The King County Pros- ecutor’s Office says Cody Lee Miller was charged in King County’s regional men- tal health court Friday with misdemeanor assault and malicious mischief charges. But, officials say, if he com- plies with conditions includ- ing mental health treatment and daily medication mon- itoring, the charges will be dismissed. Miller was originally charged with felonies after he climbed to the top of the tree in March and remained there for about 25 hours, ignoring police efforts to coax him down and throwing apples and branches at responders. The drama sparked intense interest on social media, with new Twitter accounts and the hashtag #ManInTree trending. Miller was found not competent to stand trial and sent to Western State Hos- pital for several months of mental health treatment. GERANIOS Associated Press SPOKANE, Wash. — The western United States set records for low winter snow- pack levels in 2015, and a new report blames high tempera- tures rather than low precip- itation levels, according to a new study. Greenhouse gases appear to be a major contributor to the high temperatures, accord- ing to the study published Monday in the journal Geo- physical Research Letters. Scientists looked at snow-measurement sites in California, Oregon, Washing- ton state, western Nevada and western Idaho. They found that in 2015, more than 80 per- cent of those sites experienced record low snowpack lev- els as a result of much warm- er-than-average temperatures. Most of the previous records were set in 1977, a drought year, said Philip Mote, lead author of the study and director of the Oregon Climate Change Research Institute at Oregon State University. “The 2015 snowpack sea- son was an extreme year,” Mote said. “But because of the increasing influence of green- house gases, years like this may become commonplace over the next few decades.” Winter snowpack in the mountains is important in the arid West because the melting snow provides precious water in dry months. The snow drought last winter led the governors of California, Ore- gon and Washington to order reductions in water use. California has been in a drought since 2011. Oregon and Washington experienced much higher-than-average temperatures during the 2014- 15 winter, but they were not as dry overall as California, the report said. We’ve got you covered... WARRENTON — War- renton Police arrested two more people they say are connected to the theft of a rifle from Fred Meyer in October. Max Rauh, 18, and Con- nor Morgan, 18, both from rural Astoria, were arrested Monday and charged with first-degree theft. They appeared in surveillance footage of the Oct. 21 theft and it seems obvious they knew what was going on when their friend James Ogier broke the rifle out of its safety devices and took it, said Warrenton Police Chief Mathew Workman. “They didn’t react like a normal person would,” he said. Rauh and Morgan deny they were involved in the theft of the rifle, but admitted to police they knew Ogier, 20, also of Astoria, had sto- len the rifle when they were outside the store. Workman said anyone who witnesses a crime needs to report it, once it’s safe to do so. Looking at the video footage, he has his doubts about the men’s statements. Ogier was arrested sev- eral days before Rauh and Morgan after a correc- tions deputy recognized him in the surveillance foot- age. He faces charges of first and second-degree bur- glary, second-degree crim- inal mischief, tampering with physical evidence and first-degree theft as well as a probation violation. Police were able to recover the rifle and arrest the primary suspect within roughly 24 hours of the crime being committed, Workman said. Family of man who died falling off Seaside deck settles suit Associated Press PORTLAND — The fam- ily of a 77-year-old man who died after falling while try- ing to step onto a deck has agreed to settle its lawsuit against a Seaside vacation condominium. The Oregonian/Oregon- Live reported that the fam- ily of David Lloyd Roach dropped its $4.3 million law- suit in exchange for $37,500. The civil trial had been set to start last week in Multnomah County Circuit Court. Roach was renting sev- eral units in the oceanfront vacation condo complex in August 2013 when he tried to step from the grass onto the deck of one of the units. The deck was 14 inches off the ground. Roach stubbed his toe on the deck, fell back- ward and struck his head. He died as a result of his injuries.
