Seaside Planning Commission at Seaside City Hall, 989 Broadway, to take
testimony regarding the following item:
16-048VRD & 16-049V is a request by Alan & Jennifer Goldsmith for a two
(2) bedroom Vacation Rental Dwelling Permit with a maximum occupancy of
not more than six (6) people over the age of three. The owner is also
requesting a variance to the 50% side yard landscaping requirement and
recognition of the parking within a pre-existing easement with the
neighboring property owner to the east. The property is located at 120 13th
Avenue (6-10-16DA TL 3300) and it is zoned Medium Density
Residential (R-2).
The review will be conducted in accordance with Article 6, 7, and 10 of the
Seaside Zoning Ordinance which establishes the review criteria and
procedures for a Conditional Use and Variance. The specific review
criterion for Vacation Rental Dwellings is included in Section 6.137 of the
Ordinance.
All interested persons are invited to attend the meetings and submit oral
testimony in favor or in opposition to the request. During the hearing,
individuals that wish to offer testimony will be called to a microphone by the
Chairman of the Planning Commission and asked to state their name and
address for the record before they testify. Written testimony is also
welcome and will be submitted to the Planning Commission at the time of
the hearing. Comments may be delivered to the Community Development
Department located at 1387 Avenue U or mailed to 989 Broadway, Seaside,
Oregon 97138. A copy of the application, applicable criteria, documents,
and evidence relied upon by the applicant are available for review at no
charge. Likewise, a staff report will be available for inspection 7 days prior
to the hearing. These materials can be reviewed at the Community
Development Department. Copies of these materials will be provided at a
reasonable cost.
Failure to raise an issue at the meeting, in person, or in writing, or failure to
provide sufficient details to afford the Planning Commission and the
applicant an opportunity to respond to the issue may preclude appeal to the

DEFAULT FOR WHICH FORECLOSURE IS MADE: Grantor is in default and
Beneficiary seeks to foreclose the Trust Deed for failure by Grantor to make any repayment of
principal and interest from and after the date of the original funding as described in Section 5 below.

SUM OWING ON OBLIGATION SECURED BY TRUST DEED: Beneficiary has declared
all amounts owing on the obligation secured by the Trust Deed immediately due and payable. The
sums owing on the obligation secured by the Trust Deed are: Principal in the total amount of $26,773.50,
funded $2,500.00 on October 1, 2007, $13,773.50 on November 1, 2007, and
$10,500.00 on
December 7, 2007, together with interest thereon at the rate of seven percent (7%) per annum from the

ELECTION TO SELL: Both the Beneficiary and the Trustee have elected to sell the real
property to satisfy the obligations secured by the Trust Deed. A Trustee's Notice of Default and
Election to Sell was recorded on May 9, 2016, as Recorder's Fee No. 2016 03322, Official Records
in the county clerk's office of Clatsop County, Oregon.
