ur Rust "framed up" his own kidnap
ping February 1 in order to obtain
money from his father, was the sensa
tional change made by the defense Fri
day in the trial of Hugh Van Am
burgh, being tried for the abduction ol
the son of W. R. Rust, local million
aire. The charge was made before a
crowded courtroom. It was entire
ly unexpected.
"The defense will show," declared
Attorney 'Gordon, "that Van Amburgn
confessed to the kidnapping to shield
Arthur Rust. We will show that
the boys were well acquainted, that
on the day of the alleged kidnappin
Kust stopped van Amburgn and en
tered his automobile, that Rust plott
ed the abduction to obtain money,
that Rust helped to write the note de
manding $20,000 ransom, that Ru
was not bound until it was feared that
the police -were coming."
The defense issued subpoenas for
six witness after making the charges.
These witnesses, not before mention
ed in the case, will prove the contea
tions of Van Amburgh, Attorney Goi-
don asserted.
After the statement of the defense
the state called Arthur Rust to the
itand as Its first witness. He detail
ed the alleged kidnapping, nis testi
mony coinciding with the confessions
of Van Amburgh, when he was arrest
ed and accused of the crime.
The minimum penalty for kidnap
ping under tne state law is 10 yeara-j
in rthe state penitentiary.
OBITUARIES
Frank Skillman, aged 77 years, died
at his home at Mount Pleasant, about
two miles from Oregon City Thurs
day morning at 2 o'clock.
Mr. Skillman, who was a retired
druggist, arrived in Oregon City from
New York about sixteen years ago,
where he purchased a small farm
near Mount Pleasant.
Deceased is survived by his wife,
Mrs. Mary Skillman, of Mount Pleas
ant, and several brothers and sisters
of Portland. The remains are at the
undertaking; parlors of Holman &
Pace, but funeral arrangements have
not yet been made.
The funeral services of Franklin
Skillman, who died at his home at
Mount Pleasant Thursday, will be held
from the Congregational church in
this city Monday afternoon at 2s

Word has been received in this
city by relatives and friends of An
drew Robertson, former resident 01
Oregon City, -whose home has for a
number of years been in Sellwooa,
died in Arizona Thursday, March 24,
after a brief illness of lune trouble.
.Mr. Robertson recently left for Ari
zona for the benefit of his health, his
family being with him at the time 01
his death.
Deceased engaged in the grocery
business in Oregon City for some time
previous to taking up his home anu
entering a similar business in Sell
wood. He was an active member 01
(he Prescbyterian church while resid
ing here, and well known in this city.
Mr. Robertson is survived by his
wife, Mrs- Emily Robertson, formerly
Miss Holden, of this city, whom ho
married while residing here; a daugh-
', Miss Lillian Robertson and a son,
Edward Robertson, of Sellwood. He
also leaves a sister.
Deceased was a son-in-law of Mrs.
A. Holden. of Oregon City, and broth
er-in-law of Mrs. F. W. Greenman, ol
Eighth and Madison streets.
The remains are being shipped
north, and funeral services are to be
held in Sellwood upon the arrival of
the body.

BOSTON, March 24. The body of
lieutenant Warren H. Langdon, Unit-
d States navy, sent to his family here
from Vladivostok, where he was killei
by a Japanese sentry in January, was
buried today at Forest Hills ceme
tery.
The navy paid final honor to its
lead through officers of equal rank,
who were the honorary pallbearers;
non-commissioned officers, who con
stituted the, body bearers; an escort
of 150 bluejackets, who followed be-
ind the caisson, a band and a fir
ing squaa.
The funeral services of Francis Fos
ter, who died suddenly at his home
near Willamette Saturday evening,
were held from the Holman & Pace
funeral chapel Monday afternoon at 2
'clock.
Rev. Willis Pettibone, pastor of the
Baptist church, officiated, and a largj
number of friends of the family at
tended the services.
Interment was in the Mountain
View cemetery.

Tuesday afternoon, March 15, Mrs. Ei
la Soules informed Chas. L. Ogle that
the Ford car which stood in front ot
the house had been there since the
night of March 5 and had not been
moved during that time.
During the several days following
the family discussed the matter of
taking the robe out of the car ana
putting it in the yard. As the car
stood there so long, Mrs. Soules con
sidered that the authorities should
be notified and requested Mr. Ogle to
do so. He secured the name and
numoer or the car. then saw Marshal
Covey, who first attended to a long
distance call and then looked into the
matter on the 16th. It was learnen
that the car had been stolen from
Miles Bradford at Salem on the night
of March 5th.
This brings out the theory that the
the thief got it to go after first-class
booze that was cached, but found the
car too small and came to Woodburn
in the Ford for a larger car.
It is thought' by some that he and
another had the booze stored anu
the other watched the place, while
he went after a big car, fearing, to
pass ith rough Oregon City and Into
Portland with a Ford full of the
stuff. A few are under the impres
sion that the liquor was at Salem
and had been brought in thn Ford
and cached between Salem and Wood
burn; that the party or panties had
been hired by no common bootlegger,
but by a higher-up.
The authorities have, not given up
hope of apprehending the murderer,
and efforts are being made to do so.
It is said the Pinkertons have become
interested and are active.
On the night of the murder a party
was passing the Gervais road at about
11:30 and heard a big argument gt-

chine. This was undoubtedly YoJei

highway passed on, considering it
none of his business and not wishing'
to mix in.

