HEARING
CANNON BEACH CITY COUNCIL
The Cannon Beach City Council will hold a public hearing on Tuesday, August 6, 2019 at 7:00 p.m.
at Cannon
Beach City Hall, 163 East Gower Street, Cannon Beach, regarding the following:
ZO 19-01, the City of Cannon Beach request for Zoning Ordinance text amendment; revision
of Municipal Code Chapter 17.77, Short-Term Rentals. The proposed amendments address
short-term rental permit administration, enforcement and standards. The request will be
reviewed against the criteria of the Municipal Code, Section 17.86.070.A, Amendments
Criteria.
All interested parties are invited to attend the hearings and express their views. Statements will be
accepted in writing or orally at the hearing. Failure to raise an issue at the public hearing, in person or
by letter, or failure to provide statements or evidence sufficient to afford the decision maker an oppor-
tunity to respond to the issue precludes appeal to the Land Use Board of Appeals based on that issue.
Correspondence should be mailed to the Cannon Beach City Council, Attn. Colleen Riggs, PO Box
368, Cannon Beach, OR 97110 or via email at riggs@ci.cannon-beach.or.us. Written testimony re-

Parcel 1: A tract of land in Section 30, Township 8 North, Range 9 West of the
Willamette Meridian, in the County of Clatsop and State of Oregon, described as follows:
Beginning at a point in the center line of the Oregon Coast Highway known as Alternate

Parcel 2: Beginning at the Northeast corner of the tract of land in Section 30, Township 8
North, Range 9 West of the Willamette Meridian, which tract was conveyed by grantors to
grantees by Deed recorded in Book 637, Page 857 and 858 on May 31, 1985 in record
of deed, County of Clatsop, State of Oregon; thence South along the East line of

No action has been instituted to recover the obligation, or any part thereof, now remaining
secured by the Trust Deed, or if such action has been instituted, such action has been dismissed
except as permitted by ORS 86.752(4).
Both the Beneficiary and the Trustee have elected to sell the real property to satisfy the
obligations secured by the Trust Deed and a Notice of Default has been recorded pursuant to Oregon
Revised Statutes 86.752(3). The default for which the foreclosure is made is Grantors failure to pay
when due the following sums:

Late charges $72.50 each for 9/1/17 – 3/1/19 $1,377.50
For payments not made within 15 days of the due date
County ad valorem taxes (through April 15, 2019) $11,002.64
By reason of the default just described, the Beneficiary has declared all sums owing on the
obligation secured by the Trust Deed immediately due and payable, those sums being the following, to-
wit:
(a) principal amount of $262,577.04 as of March 1, 2019 plus interest at the rate of 5%
per annum from March 1, 2019 until paid; (b) plus late charges; (c) any additional
advances, unpaid real property taxes; (e) plus attorney fees and costs incurred related to
the foreclosure less any unapplied funds; and (f) plus all sums expended by Beneficiary
to protect its interest during the pendency of this proceeding.
By reason of said default, Beneficiary under the Trust Deed, and the Successor Trustee
have elected to foreclose the Trust Deed by advertisement and sale pursuant to ORS 86.706 to ORS
86.806 and sell the real property identified above to satisfy the obligation that is secured by the Trust
Deed.
NOTICE IS HEREBY GIVEN that the undersigned Successor Trustee will on August 30,
2019 at the hour of 11:30 o’clock, A.M., in accord with the standard of time established by ORS 187.110,
at the North door of the Clatsop County Courthouse, 749 Commercial Street, in the City of Astoria,
County of Clatsop, State of Oregon, sell at public auction to the highest bidder for cash the interest
in the real property described above which the Grantor had or had power to convey at the time of the
execution by Grantor of the Trust Deed together with any interest which the Grantor or Grantor’s suc-
cessors in interest acquired after the execution of the Trust Deed, to satisfy the foregoing obligations
thereby secured and the costs and expenses of the sale, including a reasonable charge by the Trustee.
NOTICE IS FURTHER GIVEN that any person named in ORS 86.778 has the right, at any
time prior to five days before the date last set for the sale, to have this foreclosure proceeding dis-
missed and the Trust Deed reinstated by payment to the Beneficiary of the entire amount then due
(other than such portion of the principal as would not then be due had no default occurred) and by
curing any other default complained of herein that is capable of being cured by tendering the perfor-
mance required under the obligation or Trust Deed, and in addition to paying those sums or tendering
the performance necessary to cure the default, by paying all costs and expenses actually incurred in
enforcing the obligation and Trust Deed, together with Trustee and Attorney fees not exceeding the
amounts provided by ORS 86.778.
      Without limiting the trustee’s disclaimer of representations or warranties, Oregon law requires the
trustee to state in this notice that some residential property sold at a trustee’s sale may have been used
in manufacturing methamphetamines, the chemical components of which are known to be toxic.
Prospective purchasers of residential property should be aware of this potential danger before decid-
ing to place a bid for this property at the trustee’s sale.
In construing this notice, the singular includes the plural, the word Grantor includes any
successor in interest to the Grantor as well as any other person owing an obligation, the performance
of which is secured by the Trust Deed, and the words Trustee and Beneficiary include their respective
successors in interest, if any.
