The Seaside Planning Department has received the following re-
quest:
22-012V: A variance request by Alejandro Fraga to the 12” max-
imum exposure height for the perimeter block skirting of a manu-
factured home (Section 4.135, 2 of the Seaside Zoning Ordinance).
The applicant is requesting additional exposure based on the floor
elevation requirements within the 100 year floodplain. The subject
property is located at 1369 9th Avenue (T6-R10-S15CD-TL1200)
and it is zoned Suburban Residential (SR).
The review will be conducted in accordance with Article 7 and Ar-
ticle 10 of the Seaside Zoning Ordinance, which establishes the
review criteria and procedures for a variance.
A copy of the application, applicable criteria, documents, and
evidence relied upon by the applicant are available for review at
no charge. These materials can be reviewed at the Community
Development Department, 1387 Avenue U in Seaside. Copies of
these materials will be provided at a reasonable cost.
All interested persons are invited to submit written testimony in
favor or in opposition to the request. Written testimony submitted
by 5:00 p.m., March 4, 2022; will be considered by the Planning
Director in rendering a decision on the application. Comments
received after this date will not be considered. Comments may

HAS PROPOSED LAND USE REGULATIONS THAT MAY
AFFECT PERMISSABLE USES OR THE VALUE OF YOUR
PROPERTY AND OTHER PROPERTIES IN THE GEARHART
URBAN GROWTH BOUNDARY
Notice is hereby given the Gearhart City Council will hold a public
hearing on Tuesday, March 2, 2022, at 6:00 pm., Gearhart City
Hall 698 Pacific Way, Gearhart, Oregon 97138. The purpose of
the hearing is to consider the proposed Gearhart Parks and Rec-
reation Master Plan Draft prepared by the Park Plan Citizens Advi-
sory Committee, amended by the Gearhart Planning Commission,
and funded by the Oregon Park and Recreation Department.
PROPOSAL: The proposal amends the Gearhart Comprehensive
Plan by referencing and enacting the Gearhart Parks and Rec-
reation Plan policies, strategies, and maps. The amendments
shall comply with and overlap with sections of the Comprehensive
Plan including the General Development Goals, Recreation Goal
8, Transportation Goal 12, Necanicum Estuary Goal 16, Coastal
Shorelands Goal 17, Beaches and Dunes Goal 18. The amend-
ments affect the Gearhart Zoning Ordinance Section 3.9 Parks
and Open Space Zone, and incorporate Sections 4.080 Pedestri-
an Access, Circulation & Bike Parking provisions.
REVIEW CRITERIA: Relevant approval criteria are the Gearhart
Zoning Ordinance Article 11 Amendment Criteria; the Gearhart
Comprehensive Plan and the Oregon Statewide Planning Goals.
All documents and evidence relied upon and applicable criteria
pertinent to the amendments will be available for review on the city
website www.cityofgearhart.com and at Gearhart City Hall at the
office of Chad Sweet, 503-738-5501 and copies may be obtained
at a reasonable cost. The Draft Plan and city staff report will be
available for inspection at no cost and may be obtained at reason-
able cost seven (7) days prior to the hearing. All interested parties
are invited to express their opinion for or against the request at the
hearing or by letter addressed to the Gearhart City Council, Post
Office Box 2510, Gearhart, Oregon 97138, or by email at
planning@cityofgearhart.com received prior to 4:00 o’clock pm the
day of the hearing. The public hearing will be conducted in accor-
dance with Section 13.050 of the Gearhart Zoning Ordinance. The
final decision will be made by the Gearhart City Council.
Any person testifying may appeal the decision, however,
failure to raise an issue, including constitutional or other issues re-
garding conditions of approval, with sufficient specificity to afford
the City and parties to the request an opportunity to respond to
the issues precludes appeal on said issue to the State Land Use
Board of Appeals (LUBA), or to seek damages in circuit court due
to a condition of approval.
About this Notice: In 1988 Oregon voters passed a law known as
Ballot Measure 56. It requires that notices be mailed to landown-
ers when a change in land-use laws might limit the use of their
property. The law requires the City of Gearhart to use the wording
in such notices, even though the wording does not describe the
likely effects from the change in land use laws. The Measure also
requires the notice to say that the City of Gearhart has determined
that the proposed land use changes “may change the value of your
property”. However, the City of Gearhart does not know how these
amendments might affect the value of your property, if at all.