SUCCUMBS TO
HEART ATTACK
Mrs. Elizabeth Shivley, widow of the
late William B. Shivley, a pioneer
merchant of Portland and Oregon
City, died suddenly in this city Tues
day afternoon from heart trouble.
Mrs. Shively had been suffering
from a 6ever cold for several days,
and was under the doctor's care, but
Tuesday morning she had greatly im
proved and believing that a walk in
sunshine would be benificial to hei,
started down Main street, but was
stricken at Main and Seventh streets.
Dr. W. E. Hepmstead was summoned,
but Mrs. Shively passed away shortly
after the attack.
No woman in Oregon City was held
in higher esteem than Mrs. Shively.
She was loved by her hundreds of
friends. She wa s of a
sunny disposition and her charming
personality attracted many friends
throughout the county.
Mrs. Shively was born nead Dan
ville, Illinois, and moved with her hus
band to Portland, Oregon, in 1881,
residing there for twelve years, where
her husband engaged in business and
later came to Oregon City, arriving
here in 1894, where she has since re
sided. She engaged in business heie
with her daughter; Miss Lillie Shive
ly, who managed the Shively opera
house for many years.
Mrs. Shively is survived by her
daughter, Miss Lillie Shively of thig
city, and Attorney William B. Shive
ly, of Portland. Mr. Shively, her
husband, died in 1907.

Mr. Snillman was an influential
man of New York, wnere ne engaged
in the druggist business, later moving
to South Dakota, before coming to
Oregon 16 years ago.
Mr. Skillman was a veteran of the
Civil War, and his casket was drapeiT
vith the national colors. A num
her of the old veterans here attend
ed the funeral service. Deceased was
1 member of the Masonic lodge. In-
erment was in the Masonic cem:

Elmer E. Comstock, aged 26 years,
died at the family residence a Canby
Saturday night from tuberculosis.
Deceased is survived by his parents,
Mr. and Mrs. Comstock, and a broth
er, of Canby, and a. sister, residing

morning at the Canby Nazarene
church, with interment in the Zion
cemetery, Canby.

received a penitent letter from the
man and a check covering the back

make, namely, a decision to be
strictly honest, and my conception f
honesty is that it is one's duty to
pay his taxes and as hunting an-;1
angling fees or license fees are a kind
of tax, I inclose the amount necessary
to cover three unpaid license fees,
which is $4.50," wrote the Hubbara
man. "I know it is common practice
with many to dodge paying their
obligations for hunting and fishing,
but that day is past with me. Will
close, hoping I need never write you
the same kind of letter again.
Francis M. Foster, aged 64 years,
dropped dead from heart failure Sat
urday evening about 5:30 o'clock at
his home near Willamette. Foster
bad just made a trip to Oregon City,
and upon his return to his place, haa
started in to do the chores when the
fatal attack came. Deceased came
to this -county a few months ago and
settled on a farm about two miles
out of Willamette. He leaves a
wife and several grown children. The
body is at the parlor3 of Holman &
Pace, this city.

Common School
Fund Not Available
Until Last of April
No apportionment of the common
school fund will be made until the lat
ter part of April, according to a state
ment of Brenton Vedder, county
school superintendent. Heretofore,
the fund has been alotted along about
April 1, each year, but the money will
not be available for about a month.
The data for the apportionment of the
2-mill elementary tax fund has not
been set.
THREE MEN
PAY FINES IN
CITY COURT
W. and J. Boyland, arrested Satur
day night on Main street for being
intoxicated and having liquor in their
possession, appeared before City
Judge Kelly Monday afternoon and
were fined $50 each. Geo. Armstrong,
who was in the party arrested, paid
a fine of $5. Chief Hadley and Night
Officer Wagenblast made the arrests.

estimates at between $75,000 and
$100,000 was suffered by Kafoury
Bros., a mercantile firm on State
street, ; early Wednesday, when prac
tically their entire stock was destroy
ed. An 'additional loss of $15,000 was
sustained by the Hushes estate, which
owns the building in which the store
was located.
