin product
manufacturers and psilocybin service centers within the city’s
jurisdictional boundaries to enable the adoption of the state’s
psilocybin licensing and regulatory program to allow the city to adopt
reasonable time, place, and manner regulations on the operation of
psilocybin facilities is in the best interest of the health, safety, and
welfare of the people of Seaside.

DEFAULT: The Grantor is in default and the Beneficiary elects to foreclose the Trust Deed by
reason of the failure to pay the following: (1) Grantor’s failure to pay when due the monthly sum
of $1,250.00; and (2) Grantor’s failure to pay real property taxes for tax years 2020-2022 in the
amount of $3,048.56, plus interest.

AMOUNT DUE: By reason of the default, the Beneficiary has declared all sums owing on the obli-
gation secured by the Trust Deed immediately due and payable, those sums being the principal amount
of $113,078.42, plus interest on the principal amount at the rate of 12% per annum from October 8, 2021

of said default, have elected, and do hereby elect, to foreclose said Trust Deed by advertisement and sale
pursuant to Oregon Revised Statutes §86.705 et seq., and to cause to be sold at public auction to the
highest bidder, for cash or certified funds, the interest in said described property which Grantors had, or
had the power to convey, at the time of the execution of the Trust Deed, together with any interest the
Grantors acquired after the execution of the Trust Deed, to satisfy the obligations secured by said Trust
Deed together with the expenses of sale, including the compensation of the Trustee as provided by law,
and the reasonable fees of the Trustee’s attorney.

house steps of the Clatsop County Courthouse, 749 Commercial Street, Astoria, OR 97103.
H. RIGHT TO REINSTATE: NOTICE IS FURTHER GIVEN that at any time prior to five (5) days before
the sale, this foreclosure proceeding may be dismissed and the Trust Deed reinstated by payment to the
Trustee of the entire amount then due (other than a portion of the principal as would not then be due had
no default occurred), and by curing any other default complained of herein that is capable of being cured
by tendering the performance required under the obligation or Trust Deed, and in addition to paying said
sums or by tendering the performance necessary to cure the default, by paying all costs and expenses to
