WASHINGTON, Nov. 14. la the majority opinion of the Commerce Court formally handed down today In the transcontinental rate cases. It Is held that the long-and-short haul pro vision of the Interstate commerce act Is constitutional. Temporary Injunc tion against putting the so-called "Spo kane rates' Into effect, however, Is granted. The Court, however, declares that the Interstate Commerce Commission exceeded Its authority In attempting to establish a relation betwen long and short haul rates, Irrespective of absolute rates, and It enjoins the Com mission from putting in force the or der reducing transcontinental freight rates pending a more complete Inves tigation by the court The Commerce Court reached the conclusion that the cases Involved in the present proceealng afforded the best possible opportunity for a deter mination of the constitutionality of the long-and-short-haul provision of the act to regulate commerce. It was realized that the question eventually would have to be fought out before the United States Supreme Court In the formal opinion, prepared by Judge Mack, the Commerce Court up holds the Interstate Commerce Con mission upon the point of constitution' alltv of the long-and-ehort-haul provi sion of the interstate commerce act but It gees further than the Commis sion did. and declares the law would have been unconstitutional "as an un lawful delegation of legislative pow er," If no standard were given, "to rulde the exercise of the Commis sion's discretion in granting authority to depart from the rules forbidding a lesser rate for the long and for the short haul in the same direction and over the same line." The court dis agrees with the method used by the Commission In determining the prop er rate. PRESIDENT DODGES SUFFRAGE QUESTION NASHVILLE. Tenn., Nov. 10. A plea that President Taft say a word for the women while he was asking support of the people for his peace treaties was without result here late last night for Mr. Taft ignored the letter passed into his hands until af ter he had completed his formal ad dress. The suffrage movement recently In vaded Nashville, and a great crowd that heard the President's talk about peace also wanted to get his idea of the votes-for-women campaign.
