State mandates increased safety
around pulled-over vehicles
The Daily Astorian
Beginning in January, driv-
ers will be required to move
over to another lane or slow
down by at least 5 mph below
the posted speed limit for any
vehicle stopped next to the
side of the road displaying
hazard lights or other signs of
distress.
Under current law, driv-
ers have to move over — or
if unable to move over safely,
to slow down — only for
emergency services, road-
side assistance and tow trucks
when they displaying warning
lights.
The offense for break-
ing the new law will remain
a Class B traffic violation.
A person is not in violation
of the move-over law if a
stopped vehicle is in a desig-
nated parking area.
The state Department of
Transportation was behind
the law as a means to increase
safety for motorists stopped
along highways. Between
2011 and 2015, there were
167 serious crashes and eight
deaths in incidents where a
vehicle was parked on the side
of the road and there was no
emergency vehicle with lights
on involved. There were six
serious crashes and no deaths
when an emergency vehicle
with hazard lights was aiding
a motorist.
