Section 1. There la hereby appro
priated tbo sum of $680,000 to bo used
aa provided for In thla act, one-half of
hlch ehall bo available in tbo year
1811 and tbo remainder in tbo year
1813.
Section t. Each county, a now or
ganized In thla atate, ahall be entitled
to receive $10,000 of tbo money appro
priated by Section one of thla Act for
tho year 1811, and $10,000 for the year
1313, to be used in the construction of
permanent roads In that county aa pro
vlded In thla act
Section 3. Whenever any county
ahall dealre to accept tho money as
mentioned In aectlon two of thia act
it ahall provide and make available aa
needed, a fund of $30,000 to be uaed
with the $5,000 mentioned In aectlon
two for the construction of a perma
nent road In that county. After hav
inr ao provided ouch fund tho county
court ahall select the particular loca
tinn of tho road to be constructed and
shall designate tho place, of beginning
and definitely describe tho location ol
the road, all of which ahall be entered
on tbe Journal of the court. Such
road ahall begin at one of tbe principal
market placea In the county or ahall
connect with a permanent road lead
ing to auch place, and shall bo ao locat
ed aa that when constructed, aa herein
vlded. it will constitute one oT the

SeAlpn 4. All roads conatrncted nn
def the provlslona of this act ahall be
constructed by and under the exclua-
Ive direction and control' of tbe state
Highway Commissioner. Whenever
the county court ahall have compiled
wtth the reaulrementa of aectlon three
of thla act It shall notify the'Com;
mlaaloner of tbat fact and at tho same
time render him assurance that if haa
or will procure when needed auch ma
chinery, tool a and tppllancea aa tney
may determine will be needed In the
construction of auch road.- but no pan
of tho fund of $30,000 mentioned In
aectlon three of thla act ahall bo uaed
for tbe purchase of machinery, toola
or appliancea or for any other purpose
than the construction of such road.
Necessary engineering and supervision
work ahall be deemed conatructlon.
Aa aoon aa the Commissioner ahall be
satisfied that the county court haa
complied with the requlrementa of
aectlona three and four of thla act ne
ahall comenco the conatructlon of auch
road at the place of beginning thereof
aa designated by the county court and
proceed with auch construction aa ex
peditiously aa possible. Aa the work
of conatructlon proceeda the coat
thereof ahall be paid aa follows: At
tho end of each calendar month, or
oftener, In tho discretion of the Com
missioner, he ahall prepare an Item
ized atateroent In triplicate showing
the amounta duo on account of the con
atructlon of auch road and the persona
to whom It 1b owing. One of theae
Btatementa of account ahall be deliv
ered to the county court one to the
Secretary of State, and the other he
ahall keep on file aa a part of tho rec
ords of hla office. Aa soon aa the
county court receives auch statement
of account It ahall cause warrant a to
bo drawn according to such statement
for C6 2-3 per cent thereof, and aa Boon
as the Secretary of State ahall receive
auch atatement of account be shall in
tho same manner draw warrants upon
the State Treasurer for 33 1-3 per cent
thereof, and In thla way shall such
payments proceed until $30,000 ahall
have been expended.
Soctlon 5. All roada constructed
under the provlslona of thla act shall
be constructed according to tho best
and most scientific methods, and ao
k to make them as durable and per-
jnanent aa possible, and no part of
auch road shall bo constructed upon
greater grade than seven per cent ex
cept by direction of tho State Highway
Board.
Section 8. If any road, or any part
thereof, constructed under , tho pro
vlslona of thla act shall bo constructed
by contract specifications showing
whst is to be Included In any- auch
contract ao aa to enable any one of
ordinary understanding In such mat
ters to understand the same ahall be
prepared in duplicate, one of which
ahall bo delivered to the county court
and the other ahall be kept on file by
tho Commissioner aa a .part of the
recorda of his office, and both of
which ahall be open to the Inspection
of prospective bidders. After tho pre
paration of auch specifications notice
inviting blda according to auch apect
ricatlona ahall bo printed for at leaat
two weoka In two newapapere printed
In-the county, or If there la but one
auch paper then In It, and alao by post
ing one copy of such notice, at the
court house door.. All bida ahall bo
publicly opened by tho Oommlaaloner
at tho ofloe of tho county Judge, or at
auch other .room in tho court house as

ment for bids, at such time as may bo
