public hearing on Wednesday, April 5, 2017 at 6:00 p.m., Gearhart City Hall,

An Appeal submitted by Terry Lowenberg appealing the decision of the
Planning Commission denying a revision to their approval of Conditional

that a ballot title for an initiative petition was filed with the City Elections
Officer on March 10, 2017. The initiative petition complies with
constitutional requirements. Any elector dissatisfied with the proposed
ballot title may petition the Clatsop County Circuit Court seeking a

SUMMARY
If approved, the Amended Vacation Rental Dwelling Ordinance would:
Reduce annual fees from $600 to $500, and change cancellation
requirements;
Require fees to be spent on police and fire departments;
Change the maximum occupancy to two persons over the age of 12 per
bedroom, plus three additional people over the age of 12 per dwelling
unit, plus children;
Eliminate off street parking, residential appearance, and garbage service
requirements; require compliance with City ordinances;
Eliminate Septic Sewer Capacity Inspections, and Cesspool prohibitions;
Eliminate the Notice of Occupancy Requirements;
Eliminate the requirement that a 24 hour representative be able to
physically respond to the site within 30 minutes;
Eliminate Neighbor Notice Requirements;
Allow the safety inspection to be conducted by any licensed home
inspector;
Allow permit to transfer with property ownership change;
State that no more than seven percent of total dwelling units in Gearhart
may hold a permit for Vacation Rental use; and
Require voter approval of any change in law applying to vacation rental
permit property owners.
