Principle of Equality -BORAH Will End Im proper Con duct on Part of Courts .-OWEN dAsMrleaa Ptaae AafodatAofi. I By Senator BORAH of Idaho AM afraid that the principle of the recall as ap plied to judges will tend to es tablish the rule of the majority in matters of ju dicial controver ts It will tend to make decisions bear the color and drift of major ity rale or party domination rather than that of a faithful rendition of the law and the facta. What ia the basic principle of Democratic or Repablican govern ment t We sometimes urge that the first principle ia that the MA JORITY SHALL RULE. That is true in making laws and deter mining policies, bnt it has no place in and WTLL DESTROY RE PUBLICAN GOVERNMENT . if applied to the courts or to con trovexsies to be determined nnder the law. There all men are eqnal. BACK OF THE RULE OF THE MAJORITY IS THE OR EAT PRIN- . CIFLE OF EQUALITY. THE BASIC, BEDROCK PRINCIPLE OF FREE GOVERNMENT. ' The difference between the old democracies or republics which perished and oars is that the an cient republics could devise no way by which to shield the RIGHTS OF THE MINOR TTY. Though the majority most rule, yet a government which has bo method . for protecting - the rights of the minority for it has rights is a deapotus government ,1 do not care whether yon call it r-onarchv or a republic. . r he '4 If By Senator OWEN of Oklahoma 7 the power of recall ex ists the con duct of judges will be bo exem plary, so satis factory to the people of the United States thst no recall of any federal judge would ever be necessary. THE MOMENT THE RECALL WENT INTO EFFECT THE COURTS WOULD PROMPTLY DISCONTINUE THEIR UNAUTHORIZED. UNCON STITUTIONAL AND GROSSLY IM. PROPER CONDUCT OF DECLAR ING AN ACT OF CONGRESS UN. CONSTITUTIONAL. The recall is justified Jy REA SON AND COMMON SENSE. 1 cannot see why any one should insist' that a judge, infirm, dis abled, feeble, decrepit and worn out, should not be recalled except by impeachment. The recall ia a much milder system than impeach ment and may remove a judge WITHOUT DISGRACE. Never during the ten years that the right of recall has existed in Oregon have the people availed themselves of it against a judge, although there is oue case pending these now which undoubtedly will be decided wisely by the people. The reactionary Tory argument that the people are TURBU LENT.
