NOTICE IS HEREBY GIVEN that on May 25, 2021, the
Circuit Court of the State of Oregon for Clatsop County entered
an Order Approving Plaintiff’s Motion for Appointment of Receiver
(the “Order”) in the above-captioned case. This Notice is provided
pursuant to ORS 37.330(3).
The Order appoints Kenneth S. Eiler as receiver (the
“Receiver”) over the assets of NCR, Hemsley, and Astoria Star,
except for property of Hemsley that constitutes personal property
primarily used for personal, family, or household purposes, or that
is otherwise exempt from execution under applicable law (the “Re-
ceivership Estate”). The Receivership Estate includes real prop-
erty commonly known as 1681 Franklin Avenue, Astoria, Oregon
97103 and legally described as follows:

Notice of Automatic Stay.
The entry of the Order imposes an automatic stay
against most collection activities. This means that creditors gen-
erally may not take actions to collect debts from NCR, Hemsley, or
Astoria Star or their property, or attempt to exercise control over
assets of the Receivership Estate. For example, while the stay
is in effect, creditors cannot sue, garnish, assert a deficiency, re-
possess property, or otherwise try to collect from NCR, Hemsley,
or Astoria Star or from assets of the Receivership Estate. Credi-
tors who violate the stay may be required to pay actual damages,
costs, and reasonable attorney fees incurred as a result of the
violation.

Do Not File Claims at This Time.
No claims may be submitted until a claims process is
first established by the Receiver. Unsecured creditors will receive
further notice of a claims filing deadline and instructions how to file
a claim once the Receiver fixes such claims process.
