You are hereby required to appear and defend the petition filed against you in the above entitled action within
thirty (30) days of the date of first publication specified here in along with with the required filing fee, and in
case of your failure to do so, for want thereof, Plaintiff will apply to the court for the relief demanded in the
petition.
NOTICE TO THE DEFENDANT: READ THESE PAPERS CAREFULLY!
You must “appear” in this case or the other side will win automatically. To “appear” you must file with the court
a legal paper called a “motion” or “answer”. The “motion” or “answer” must be given to the court clerk or
administrator within thirty (30) days of the date of first publication specified herein along with the required
filing fee. It must be in proper form and have proof of service on the Plaintiffʼs attorney or, if the Plaintiff does
not have an attorney, proof of service upon the Plaintiff.
The complaint alleges that you violated the Residential Landlord-Tenant Act by providing a nonhabitable
leasehold, by permitting contractors to repeatedly enter an area reserved to Plaintiffs under the rental
agreement without Plaintiffsʼ consent or notice to Plaintiffs, and by issuing a notice of termination of Plaintiffsʼ
lease in retaliation for Plaintiffsʼ complaints; that you discriminated against Plaintiffs on the grounds of race by
delaying remediation of nonhabitable conditions and issuing the notice of termination in violation of ORS
93.360 and 659A.421; and other allegations against other defendants. On claims against you, Plaintiffs seek
damages totaling $12,800.00 against Mr. Falby and $5,625.00 against Mr. Noble, a declaration that the notice
of termination is invalid, their costs, disbursements, and reasonable attorney fees, and such other relief as is
just and equitable.
