No Evidence That H. M- Keller Was
Guilty of Larceny.

V. and H. M. Keller, of Sandy ac
cused of "roliblng , the store at that
place a month ago who appeared be
fore Justice Samson Saturday, resulted
In the dismissal of the chirge as
against H. M. Keller. Edward M. Kel
ler, the older brother, was bosrod over
to Circuit Court on a bond of IS'.
There was no evidence that the
younger -brother bad participated In
the theft even in case ir is proved
against Ihe other though he Admit
ted a knowledge that the older brother
had the goods and be was suspicious
as to where they might come from.
The father, who lives at Rlxerslde
Mills, near Estacada, was present but
did not manifest any Inclination to go
on the bond of the elder son. The
excuse was made for tba young man
by his friends that he must ba a klep
tomaniac. It seems that ha has been
in, trouble before and that he waa sent
to reform school in Colorado In his
younger years. - -
ALEXANDER AND BERRY APPEAL.
Suit for Cancellation of Deed Goes Up
to Supreme Court.
The case of Milton L. Freeman vs.
J. T. Alexander and Frank T. Berry
will be appealed to tha Supreme Court
and notice of appeal was filed in the
county clerk's office Saturday. Free
man brought auit to cancel a deed to
the northeast quarter of tha northeast
quarter of section 6. township 6 south,
range 2 east. Freeman claimed that
the deed was never lawfully delivered
to tha defendants and Was recorded
without warrant and against the con
sent of Freeman. The Clrcujt Court
declared the deed void and ordered
lta cancellation. E. B. Dufur Is at
torney for Freeman and Oglesby
Young for Alexander and Berry.
